La locataire et sa caution, d\u00e9bout\u00e9es en premi\u00e8re instance d&#8217;une partie de leurs demandes, font appel. La juridiction doit se prononcer sur l&#8217;\u00e9tendue de la responsabilit\u00e9 du bailleur et le pr\u00e9judice de jouissance. La cour confirme int\u00e9gralement le premier jugement.<\/p>\n<p>La d\u00e9limitation de la p\u00e9riode de responsabilit\u00e9 du bailleur<\/p>\n<p>La cour rappelle fermement les obligations l\u00e9gales pesant sur le bailleur. &#8220;En application des articles 1719 et 1720 du code civil et de l&#8217;article 6 de la loi du 06\/07\/1989, le bailleur a l&#8217;obligation de mettre \u00e0 disposition un logement en bon \u00e9tat d&#8217;usage et de r\u00e9paration et de d\u00e9livrer un logement d\u00e9cent.&#8221; (Motifs, 1\/) Cette obligation de d\u00e9livrance et d&#8217;entretien est continue pendant toute la dur\u00e9e du bail. Toutefois, son ex\u00e9cution pratique est conditionn\u00e9e par une information diligente du locataire. &#8220;A cela, il convient d&#8217;ajouter que si pendant l&#8217;ex\u00e9cution du bail, l&#8217;obligation d&#8217;entretien et celle de d\u00e9livrance perdurent, elles sont subordonn\u00e9es \u00e0 une information pr\u00e9alable et la participation active des occupants&#8221; (Motifs, 1\/). La responsabilit\u00e9 du bailleur ne peut donc \u00eatre engag\u00e9e pour une p\u00e9riode o\u00f9 il n&#8217;a pas \u00e9t\u00e9 alert\u00e9 du d\u00e9sordre.<\/p>\n<p>La cour op\u00e8re ainsi une distinction temporelle cruciale pour fixer le point de d\u00e9part de la responsabilit\u00e9. Elle \u00e9carte la pr\u00e9tention de la locataire \u00e0 faire remonter le dysfonctionnement \u00e0 son entr\u00e9e dans les lieux. &#8220;Comme l&#8217;a justement relev\u00e9 le premier juge, il n&#8217;est nullement \u00e9tabli que le dysfonctionnement du syst\u00e8me de chauffage \u00e9tait pr\u00e9sent en d\u00e9but de location&#8221; (Motifs, 1\/). Le premier signalement formel datant du 17 juin 2020, la p\u00e9riode de responsabilit\u00e9 est strictement circonscrite \u00e0 partir de cette date. Cette analyse restreint la p\u00e9riode indemnisable et souligne la charge de preuve et de diligence qui incombe au locataire.<\/p>\n<p>La r\u00e9paration forfaitaire du trouble de jouissance<\/p>\n<p>La reconnaissance d&#8217;un pr\u00e9judice d\u00e9coule directement de la violation des obligations du bailleur. La cour constate un manquement certain \u00e0 compter du signalement. &#8220;Pour le surplus, il est justifi\u00e9 d&#8217;une d\u00e9faillance de la climatisation du 17 juin au 30 d\u00e9cembre 2020 ce qui occasionne un pr\u00e9judice de jouissance incontestable&#8221; (Motifs, 1\/). L&#8217;absence d&#8217;un chauffage fonctionnel pendant les mois d&#8217;automne constitue une privation substantielle de la jouissance paisible du logement. La solution rejoint la jurisprudence qui consid\u00e8re que la fourniture d&#8217;un chauffage efficace rel\u00e8ve de l&#8217;obligation de jouissance paisible.<\/p>\n<p>La quantification du pr\u00e9judice suit une m\u00e9thode forfaitaire et ne compense pas l&#8217;int\u00e9gralit\u00e9 de la p\u00e9riode litigieuse. &#8220;C&#8217;est donc \u00e0 bon droit que le premier juge a indemnis\u00e9 ce pr\u00e9judice par l&#8217;allocation de la somme de 500 euros tenant l&#8217;absence de chauffage pendant les trois mois d&#8217;automne&#8221; (Motifs, 1\/). La cour valide cette \u00e9valuation sans discuter son montant, se bornant \u00e0 confirmer le raisonnement du premier juge. Cette approche forfaitaire, bien que courante, contraste avec des d\u00e9cisions qui peuvent retenir une indemnisation au jour le jour pour de tels troubles.<\/p>\n<p>En revanche, la cour rejette la demande li\u00e9e \u00e0 une surconsommation \u00e9lectrique suppos\u00e9e. &#8220;Enfin, sur la surconsommation \u00e9lectrique, celle-ci n&#8217;est nullement justifi\u00e9e et ne peut se d\u00e9duire de la facture produite&#8221; (Motifs, 1\/). Ce rejet est motiv\u00e9 par une insuffisance probatoire, la locataire n&#8217;ayant pas pu \u00e9tablir de comparaison avec une p\u00e9riode de r\u00e9f\u00e9rence. La d\u00e9cision rappelle ainsi que tout chef de pr\u00e9judice, m\u00eame cons\u00e9cutif \u00e0 un manquement av\u00e9r\u00e9, doit \u00eatre prouv\u00e9 dans son existence et son montant par la partie qui l&#8217;invoque.<\/p>\n<p>La port\u00e9e de l&#8217;arr\u00eat est double. Elle pr\u00e9cise les conditions de mise en \u0153uvre de la responsabilit\u00e9 du bailleur pour d\u00e9faut d&#8217;entretien, en subordonnant son d\u00e9clenchement \u00e0 un signalement formel. Elle illustre \u00e9galement la marge d&#8217;appr\u00e9ciation des juges du fond dans l&#8217;\u00e9valuation forfaitaire des troubles de jouissance, sans qu&#8217;un bar\u00e8me pr\u00e9cis ne s&#8217;impose.
