La soci\u00e9t\u00e9 gestionnaire du terrain, devenue propri\u00e9taire, agissait en expulsion contre l&#8217;occupant qui exploitait ant\u00e9rieurement les lieux. L&#8217;occupant opposait l&#8217;illic\u00e9it\u00e9 du bail de la demanderesse, faute de mandat d&#8217;un op\u00e9rateur de t\u00e9l\u00e9phonie mobile. La cour a rejet\u00e9 ces moyens et confirm\u00e9 la d\u00e9cision de premi\u00e8re instance accordant l&#8217;expulsion et une provision sur indemnit\u00e9 d&#8217;occupation, tout en constatant la cessation du trouble.<\/p>\n<p>La recevabilit\u00e9 de l&#8217;action en expulsion face \u00e0 une obligation administrative<\/p>\n<p>La cour \u00e9carte d&#8217;abord les fins de non-recevoir soulev\u00e9es par l&#8217;occupant. Elle rappelle que la qualit\u00e9 pour agir en expulsion appartient \u00e0 tout titulaire d&#8217;un droit r\u00e9el, ind\u00e9pendamment de la r\u00e9gularit\u00e9 administrative de son projet. L&#8217;occupation sans droit ni titre d&#8217;une parcelle dont la soci\u00e9t\u00e9 est propri\u00e9taire suffit \u00e0 fonder son int\u00e9r\u00eat \u00e0 agir. La cour pr\u00e9cise que &#8220;la qualit\u00e9 \u00e0 agir du nouveau preneur \u00e0 bail, et a fortiori celle du nouveau propri\u00e9taire, n&#8217;\u00e9tant pas restreinte par la loi, notamment par l&#8217;exigence d&#8217;un mandat op\u00e9rateur&#8221; (Motifs, 1.2). Cette solution est conforme \u00e0 une jurisprudence constante de la Cour de cassation sur le droit d&#8217;agir en expulsion.<\/p>\n<p>L&#8217;interpr\u00e9tation restrictive des obligations pr\u00e9alables \u00e0 l&#8217;\u00e9dification<\/p>\n<p>La cour interpr\u00e8te strictement la port\u00e9e de l&#8217;article L. 34-9-1-1 du code des postes et communications \u00e9lectroniques. Elle estime que cette disposition, qui impose une information pr\u00e9alable au maire accompagn\u00e9e d&#8217;un mandat d&#8217;op\u00e9rateur, ne cr\u00e9e qu&#8217;une simple obligation administrative. Elle souligne que les textes &#8220;ne pr\u00e9voyant, \u00e0 la charge du preneur d&#8217;un contrat de bail ou de r\u00e9servation d&#8217;un terrain, qu&#8217;une obligation d&#8217;information, sans l&#8217;assortir de la moindre sanction&#8221; (Motifs, 1.1). L&#8217;absence de sanction l\u00e9gislative expresse interdit donc d&#8217;en d\u00e9duire une nullit\u00e9 du contrat de bail ou une irrecevabilit\u00e9 de l&#8217;action en justice. La lic\u00e9it\u00e9 du contrat n&#8217;est pas subordonn\u00e9e au respect de cette formalit\u00e9.<\/p>\n<p>La caract\u00e9risation du trouble manifestement illicite malgr\u00e9 une contestation s\u00e9rieuse<\/p>\n<p>La cour confirme la qualification de trouble manifestement illicite. Elle rappelle que &#8220;l&#8217;occupation sans droit ni titre du bien d&#8217;autrui constitue un trouble manifestement illicite&#8221; (Motifs, 2.1). Ce trouble est caract\u00e9ris\u00e9 par l&#8217;atteinte \u00e9vidente au droit de propri\u00e9t\u00e9, justifiant une mesure d&#8217;expulsion en r\u00e9f\u00e9r\u00e9. La cour applique ici une jurisprudence bien \u00e9tablie selon laquelle une contestation s\u00e9rieuse sur le fond du droit ne fait pas obstacle \u00e0 la cessation d&#8217;un trouble manifestement illicite. Elle cite un arr\u00eat de la deuxi\u00e8me chambre civile pr\u00e9cisant qu'&#8221;une contestation s\u00e9rieuse sur le fond du droit n&#8217;interdit pas au juge des r\u00e9f\u00e9r\u00e9s de prendre les mesures pr\u00e9vues \u00e0 l&#8217;article 835, alin\u00e9a 1er, du code de proc\u00e9dure civile pour faire cesser un trouble manifestement illicite&#8221; (Civ. 2e, 7 juin 2007, n\u00b0 07-10.601). L&#8217;argumentation sur la validit\u00e9 du cong\u00e9 est ainsi jug\u00e9e inop\u00e9rante en r\u00e9f\u00e9r\u00e9.<\/p>\n<p>L&#8217;octroi d&#8217;une provision sur l&#8217;indemnit\u00e9 d&#8217;occupation malgr\u00e9 l&#8217;illic\u00e9it\u00e9 all\u00e9gu\u00e9e<\/p>\n<p>Enfin, la cour valide l&#8217;octroi d&#8217;une provision sur indemnit\u00e9 d&#8217;occupation. Elle estime que l&#8217;existence de l&#8217;obligation de r\u00e9parer le pr\u00e9judice n&#8217;est pas s\u00e9rieusement contestable. Le pr\u00e9judice r\u00e9side dans la privation de jouissance du terrain, \u00e9valu\u00e9e au montant du loyer que le propri\u00e9taire justifie avoir pay\u00e9 en pure perte. La cour rejette l&#8217;id\u00e9e que l&#8217;absence de mandat op\u00e9rateur rende le pr\u00e9judice incertain. Elle consid\u00e8re que &#8220;le fait de ne pas pouvoir jouir des lieux constitue sans contestation s\u00e9rieuse un pr\u00e9judice indemnisable&#8221; (Motifs, 2.2). La provision est ainsi accord\u00e9e sur le fondement de la responsabilit\u00e9 quasi-d\u00e9lictuelle, ind\u00e9pendamment de la r\u00e9gularit\u00e9 administrative du projet immobilier.<\/p>\n<p>Cet arr\u00eat affirme la primaut\u00e9 du droit de propri\u00e9t\u00e9 sur les obligations administratives pr\u00e9alables \u00e0 un projet. Il rappelle que l&#8217;absence de sanction l\u00e9gislative attach\u00e9e \u00e0 une formalit\u00e9 d&#8217;information ne peut vicier un contrat ni priver son titulaire de ses actions possessoires. La solution prot\u00e8ge le propri\u00e9taire contre les occupations sans titre, m\u00eame lorsque son propre projet n&#8217;est pas encore en conformit\u00e9 avec la r\u00e9glementation sectorielle. Elle limite ainsi les risques de contentieux strat\u00e9giques fond\u00e9s sur des irr\u00e9gularit\u00e9s purement administratives pour prolonger une occupation illicite.
