Le bailleur public justifie d&#8217;une saisine pr\u00e9alable de la commission comp\u00e9tente et d&#8217;un commandement de payer. La juridiction constate la r\u00e9siliation de plein droit du bail et ordonne l&#8217;expulsion du locataire, fixant une indemnit\u00e9 d&#8217;occupation. Elle statue \u00e9galement sur le recouvrement des cr\u00e9ances et les frais de proc\u00e9dure.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n<p>Le respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;action en justice<\/p>\n<p>L&#8217;ordonnance v\u00e9rifie scrupuleusement le respect des conditions de recevabilit\u00e9 pos\u00e9es par la loi. Le bailleur public devait pr\u00e9alablement saisir la commission de pr\u00e9vention des expulsions. La d\u00e9cision constate que cette formalit\u00e9 a \u00e9t\u00e9 accomplie dans les d\u00e9lais l\u00e9gaux, rendant la demande recevable. Cette \u00e9tape est une condition sine qua non pour toute action en constatation de r\u00e9siliation intent\u00e9e par un bailleur personne morale.<\/p>\n<p>La valeur de cette v\u00e9rification est essentielle pour garantir les droits de la partie d\u00e9fenderesse. Elle illustre le contr\u00f4le strict des conditions de forme, dont l&#8217;inobservation entra\u00eenerait l&#8217;irrecevabilit\u00e9 de la demande. La port\u00e9e est protectrice, assurant un d\u00e9lai de concertation avant toute proc\u00e9dure judiciaire. Une jurisprudence rappelle que l&#8217;absence de preuve certaine de cette saisine est fatale. &#8220;Toutefois, le courrier agraf\u00e9 \u00e0 ce bordereau est dat\u00e9 du 19 janvier 2024. Il est donc post\u00e9rieur et ne mentionne, en outre, aucun num\u00e9ro de LRAR. Par cons\u00e9quent, la bailleresse ne justifie pas de la saisine de la CCAPEX \u00e0 la date indiqu\u00e9e du 30 octobre 2023 et la saisine qui appara\u00eet avoir \u00e9t\u00e9 faite le 19 janvier 2024 n\u2019est pas certaine, en l\u2019absence d\u2019accus\u00e9 de r\u00e9ception par l\u2019organisme.&#8221; (Tribunal judiciaire de Paris, le 17 janvier 2025, n\u00b024\/07690)<\/p>\n<p>L&#8217;acquisition de la clause r\u00e9solutoire par commandement infructueux<\/p>\n<p>Le juge analyse ensuite les conditions de mise en \u0153uvre de la clause contractuelle. Le bail contenait une clause r\u00e9solutoire s&#8217;activant apr\u00e8s un commandement de payer rest\u00e9 sans effet. Un tel commandement, rappelant les textes applicables, a \u00e9t\u00e9 signifi\u00e9 pour un arri\u00e9r\u00e9 arr\u00eat\u00e9 \u00e0 une date pr\u00e9cise. La d\u00e9cision rel\u00e8ve que les causes de ce commandement sont demeur\u00e9es impay\u00e9es pendant plus de deux mois.<\/p>\n<p>Le sens de cette analyse est de v\u00e9rifier la r\u00e9gularit\u00e9 de la mise en demeure et l&#8217;absence de paiement. Sa valeur r\u00e9side dans l&#8217;application stricte des stipulations contractuelles et des dispositions l\u00e9gales. La port\u00e9e en est d\u00e9cisive, car c&#8217;est ce d\u00e9lai de deux mois d&#8217;impay\u00e9s post-commandement qui fait acqu\u00e9rir la r\u00e9siliation de plein droit. Une autre d\u00e9cision confirme ce m\u00e9canisme en constatant l&#8217;acquisition de la clause. &#8220;Le jugement ne peut d\u00e8s lors, comme le demandent \u00e0 titre principal les appelants, \u00eatre infirm\u00e9 puisque la clause r\u00e9solutoire \u00e9tait acquise au profit des bailleurs \u00e0 compter du 29 avril 2024.&#8221; (Cour d&#8217;appel de Versailles, le 13 janvier 2026, n\u00b025\/00835)<\/p>\n<p>Les cons\u00e9quences patrimoniales et ex\u00e9cutoires de la r\u00e9siliation<\/p>\n<p>La condamnation au paiement et la requalification en indemnit\u00e9 d&#8217;occupation<\/p>\n<p>Suite \u00e0 la constatation de la r\u00e9siliation, le juge statue sur la cr\u00e9ance du bailleur. Un d\u00e9compte provisionnel est arr\u00eat\u00e9, incluant les loyers impay\u00e9s jusqu&#8217;\u00e0 la r\u00e9solution. La d\u00e9cision op\u00e8re une requalification juridique n\u00e9cessaire pour les p\u00e9riodes suivant la rupture du contrat. Les sommes r\u00e9clam\u00e9es au titre de cette p\u00e9riode sont requalifi\u00e9es en indemnit\u00e9 d&#8217;occupation.<\/p>\n<p>Le sens de cette requalification est d&#8217;adapter la nature de la cr\u00e9ance au changement de situation juridique. Sa valeur est de respecter le principe selon lequel un occupant sans titre ne peut \u00eatre redevable d&#8217;un loyer. La port\u00e9e est pratique, fixant le montant de cette indemnit\u00e9 au niveau du loyer et charges contractuels. Cela garantit une r\u00e9paration ad\u00e9quate pour le propri\u00e9taire priv\u00e9 de son bien.<\/p>\n<p>Les mesures d&#8217;ex\u00e9cution forc\u00e9e et la condamnation aux d\u00e9pens<\/p>\n<p>La d\u00e9cision ordonne in fine la lib\u00e9ration des lieux et, \u00e0 d\u00e9faut, l&#8217;expulsion du locataire. Elle pr\u00e9voit un d\u00e9lai de deux mois suivant un commandement de quitter les lieux rest\u00e9 infructueux. Par ailleurs, le juge condamne la partie perdante aux d\u00e9pens, incluant les frais de proc\u00e9dure ant\u00e9rieurs. Il alloue \u00e9galement une somme au titre de l&#8217;article 700 du code de proc\u00e9dure civile.<\/p>\n<p>Le sens de ces dispositions est de rendre effective la d\u00e9cision de justice et de compenser les frais. La valeur de l&#8217;ordonnance d&#8217;expulsion est de permettre le recours \u00e0 la force publique si n\u00e9cessaire. Sa port\u00e9e est ex\u00e9cutoire par provision, offrant au bailleur un titre pour recouvrer rapidement son logement.
