La salari\u00e9e contestait la r\u00e9alit\u00e9 des faits reproch\u00e9s, \u00e0 savoir des menaces de mort prof\u00e9r\u00e9es \u00e0 l&#8217;encontre d&#8217;une coll\u00e8gue. Les juges du fond avaient retenu l&#8217;absence de cause r\u00e9elle et s\u00e9rieuse. La cour d&#8217;appel confirme cette analyse apr\u00e8s un examen rigoureux de la preuve. Elle r\u00e9duit cependant le montant de l&#8217;indemnit\u00e9 compensatrice accord\u00e9e \u00e0 la salari\u00e9e.<\/p>\n<p>La rigueur proc\u00e9durale de l&#8217;appel<\/p>\n<p>L&#8217;exigence d&#8217;une demande expresse d&#8217;infirmation<\/p>\n<p>La cour rappelle d&#8217;abord une r\u00e8gle essentielle de proc\u00e9dure civile en mati\u00e8re d&#8217;appel. La demande d&#8217;infirmation constitue une pr\u00e9tention n\u00e9cessaire \u00e0 la d\u00e9termination de l&#8217;objet du litige. Elle doit donc figurer express\u00e9ment dans le dispositif des conclusions de la partie appelante. En l&#8217;esp\u00e8ce, la salari\u00e9e n&#8217;avait pas formul\u00e9 une telle demande pour plusieurs chefs du jugement. La cour en d\u00e9duit qu&#8217;elle n&#8217;est pas valablement saisie sur ces points et confirme le jugement en ces parties. Cette solution souligne le formalisme strict encadrant l&#8217;exercice de l&#8217;appel. Les parties doivent clairement exprimer leurs pr\u00e9tentions sous peine d&#8217;\u00eatre irrecevables.<\/p>\n<p>Les cons\u00e9quences sur le quantum de l&#8217;indemnit\u00e9<\/p>\n<p>Ce formalisme a une incidence directe sur le montant de la condamnation. La salari\u00e9e demandait en appel une majoration substantielle de son indemnit\u00e9 pour licenciement sans cause. Or, elle n&#8217;avait pas sollicit\u00e9 l&#8217;infirmation du chef du jugement fixant initialement ce montant. &#8220;Pour les m\u00eames motifs que ceux retenus pour les autres chefs de demande, en l&#8217;absence de demande aux fins d&#8217;infirmation [&#8230;] la cour n&#8217;est pas valablement saisie&#8221; (Motifs). La cour ne peut donc pas r\u00e9examiner ce point \u00e0 la hausse. Elle statue uniquement sur la demande de r\u00e9duction form\u00e9e par l&#8217;employeur via un appel incident. Cette application stricte pr\u00e9serve la s\u00e9curit\u00e9 juridique et le principe du contradictoire.<\/p>\n<p>L&#8217;appr\u00e9ciation souveraine de la preuve de la faute<\/p>\n<p>Le b\u00e9n\u00e9fice du doute au salari\u00e9<\/p>\n<p>Le c\u0153ur de l&#8217;arr\u00eat r\u00e9side dans l&#8217;analyse des \u00e9l\u00e9ments justifiant le licenciement. L&#8217;employeur invoquait une faute grave fond\u00e9e sur des propos mena\u00e7ants. La salari\u00e9e en contestait la teneur exacte, offrant une version diff\u00e9rente. La cour souligne que la charge de la preuve incombe \u00e0 l&#8217;employeur. Face \u00e0 des versions contradictoires et en l&#8217;absence de t\u00e9moin direct, les juges appr\u00e9cient souverainement. Ils rel\u00e8vent que le contexte \u00e9motionnel de l&#8217;entretien permet une m\u00e9prise. &#8220;Il n&#8217;est pas exclu que la premi\u00e8re ait pu se m\u00e9prendre sur les termes employ\u00e9s par la salari\u00e9e&#8221; (Motifs). Le doute, dans ce cas, profite n\u00e9cessairement \u00e0 la salari\u00e9e.<\/p>\n<p>La valeur limit\u00e9e des ant\u00e9c\u00e9dents disciplinaires<\/p>\n<p>L&#8217;employeur tentait de corroborer sa version en invoquant le passif disciplinaire de l&#8217;int\u00e9ress\u00e9e. La cour \u00e9carte cet argument car il ne constitue pas une preuve directe des faits litigieux. &#8220;L&#8217;existence d&#8217;ant\u00e9c\u00e9dents disciplinaires [&#8230;] ne peuvent en outre valoir preuve de l&#8217;exactitude des propos tenus&#8221; (Motifs). Cette analyse est conforme \u00e0 la jurisprudence exigeant une preuve certaine de la faute all\u00e9gu\u00e9e. Elle rappelle que des griefs ant\u00e9rieurs, m\u00eame \u00e9tablis, ne suffisent pas \u00e0 prouver un manquement sp\u00e9cifique et contemporain. La d\u00e9cision prot\u00e8ge ainsi le salari\u00e9 contre une condamnation par pr\u00e9somption ou amalgame.<\/p>\n<p>La port\u00e9e de l&#8217;arr\u00eat est double. Sur le plan proc\u00e9dural, il r\u00e9affirme l&#8217;importance du formalisme de l&#8217;appel et ses cons\u00e9quences pratiques. Sur le fond, il illustre le contr\u00f4le strict exerc\u00e9 par le juge sur la preuve de la faute grave. Le doute, dans ce domaine, doit toujours b\u00e9n\u00e9ficier au salari\u00e9. La r\u00e9duction de l&#8217;indemnit\u00e9, fond\u00e9e sur des \u00e9l\u00e9ments de fait souverainement appr\u00e9ci\u00e9s, montre l&#8217;autonomie de la r\u00e9paration du pr\u00e9judice.
