Le bailleur d\u2019un bail commercial a sollicit\u00e9 la r\u00e9siliation du bail pour d\u00e9faut de paiement des loyers par le preneur. Il a \u00e9galement demand\u00e9 l\u2019expulsion, le paiement d\u2019une indemnit\u00e9 d\u2019occupation et l\u2019allocation d\u2019une provision. Le juge a prononc\u00e9 la r\u00e9solution du bail et ordonn\u00e9 l\u2019expulsion. Il a fix\u00e9 l\u2019indemnit\u00e9 d\u2019occupation au montant du loyer et accord\u00e9 une provision, tout en rejetant la demande d\u2019indemnisation pour pr\u00e9judice moral.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la r\u00e9solution du bail<\/p>\n<p>Le formalisme imp\u00e9ratif du commandement pr\u00e9alable. Le juge rappelle le cadre l\u00e9gal strict r\u00e9gissant les clauses r\u00e9solutoires en mati\u00e8re commerciale. L\u2019article L 145-41 du Code de commerce exige un commandement demeur\u00e9 infructueux un mois apr\u00e8s sa d\u00e9livrance. Le commandement d\u00e9livr\u00e9 visait express\u00e9ment la clause r\u00e9solutoire et mentionnait le d\u00e9lai l\u00e9gal. &#8220;Ainsi, le commandement de payer n\u2019a fait qu\u2019appliquer ladite clause, respectant les obligations l\u00e9gales quant \u00e0 la dur\u00e9e impartie au locataire pour r\u00e9gulariser sa situation&#8221; (Motifs). La d\u00e9cision souligne ainsi l\u2019importance d\u2019une mise en demeure formellement irr\u00e9prochable pour valider la r\u00e9solution de plein droit.<\/p>\n<p>L\u2019acquisition certaine de la clause r\u00e9solutoire. Le juge constate l\u2019inex\u00e9cution persistante des obligations par le locataire apr\u00e8s le commandement. Aucun paiement n\u2019est intervenu dans le mois suivant, et les versements ult\u00e9rieurs sont rest\u00e9s sporadiques et insuffisants. &#8220;Il n&#8217;existe aucune contestation s\u00e9rieuse quant au montant ou \u00e0 la nature de la dette&#8221; (Motifs). D\u00e8s lors, la condition de l\u2019article L 145-41 est remplie, entra\u00eenant la r\u00e9siliation automatique du bail. La date d\u2019effet est fix\u00e9e au lendemain de l\u2019expiration du d\u00e9lai d\u2019un mois, faisant du preneur un occupant sans titre.<\/p>\n<p>Les mesures prononc\u00e9es en r\u00e9f\u00e9r\u00e9 et le contr\u00f4le judiciaire<\/p>\n<p>L\u2019expulsion pour trouble manifestement illicite. Suite \u00e0 la r\u00e9solution, l\u2019occupation des lieux devient sans droit. Le juge fonde son ordonnance d\u2019expulsion sur l\u2019article 835 alin\u00e9a 1 du code de proc\u00e9dure civile. &#8220;En l&#8217;esp\u00e8ce le preneur occupe sans droit ni titre le local lou\u00e9 depuis le 27 septembre 2024, date de r\u00e9siliation du bail&#8221; (Motifs). Cette occupation constitue un trouble manifestement illicite justifiant une mesure conservatoire en r\u00e9f\u00e9r\u00e9, m\u00eame en pr\u00e9sence d\u2019une contestation sur le fond. Le juge use de son pouvoir pour faire cesser sans d\u00e9lai cette situation ill\u00e9gale.<\/p>\n<p>Le contr\u00f4le du juge sur les clauses p\u00e9nales et l\u2019octroi d\u2019une provision. Le juge mod\u00e8re la clause fixant l\u2019indemnit\u00e9 d\u2019occupation, la jugeant excessive au regard de l\u2019article 1231-5 du code civil. Il la ram\u00e8ne au montant du loyer initial. Concernant la provision, il applique l\u2019article 835 alin\u00e9a 2 du m\u00eame code. &#8220;Il n\u2019existe aucune contestation s\u00e9rieuse quant \u00e0 l&#8217;obligation payer l\u2019indemnit\u00e9 d\u2019occupation&#8221; (Motifs). Une provision est donc accord\u00e9e sur cette cr\u00e9ance certaine. En revanche, la demande de provision pour pr\u00e9judice moral est rejet\u00e9e, faute d\u2019\u00e9l\u00e9ments justificatifs. Cette solution rejoint la jurisprudence selon laquelle &#8220;l&#8217;allocation de dommages-int\u00e9r\u00eats en r\u00e9paration d\u2019une atteinte au droit \u00e0 l\u2019image et \u00e0 la vie priv\u00e9e n&#8217;a pas pour objet de sanctionner un comportement ou d\u2019avoir un effet dissuasif mais de r\u00e9parer le pr\u00e9judice subi par la victime&#8221; (Tribunal judiciaire de Nanterre, le 27 juin 2025, n\u00b025\/00662).
