Le juge constate la r\u00e9siliation de plein droit tout en accordant des d\u00e9lais de paiement au locataire et en suspendant les effets de la clause r\u00e9solutoire. Cette d\u00e9cision illustre l&#8217;articulation complexe entre la sanction du d\u00e9faut de paiement et les mesures de pr\u00e9vention des expulsions locatives.<\/p>\n<p>La sanction du d\u00e9faut de paiement et ses conditions proc\u00e9durales<\/p>\n<p>Le juge constate d&#8217;abord la r\u00e9gularit\u00e9 de la proc\u00e9dure engag\u00e9e par le bailleur. L&#8217;assignation a \u00e9t\u00e9 notifi\u00e9e conform\u00e9ment aux exigences l\u00e9gales, notamment au repr\u00e9sentant de l&#8217;\u00c9tat. La saisine pr\u00e9alable de la commission de coordination des actions de pr\u00e9vention des expulsions locatives est \u00e9galement justifi\u00e9e, rendant la demande recevable. Le respect de ces formalit\u00e9s est une condition essentielle \u00e0 l&#8217;examen du fond.<\/p>\n<p>La r\u00e9siliation de plein droit est ensuite prononc\u00e9e en application de la clause contractuelle. Un commandement de payer visant cette clause a \u00e9t\u00e9 signifi\u00e9 pour un arri\u00e9r\u00e9 locatif. Les causes de ce commandement sont demeur\u00e9es impay\u00e9es pendant plus de deux mois. En cons\u00e9quence, la r\u00e9siliation de plein droit du contrat de bail est acquise \u00e0 compter du 14 mars 2025. Cette application stricte du contrat sanctionne le manquement substantiel du locataire.<\/p>\n<p>Le pouvoir d&#8217;am\u00e9nagement judiciaire au service de la pr\u00e9vention<\/p>\n<p>Le juge use ensuite de son pouvoir d&#8217;am\u00e9nager les cons\u00e9quences de la r\u00e9siliation. Il accorde des d\u00e9lais de paiement pour le r\u00e8glement de la dette locative, fix\u00e9e \u00e0 titre provisionnel. &#8220;En application de l&#8217;article 24 de la loi du 6 juillet 1989, le juge peut, \u00e0 la demande du locataire, du bailleur ou d&#8217;office, \u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu&#8217;il ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience, accorder des d\u00e9lais de paiement dans la limite de trois ann\u00e9es&#8221; (Sur la cr\u00e9ance du bailleur, les d\u00e9lais de paiement et la suspension des effets de la clause). Cette mesure est conditionn\u00e9e \u00e0 la reprise des paiements courants.<\/p>\n<p>Le juge suspend parall\u00e8lement les effets de la clause r\u00e9solutoire pendant la dur\u00e9e des d\u00e9lais accord\u00e9s. Cette suspension pr\u00e9serve le maintien dans les lieux du locataire qui respecte son \u00e9ch\u00e9ancier. Elle est toutefois assortie d&#8217;une condition r\u00e9solutoire stricte en cas de nouvel impay\u00e9. Le non-paiement d&#8217;une seule \u00e9ch\u00e9ance entra\u00eenera l&#8217;exigibilit\u00e9 imm\u00e9diate du solde et autorisera l&#8217;expulsion. Ce dispositif combine ainsi cl\u00e9mence temporaire et fermet\u00e9 en cas de d\u00e9faillance.<\/p>\n<p>Cette d\u00e9cision d\u00e9montre la marge de man\u0153uvre du juge des contentieux de la protection. Elle valide une r\u00e9siliation tout en en diff\u00e9rant les effets les plus graves pour le locataire. Le raisonnement s&#8217;inscrit dans la lign\u00e9e d&#8217;une jurisprudence r\u00e9cente appliquant les dispositions protectrices de la loi de 1989. &#8220;Conform\u00e9ment \u00e0 l\u2019article 24 V de la loi du 6 juillet 1989, modifi\u00e9e par la loi n\u00b0 2023-668 du 27 juillet 2023 d\u2019application imm\u00e9diate, le juge peut \u00e0 la demande du locataire, du bailleur ou d&#8217;office [&#8230;] accorder des d\u00e9lais de paiement&#8221; (Tribunal judiciaire de Caen, le 27 novembre 2025, n\u00b025\/01567). La solution \u00e9quilibre donc les droits du bailleur cr\u00e9ancier et la protection du locataire d\u00e9faillant mais de bonne foi.<\/p>\n<p>La port\u00e9e de l&#8217;ordonnance est significative en mati\u00e8re de pr\u00e9vention des expulsions. Elle conditionne le maintien dans les lieux au strict respect d&#8217;un \u00e9ch\u00e9ancier judiciaire. Le juge op\u00e8re une conciliation pratique entre l&#8217;ex\u00e9cution du contrat et la pr\u00e9vention d&#8217;une impay\u00e9 locative. Cette approche favorise le recouvrement amiable de la cr\u00e9ance tout en \u00e9vitant une expulsion souvent socialement lourde.
