Le bailleur public avait signifi\u00e9 un commandement de payer en novembre 2024. Le locataire, en situation d\u2019impay\u00e9, sollicitait la suspension des effets de la clause r\u00e9solutoire et l\u2019octroi de d\u00e9lais de paiement. Le juge constate la r\u00e9solution du bail mais suspend ses effets et accorde des d\u00e9lais, en \u00e9cartant l\u2019ex\u00e9cution provisoire de la d\u00e9cision.<\/p>\n<p>Le principe de non-r\u00e9troactivit\u00e9 de la loi nouvelle<\/p>\n<p>Le juge rappelle d\u2019abord le principe de non-r\u00e9troactivit\u00e9 de la loi en mati\u00e8re contractuelle. Il applique la loi ancienne au bail conclu avant la r\u00e9forme de 2023. &#8220;Cependant, la loi du 27 juillet 2023 ne comprend aucune disposition d\u00e9rogeant \u00e0 l&#8217;article 2 du code civil, selon lequel la loi ne dispose que pour l&#8217;avenir et n&#8217;a point d&#8217;effet r\u00e9troactif.&#8221; (Motifs, 1.2) Le d\u00e9lai de deux mois pr\u00e9vu par le commandement demeure donc le d\u00e9lai l\u00e9gal applicable en l\u2019esp\u00e8ce. Ce point confirme une jurisprudence constante sur la temporalit\u00e9 des lois. Le Tribunal judiciaire de Paris a d\u00e9j\u00e0 jug\u00e9 en des termes identiques que les contrats ant\u00e9rieurs restent r\u00e9gis par la loi ancienne. &#8220;Cependant, la loi du 27 juillet 2023 ne comprend aucune disposition d\u00e9rogeant \u00e0 l&#8217;article 2 du code civil, selon lequel la loi ne dispose que pour l&#8217;avenir et n&#8217;a point d&#8217;effet r\u00e9troactif.&#8221; (Tribunal judiciaire de Paris, le 15 octobre 2024, n\u00b024\/01452) Cette solution assure la s\u00e9curit\u00e9 juridique et la pr\u00e9visibilit\u00e9 des relations contractuelles. Elle prot\u00e8ge les droits acquis sous l\u2019empire de la loi pr\u00e9c\u00e9dente.<\/p>\n<p>La suspension conditionnelle des effets de la clause r\u00e9solutoire<\/p>\n<p>Le juge op\u00e8re ensuite une interpr\u00e9tation protectrice des dispositions de l\u2019article 24 de la loi de 1989. Il admet la suspension des effets de la clause bien que le locataire ait repris seul le paiement. &#8220;En l\u2019esp\u00e8ce, malgr\u00e9 les d\u00e9clarations contraires du bailleur, [le locataire] justifie avoir repris le paiement d&#8217;au moins un loyer courant entre l&#8217;assignation et l&#8217;audience.&#8221; (Motifs, 1.2) La condition l\u00e9gale de reprise du loyer courant est ainsi interpr\u00e9t\u00e9e avec souplesse. Cette analyse rejoint l\u2019esprit d\u2019une jurisprudence r\u00e9cente qui \u00e9vite de p\u00e9naliser le locataire diligent. Le Tribunal judiciaire de Vannes a estim\u00e9 qu\u2019un r\u00e8glement int\u00e9gral avant audience devait conduire \u00e0 consid\u00e9rer la clause comme non jou\u00e9e. &#8220;Sauf \u00e0 ignorer le sens de la loi pr\u00e9cit\u00e9e et \u00e0 placer le locataire dans une situation plus d\u00e9favorable que celui qui n\u2019aurait pas r\u00e9gl\u00e9 int\u00e9gralement sa dette de loyer, il ne saurait lui \u00eatre reproch\u00e9 d\u2019en avoir sold\u00e9 le montant.&#8221; (Tribunal judiciaire de Vannes, le 5 f\u00e9vrier 2026, n\u00b025\/00549) La d\u00e9cision favorise ainsi le maintien dans les lieux et le recouvrement amiable de la cr\u00e9ance.<\/p>\n<p>L\u2019\u00e9quilibre entre les droits du bailleur et la protection du locataire<\/p>\n<p>Le juge proc\u00e8de \u00e0 une pes\u00e9e des int\u00e9r\u00eats pour accorder des d\u00e9lais de paiement adapt\u00e9s. Il fonde sa d\u00e9cision sur l\u2019appr\u00e9ciation concr\u00e8te de la situation du locataire. &#8220;Il ressort des \u00e9l\u00e9ments du dossier, et notamment de l\u2019audience, que les revenus du foyer [&#8230;] lui permettent raisonnablement d\u2019assumer le paiement d\u2019une somme de 84 euros par mois.&#8221; (Motifs, 1.2) Le dispositif du jugement organise un plan d\u2019apurement strict et encadr\u00e9 sur trente-six mois. La suspension des effets de la clause est subordonn\u00e9e au respect scrupuleux de ce plan. Le juge assortit sa d\u00e9cision de mises en garde pr\u00e9cises sur les cons\u00e9quences d\u2019un nouvel impay\u00e9. Cette approche concilie le droit du bailleur au recouvrement et la protection contre l\u2019expulsion. Elle donne une effectivit\u00e9 r\u00e9elle au pouvoir d\u2019appr\u00e9ciation du juge pr\u00e9vu par la loi.<\/p>\n<p>La modulation des effets de la d\u00e9cision de justice<\/p>\n<p>Enfin, le juge use de ses pouvoirs pour moduler les modalit\u00e9s d\u2019ex\u00e9cution de sa d\u00e9cision. Il \u00e9carte l\u2019ex\u00e9cution provisoire de droit au nom du droit au double degr\u00e9 de juridiction. &#8220;L&#8217;ex\u00e9cution provisoire risque d&#8217;entra\u00eener des cons\u00e9quences manifestement excessives privant de r\u00e9alit\u00e9 le droit au double degr\u00e9 de juridiction.&#8221; (Motifs, 4) Cette d\u00e9cision sp\u00e9cialement motiv\u00e9e prot\u00e8ge le locataire contre une expulsion imm\u00e9diate en cas d\u2019appel. Elle garantit l\u2019effectivit\u00e9 du recours juridictionnel sans priver le bailleur de son droit \u00e0 terme. Le juge condamne le locataire aux d\u00e9pens mais le d\u00e9charge de toute indemnit\u00e9 au titre de l\u2019article 700 du code de proc\u00e9dure civile. Cette prise en compte de la situation \u00e9conomique individuelle est conforme aux exigences d\u2019\u00e9quit\u00e9.
