Le bailleur invoque une clause r\u00e9solutoire de plein droit apr\u00e8s un commandement de payer demeur\u00e9 infructueux. Le juge des contentieux de la protection constate la r\u00e9siliation, condamne la locataire au paiement des sommes dues et autorise l&#8217;expulsion sous conditions, tout en rejetant certaines demandes accessoires.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale et l&#8217;acquisition de la r\u00e9siliation<\/p>\n<p>Le respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;action en justice est scrupuleusement v\u00e9rifi\u00e9. Le juge rel\u00e8ve que l&#8217;assignation a \u00e9t\u00e9 r\u00e9guli\u00e8rement notifi\u00e9e au repr\u00e9sentant de l&#8217;\u00c9tat, conform\u00e9ment \u00e0 l&#8217;article 24 de la loi du 6 juillet 1989. Il constate \u00e9galement la saisine obligatoire de la commission de coordination des expulsions locatives, celle-ci \u00e9tant justifi\u00e9e par le bailleur. Cette \u00e9tape est imp\u00e9rative d\u00e8s lors que les seuils d&#8217;anciennet\u00e9 et de montant de la dette, fix\u00e9s par arr\u00eat\u00e9 pr\u00e9fectoral, sont atteints. La recevabilit\u00e9 de la demande est ainsi \u00e9tablie sur le fondement d&#8217;une proc\u00e9dure r\u00e9guli\u00e8re.<\/p>\n<p>La r\u00e9solution de plein droit du contrat est ensuite constat\u00e9e au regard des conditions l\u00e9gales et contractuelles. Le bail contient une clause r\u00e9solutoire pr\u00e9voyant la r\u00e9siliation pour d\u00e9faut de paiement apr\u00e8s commandement infructueux. Le juge note qu'&#8221;un commandement de payer visant la clause r\u00e9solutoire et rappelant les dispositions de l\u2019article 24 de la loi n\u00b089-462 du 6 juillet 1989 et de l\u2019article 6 de la loi du 31 mai 1990 a \u00e9t\u00e9 signifi\u00e9&#8221; (Motifs, Sur la r\u00e9siliation du bail). Il rel\u00e8ve que les causes de ce commandement &#8220;sont demeur\u00e9es impay\u00e9es \u00e0 l\u2019issue du d\u00e9lai l\u00e9gal au terme duquel la r\u00e9siliation de plein droit du contrat de bail est acquise&#8221; (Motifs, Sur la r\u00e9siliation du bail). Cette analyse rejoint la jurisprudence qui estime que les conditions d&#8217;acquisition de la clause sont r\u00e9unies lorsque le commandement est rest\u00e9 infructueux pendant le d\u00e9lai l\u00e9gal. La r\u00e9siliation est donc acquise \u00e0 la date fix\u00e9e par le juge.<\/p>\n<p>Les cons\u00e9quences de la r\u00e9siliation et le rejet des demandes accessoires<\/p>\n<p>Les suites de la r\u00e9siliation sont ordonn\u00e9es en tenant compte des \u00e9quilibres l\u00e9gislatifs entre les parties. Le juge condamne la locataire au paiement de l&#8217;arri\u00e9r\u00e9 locatif et d&#8217;une indemnit\u00e9 d&#8217;occupation fix\u00e9e au montant du loyer jusqu&#8217;\u00e0 la lib\u00e9ration des lieux. Il autorise l&#8217;expulsion, mais en assortissant cette mesure d&#8217;un d\u00e9lai de deux mois suivant un commandement de quitter les lieux rest\u00e9 infructueux. Ce d\u00e9lai est impos\u00e9 car &#8220;la r\u00e8glementation ne permet pas de retenir qu\u2019il serait \u00e0 lui seul constitutif de la mauvaise foi pour prononcer une expulsion sans d\u00e9lai&#8221; (Motifs, Sur la cr\u00e9ance du bailleur, les d\u00e9lais de paiement et la suspension des effets de la clause). Le juge op\u00e8re ainsi une conciliation entre le droit du bailleur \u00e0 recouvrer son bien et la protection du locataire.<\/p>\n<p>Les demandes accessoires du bailleur sont en revanche rejet\u00e9es au nom du droit positif. La demande de majoration de l&#8217;indemnit\u00e9 d&#8217;occupation est qualifi\u00e9e de clause p\u00e9nale d\u00e9guis\u00e9e. Le juge rappelle que &#8220;est r\u00e9put\u00e9e non \u00e9crite toute clause du contrat qui autorise le bailleur \u00e0 percevoir des amendes, ou des p\u00e9nalit\u00e9s en cas d&#8217;infraction aux clauses du contrat de location&#8221; (Motifs, Sur la clause p\u00e9nale). Concernant les dommages et int\u00e9r\u00eats, il exige la preuve d&#8217;une mauvaise foi et d&#8217;un pr\u00e9judice distinct. Il souligne que &#8220;c&#8217;est \u00e0 celui qui all\u00e8gue la mauvaise foi \u00e0 la prouver&#8221; (Motifs, Sur la demande de dommages et int\u00e9r\u00eats), ce qui n&#8217;est pas \u00e9tabli en l&#8217;esp\u00e8ce.
