Le salari\u00e9 contestait son licenciement et invoquait un harc\u00e8lement moral li\u00e9 \u00e0 des modifications de ses conditions de travail. La cour a rejet\u00e9 la qualification de harc\u00e8lement mais a retenu une ex\u00e9cution fautive du contrat. Elle a confirm\u00e9 le licenciement pour faute grave tout en accordant des dommages-int\u00e9r\u00eats pour violation du droit \u00e0 repos.<\/p>\n<p>La caract\u00e9risation manqu\u00e9e du harc\u00e8lement moral<\/p>\n<p>L\u2019exigence d\u2019une appr\u00e9ciation globale des \u00e9l\u00e9ments de fait<\/p>\n<p>La cour rappelle les conditions l\u00e9gales du harc\u00e8lement moral en citant l\u2019article L. 1152-1 du code du travail. &#8220;Pour se prononcer sur l&#8217;existence d&#8217;un harc\u00e8lement moral il appartient au juge d&#8217;examiner l&#8217;ensemble des \u00e9l\u00e9ments pr\u00e9sent\u00e9s par la salari\u00e9e, en prenant en compte les documents m\u00e9dicaux \u00e9ventuellement produits, et d&#8217;appr\u00e9cier si les faits mat\u00e9riellement \u00e9tablis, pris dans leur ensemble, laissent pr\u00e9sumer l&#8217;existence d&#8217;un harc\u00e8lement.&#8221; (Motifs de la d\u00e9cision). Cette m\u00e9thode impose une analyse synth\u00e9tique et non pas une simple addition de griefs. La port\u00e9e de ce rappel est essentielle pour encadrer l\u2019office du juge. Il doit proc\u00e9der \u00e0 une appr\u00e9ciation concr\u00e8te et contextualis\u00e9e des comportements all\u00e9gu\u00e9s.<\/p>\n<p>L\u2019insuffisance des manquements contractuels isol\u00e9s<\/p>\n<p>En l\u2019esp\u00e8ce, deux manquements de l\u2019employeur sont \u00e9tablis. Le premier est un changement de statut sans accord \u00e9crit. &#8220;Il ressort que comme il l&#8217;indique il est pass\u00e9, sans son accord \u00e9crit, du statut de travailleur de jour \u00e0 celui de travailleur de nuit au sens de l&#8217;article L 3122-5 du code du travail.&#8221; (Motifs de la d\u00e9cision). Le second concerne des d\u00e9passements occasionnels de la dur\u00e9e maximale de travail. Cependant, la cour estime que ces faits, pris dans leur globalit\u00e9, ne cr\u00e9ent pas de pr\u00e9somption de harc\u00e8lement. &#8220;Il r\u00e9sulte des d\u00e9veloppements pr\u00e9c\u00e9dents que les deux faits all\u00e9gu\u00e9s sont \u00e9tablis mais M.[L] s&#8217;est accommod\u00e9 de son passage au travail de nuit sans \u00e9lever de protestation et la violation du droit \u00e0 repos, demeur\u00e9e exceptionnelle, n&#8217;a pas eu pour effet de d\u00e9grader s\u00e9rieusement son \u00e9tat de sant\u00e9.&#8221; (Motifs de la d\u00e9cision). La valeur de cette analyse est de distinguer clairement l\u2019ex\u00e9cution fautive du contrat du harc\u00e8lement moral. Un manquement objectif, m\u00eame av\u00e9r\u00e9, ne suffit pas \u00e0 caract\u00e9riser la d\u00e9gradation intentionnelle ou r\u00e9p\u00e9t\u00e9e requise par la loi.<\/p>\n<p>La validation du licenciement pour faute grave<\/p>\n<p>La lic\u00e9it\u00e9 des m\u00e9thodes de contr\u00f4le justifi\u00e9e par la s\u00e9curit\u00e9<\/p>\n<p>La cour valide les conditions du contr\u00f4le inopin\u00e9 de stup\u00e9fiants. Elle souligne que l\u2019interdiction \u00e9tait pr\u00e9vue par le r\u00e8glement int\u00e9rieur et un avenant contractuel. Les contr\u00f4les sont jug\u00e9s &#8220;pleinement justifi\u00e9s par des imp\u00e9ratifs de s\u00e9curit\u00e9&#8221; (Motifs de la d\u00e9cision). Leur modalit\u00e9 est \u00e9galement approuv\u00e9e. Ils apparaissent comme &#8220;non intrusifs ni douloureux, \u00e9taient proportionn\u00e9s au but recherch\u00e9 relevant de l&#8217;int\u00e9r\u00eat g\u00e9n\u00e9ral.&#8221; (Motifs de la d\u00e9cision). Cette analyse consacre un contr\u00f4le de proportionnalit\u00e9. La s\u00e9curit\u00e9 constitue un motif l\u00e9gitime pouvant restreindre les libert\u00e9s individuelles au travail, sous r\u00e9serve de garanties proc\u00e9durales.<\/p>\n<p>La cons\u00e9cration d\u2019une faute grave malgr\u00e9 les contestations<\/p>\n<p>La fiabilit\u00e9 des preuves est \u00e9tablie par la convergence de plusieurs tests. &#8220;Il ressort de ces attestations circonstanci\u00e9es et concordantes que le premier test salivaire r\u00e9alis\u00e9 en pr\u00e9sence d&#8217;un t\u00e9moin s&#8217;est r\u00e9v\u00e9l\u00e9 positif contrairement \u00e0 ceux effectu\u00e9s au m\u00eame moment sur d&#8217;autres salari\u00e9s.&#8221; (Motifs de la d\u00e9cision). La cour \u00e9carte l\u2019argument du salari\u00e9 sur la consommation en dehors du lieu de travail. &#8220;Le moyen tenant \u00e0 ce que sa consommation de cannabis n&#8217;a pas eu lieu dans l&#8217;entreprise ne saurait prosp\u00e9rer, le fait \u00e9tant qu&#8217;il s&#8217;est pr\u00e9sent\u00e9 \u00e0 son poste de travail apr\u00e8s avoir consomm\u00e9 du cannabis.&#8221; (Motifs de la d\u00e9cision). La port\u00e9e de cette solution est ferme. Elle consid\u00e8re que la pr\u00e9sence sous l\u2019emprise d\u2019une substance prohib\u00e9e sur le lieu de travail, en violation d\u2019une obligation essentielle de s\u00e9curit\u00e9, constitue en soi une faute grave.
