Le bailleur invoquait divers manquements du preneur, dont un d\u00e9faut d\u2019assurance et des impay\u00e9s. Les locataires soutenaient le caract\u00e8re accessoire du garage \u00e0 leur habitation principale. La juridiction a prononc\u00e9 la r\u00e9siliation du bail et l\u2019expulsion des locataires pour d\u00e9faut de paiement et d\u2019assurance, tout en rejetant leurs demandes reconventionnelles.<\/p>\n<p>La qualification autonome du garage lou\u00e9<\/p>\n<p>La d\u00e9termination de la nature juridique du local fut un pr\u00e9alable essentiel. Les locataires soutenaient que le garage \u00e9tait accessoire \u00e0 leur logement, ce qui aurait entra\u00een\u00e9 l\u2019application d\u2019un r\u00e9gime protecteur. Le tribunal a souverainement \u00e9cart\u00e9 cette qualification. Il a relev\u00e9 que le bail d\u2019habitation ne mentionnait pas le garage et qu\u2019aucun \u00e9tat des lieux commun n\u2019\u00e9tait produit. Les paiements des loyers \u00e9taient effectu\u00e9s ind\u00e9pendamment et les locataires n\u2019avaient pas sollicit\u00e9 l\u2019application de la loi du 6 juillet 1989. &#8220;D\u00e8s lors, il y a lieu de consid\u00e9rer que le garage objet du pr\u00e9sent litige n\u2019est pas accessoire au logement&#8221; (Motifs). Cette analyse restrictive prot\u00e8ge le bailleur des r\u00e8gles imp\u00e9ratives du bail d\u2019habitation. Elle rappelle que la qualification d\u2019accessoire requiert des \u00e9l\u00e9ments probants pr\u00e9cis, au-del\u00e0 de la simple proximit\u00e9 g\u00e9ographique.<\/p>\n<p>La sanction des manquements graves aux obligations locatives<\/p>\n<p>Le juge a retenu deux manquements justifiant la r\u00e9siliation judiciaire. Concernant l\u2019assurance, une attestation unique et ancienne fut jug\u00e9e insuffisante. &#8220;Cette seule attestation remontant \u00e0 plus de deux ans ne suffit pas \u00e0 \u00e9tablir que le garage serait couvert par un contrat d\u2019assurance \u00e0 ce jour&#8221; (Motifs). Ce raisonnement rejoint la jurisprudence exigeant une justification r\u00e9guli\u00e8re de l\u2019assurance. &#8220;Attendu qu\u2019aux termes de l\u2019article 7 g) de la loi du 6 juillet 1989 le locataire est oblig\u00e9 de s&#8217;assurer contre les risques dont il doit r\u00e9pondre en sa qualit\u00e9 et d&#8217;en justifier lors de la remise des cl\u00e9s puis, chaque ann\u00e9e, \u00e0 la demande du bailleur&#8221; (Tribunal judiciaire de Strasbourg, le 30 avril 2025, n\u00b024\/10283). Surtout, le d\u00e9faut de paiement des loyers fut \u00e9tabli. En application de l\u2019article 1353 du code civil, la charge de la preuve du paiement incombait aux locataires, qui n\u2019ont pas rapport\u00e9 cette preuve. La conjonction de ces deux manquements fut jug\u00e9e suffisante pour prononcer la r\u00e9siliation.<\/p>\n<p>Le rejet des autres griefs et des demandes reconventionnelles<\/p>\n<p>Le bailleur invoquait \u00e9galement un changement de destination et des troubles de voisinage. Le tribunal a minutieusement analys\u00e9 les proc\u00e8s-verbaux et attestations. Il a constat\u00e9 que la pr\u00e9sence d\u2019outils et d\u2019engins motoris\u00e9s n\u2019\u00e9tablissait pas un usage professionnel. &#8220;La seule pr\u00e9sence de diverses machines, ainsi que d\u2019engins motoris\u00e9s dans le garage lou\u00e9 n\u2019est pas suffisante pour d\u00e9terminer que [le preneur] utiliserait le garage pour un usage professionnel&#8221; (Motifs). Cette appr\u00e9ciation stricte de la preuve \u00e9vite une r\u00e9siliation pour un motif non caract\u00e9ris\u00e9. Les all\u00e9gations de troubles et de menaces furent \u00e9galement \u00e9cart\u00e9es faute de preuves objectives. Enfin, le tribunal a d\u00e9clar\u00e9 irrecevables les demandes reconventionnelles li\u00e9es au bail d\u2019habitation, faute de lien suffisant avec le litige principal. Ce strict respect des r\u00e8gles proc\u00e9durales circonscrit le d\u00e9bat aux seules obligations n\u00e9es du bail du garage.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est double. Elle affirme d\u2019abord l\u2019autonomie contractuelle pour les locations annexes, soumises au droit commun d\u00e8s lors que le lien accessoire n\u2019est pas d\u00e9montr\u00e9. Elle rappelle ensuite la gravit\u00e9 des obligations de paiement et d\u2019assurance, dont le manquement conjoint justifie une r\u00e9siliation.
