Une soci\u00e9t\u00e9 locataire reprochait \u00e0 son bailleur des d\u00e9sordres affectant un logement de fonction. La juridiction a examin\u00e9 les obligations respectives des parties et la responsabilit\u00e9 du bailleur. Elle a partiellement accueilli les demandes en ordonnant certains travaux et une r\u00e9duction de loyer limit\u00e9e.<\/p>\n<p>La d\u00e9limitation des obligations contractuelles<\/p>\n<p>La nature imp\u00e9rative des obligations du bailleur. Le juge rappelle le socle l\u00e9gal des obligations du bailleur, fond\u00e9 sur les articles 1719 du code civil et 6 de la loi du 6 juillet 1989. &#8220;Le bailleur est tenu de remettre au locataire un logement d\u00e9cent ne laissant pas appara\u00eetre de risques manifestes pouvant porter atteinte \u00e0 la s\u00e9curit\u00e9 physique ou \u00e0 la sant\u00e9&#8221; (Cour d&#8217;appel de N\u00eemes, le 10 juillet 2025, n\u00b022\/02069). Cette obligation de d\u00e9livrance et de jouissance paisible est une obligation de r\u00e9sultat. Elle ne cesse qu&#8217;en cas de force majeure, ce qui renforce consid\u00e9rablement la protection du preneur. Le bailleur ne peut ainsi s&#8217;exon\u00e9rer par la simple d\u00e9monstration de son absence de faute.<\/p>\n<p>La r\u00e9partition l\u00e9gale des charges d&#8217;entretien. En contrepartie, le locataire est soumis \u00e0 des obligations pr\u00e9cises. Il doit notamment assurer l&#8217;entretien courant et les menues r\u00e9parations. Le d\u00e9cret du 26 ao\u00fbt 1987 d\u00e9finit ces r\u00e9parations locatives comme &#8220;les travaux d&#8217;entretien courant et de menues r\u00e9parations, y compris les remplacements d&#8217;\u00e9l\u00e9ments assimilables auxdites r\u00e9parations&#8221;. Cette r\u00e9partition est essentielle pour d\u00e9terminer la responsabilit\u00e9 de chaque d\u00e9sordre constat\u00e9. Elle \u00e9vite toute confusion entre vices de construction et usure normale.<\/p>\n<p>L&#8217;appr\u00e9ciation judiciaire des d\u00e9sordres et des pr\u00e9judices<\/p>\n<p>L&#8217;analyse causale pour l&#8217;imputation des responsabilit\u00e9s. Le juge proc\u00e8de \u00e0 un examen d\u00e9taill\u00e9 de chaque d\u00e9sordre pour en d\u00e9terminer l&#8217;origine. Les infiltrations d&#8217;eau dues \u00e0 des fen\u00eatres d\u00e9fectueuses rel\u00e8vent clairement de la responsabilit\u00e9 du bailleur. En revanche, le d\u00e9collement du parquet ou les points de rouille sur un radiateur sont attribu\u00e9s au locataire. Cette analyse minutieuse est guid\u00e9e par le principe de la charge de la preuve. Le locataire doit d\u00e9montrer le lien de causalit\u00e9 entre le d\u00e9sordre et une faute du bailleur pour obtenir r\u00e9paration.<\/p>\n<p>La quantification mod\u00e9r\u00e9e du pr\u00e9judice locatif. Le juge reconna\u00eet l&#8217;existence d&#8217;un trouble de jouissance li\u00e9 aux fen\u00eatres. Toutefois, il en r\u00e9duit fortement l&#8217;\u00e9valuation. Il retient une r\u00e9duction de loyer de seulement dix pour cent pour douze mois. Cette mod\u00e9ration s&#8217;explique par plusieurs \u00e9l\u00e9ments. L&#8217;occupation du logement n&#8217;\u00e9tait pas permanente et le locataire a contribu\u00e9 \u00e0 certains retards. Le juge \u00e9carte aussi toute indemnisation pour pr\u00e9judice moral de la personne morale.
