Un salari\u00e9 contestait sa rupture en invoquant une discrimination indirecte li\u00e9e \u00e0 la fermeture d&#8217;un site. Les juges du fond avaient rejet\u00e9 sa demande au motif d&#8217;une preuve insuffisante. La cour d&#8217;appel devait d\u00e9terminer si cette d\u00e9cision respectait les r\u00e8gles de preuve en mati\u00e8re de discrimination et si la cause \u00e9conomique \u00e9tait \u00e9tablie. Elle a infirm\u00e9 le jugement et prononc\u00e9 la nullit\u00e9 du licenciement, accordant une indemnisation au salari\u00e9.<\/p>\n<p>La charge de la preuve en mati\u00e8re de discrimination indirecte<\/p>\n<p>L&#8217;erreur dans la r\u00e9partition de la charge probatoire. Le conseil de prud&#8217;hommes avait exig\u00e9 du salari\u00e9 une preuve irr\u00e9futable de la discrimination, ce qui constitue une erreur de droit. La cour rappelle que le r\u00e9gime probatoire est am\u00e9nag\u00e9 par l&#8217;article L. 1134-1 du code du travail. &#8220;Le salari\u00e9 qui invoque la discrimination doit pr\u00e9senter des \u00e9l\u00e9ments de fait laissant supposer son existence directe ou indirecte&#8221; (D\u00e9cision \u00e0 commenter). Il appartient ensuite \u00e0 l&#8217;employeur de d\u00e9montrer que sa d\u00e9cision \u00e9tait objectivement justifi\u00e9e. En renversant cette charge, les premiers juges ont viol\u00e9 la loi.<\/p>\n<p>La pr\u00e9somption \u00e9tablie par les \u00e9l\u00e9ments produits. Le salari\u00e9 avait vers\u00e9 aux d\u00e9bats plusieurs documents, dont le registre du personnel et des proc\u00e8s-verbaux d&#8217;\u00e9lections. Ces \u00e9l\u00e9ments, pris ensemble, \u00e9taient suffisants pour \u00e9tablir une pr\u00e9somption. Ils r\u00e9v\u00e9laient une surrepr\u00e9sentation de salari\u00e9s d&#8217;origine extra-europ\u00e9enne et adh\u00e9rents \u00e0 un syndicat sp\u00e9cifique sur le site ferm\u00e9. Pour la discrimination indirecte, l&#8217;intention de nuire n&#8217;est pas requise. Il suffit que la mesure neutre en apparence produise un effet disproportionn\u00e9 sur une cat\u00e9gorie prot\u00e9g\u00e9e.<\/p>\n<p>L&#8217;appr\u00e9ciation de la cause \u00e9conomique du licenciement<\/p>\n<p>Le d\u00e9faut de justification \u00e9conomique au niveau requis. L&#8217;employeur invoquait une r\u00e9organisation n\u00e9cessaire \u00e0 la sauvegarde de la comp\u00e9titivit\u00e9. La cour rappelle que cette appr\u00e9ciation doit se faire au niveau du secteur d&#8217;activit\u00e9 du groupe sur l&#8217;ensemble du territoire national, incluant l&#8217;outre-mer. Or, l&#8217;analyse \u00e9conomique produite se limitait \u00e0 la France m\u00e9tropolitaine. L&#8217;employeur n&#8217;a pas d\u00e9montr\u00e9 que le march\u00e9 ultramarin \u00e9tait distinct, malgr\u00e9 des modes de diffusion l\u00e9g\u00e8rement diff\u00e9rents. &#8220;En restreignant son analyse \u00e9conomique \u00e0 la seule France m\u00e9tropolitaine, la soci\u00e9t\u00e9 [&#8230;] ne justifie pas que la situation du groupe sur le territoire national fran\u00e7ais [&#8230;] justifiait la r\u00e9organisation&#8221; (D\u00e9cision \u00e0 commenter).<\/p>\n<p>L&#8217;absence de d\u00e9monstration du caract\u00e8re \u00e9tranger \u00e0 toute discrimination. Faute d&#8217;avoir \u00e9tabli valablement la cause \u00e9conomique au niveau l\u00e9gal, l&#8217;employeur n&#8217;a pas pu justifier que sa d\u00e9cision \u00e9tait objectivement fond\u00e9e. Par cons\u00e9quent, il n&#8217;a pas r\u00e9ussi \u00e0 renverser la pr\u00e9somption de discrimination indirecte \u00e9tablie par le salari\u00e9. La cour en d\u00e9duit la nullit\u00e9 du licenciement sans avoir \u00e0 examiner la proportionnalit\u00e9 de la mesure. Cette solution souligne que la libert\u00e9 d&#8217;entreprendre doit s&#8217;exercer dans le respect du principe de non-discrimination.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est significative en droit social. Elle r\u00e9affirme avec force la r\u00e9partition de la charge de la preuve en mati\u00e8re de discrimination, prot\u00e9geant ainsi les salari\u00e9s. Elle pr\u00e9cise \u00e9galement le champ g\u00e9ographique d&#8217;appr\u00e9ciation des difficult\u00e9s \u00e9conomiques pour les groupes internationaux. L&#8217;arr\u00eat rappelle que toute restructuration, m\u00eame collective, peut \u00eatre soumise au contr\u00f4le des discriminations indirectes. Cette analyse rejoint celle d&#8217;autres juridictions sur la n\u00e9cessit\u00e9 d&#8217;une justification objective. &#8220;En cons\u00e9quence, l&#8217;action de M.
