Le litige portait sur un rappel de salaire conventionnel, le maintien de salaire pendant des arr\u00eats maladie et l&#8217;indemnisation d&#8217;un d\u00e9lai de pr\u00e9venance non respect\u00e9. La juridiction a confirm\u00e9 int\u00e9gralement le jugement des prud&#8217;hommes, rejetant la plupart des demandes du salari\u00e9 pour d\u00e9faut de preuve ou prescription.<\/p>\n<p>I. La charge de la preuve et les conditions du maintien de salaire<\/p>\n<p>La preuve des conditions l\u00e9gales incombe au salari\u00e9 demandeur.<br \/>\nLe salari\u00e9 sollicitait le paiement d&#8217;un maintien de salaire pour plusieurs p\u00e9riodes d&#8217;absence. La cour a rappel\u00e9 le texte de l&#8217;article L1226-1 du code du travail, qui subordonne ce droit \u00e0 trois conditions cumulatives. Elle a constat\u00e9 que le requ\u00e9rant &#8220;ne justifie nullement: &#8211; des arr\u00eats de travail all\u00e9gu\u00e9s, -de leur justification dans les 48 heures aupr\u00e8s de l&#8217;employeur, &#8211; de la prise en charge par la s\u00e9curit\u00e9 sociale&#8221;. Cette carence probatoire a conduit au rejet de sa demande. Le salari\u00e9 doit ainsi rapporter la preuve de chaque \u00e9l\u00e9ment constitutif de son droit. Cette solution rappelle que le b\u00e9n\u00e9fice des indemnit\u00e9s compl\u00e9mentaires n&#8217;est pas automatique. Elle impose une diligence active au salari\u00e9 pour se conformer aux formalit\u00e9s exig\u00e9es.<\/p>\n<p>L&#8217;employeur supporte une charge probatoire sp\u00e9cifique pour la contre-visite.<br \/>\nLa d\u00e9cision \u00e9voque indirectement le r\u00e9gime de la contre-visite m\u00e9dicale. Une jurisprudence constante pr\u00e9cise les obligations de l&#8217;employeur qui l&#8217;ordonne. Comme le rel\u00e8ve la Cour d&#8217;appel de Paris, &#8220;c&#8217;est \u00e0 l&#8217;employeur, qui prend l&#8217;initiative d&#8217;un tel contr\u00f4le d&#8217;\u00e9tablir qu&#8217;il n&#8217;a pu faire effectuer cette contre-visite en raison de la carence ou de l&#8217;opposition du salari\u00e9&#8221; (Cour d&#8217;appel de Paris, le 30 mai 2024, n\u00b020\/07711). Cette r\u00e9partition des charges de preuve prot\u00e8ge le salari\u00e9 d&#8217;une suspension arbitraire de son salaire. Elle oblige l&#8217;employeur \u00e0 documenter pr\u00e9cis\u00e9ment ses d\u00e9marches pour convoquer le salari\u00e9.<\/p>\n<p>II. L&#8217;effectivit\u00e9 des droits conventionnels et la prescription<\/p>\n<p>L&#8217;application d&#8217;un accord \u00e9tendu ob\u00e9it \u00e0 un calendrier strict.<br \/>\nLe salari\u00e9 r\u00e9clamait l&#8217;application r\u00e9troactive d&#8217;une revalorisation salarissue d&#8217;un accord \u00e9tendu. La cour a rappel\u00e9 le principe d&#8217;effet diff\u00e9r\u00e9 pour les entreprises non signataires. Elle a jug\u00e9 que l&#8217;accord &#8220;ne lui \u00e9tait applicable qu&#8217;\u00e0 compter du 1er jour du mois suivant l&#8217;extension&#8221; de l&#8217;arr\u00eat\u00e9. L&#8217;employeur n&#8217;\u00e9tait donc redevable de la nouvelle grille qu&#8217;\u00e0 partir du 1er mars 2020. Ce point de droit est essentiel pour la s\u00e9curit\u00e9 des relations conventionnelles. Il emp\u00eache toute application r\u00e9troactive non pr\u00e9vue par les textes, pr\u00e9servant ainsi la situation juridique ant\u00e9rieure.<\/p>\n<p>Le point de d\u00e9part de la prescription est fix\u00e9 par la connaissance du manquement.<br \/>\nLe salari\u00e9 demandait r\u00e9paration pour des communications de planning tardives. La cour a reconnu le manquement de l&#8217;employeur \u00e0 l&#8217;accord de branche. Elle a cependant d\u00e9clar\u00e9 la demande irrecevable pour prescription biennale. Elle a estim\u00e9 que le salari\u00e9 &#8220;a eu connaissance de ce manquement de l&#8217;employeur, a minima, \u00e0 compter de&#8221; la rupture de son contrat. Le d\u00e9lai de deux ans a donc couru \u00e0 partir de cette date, rendant la saisine tardive irrecevable. Cette solution souligne l&#8217;obligation de vigilance du salari\u00e9. Elle sanctionne l&#8217;inaction prolong\u00e9e face \u00e0 un manquement dont il avait parfaitement connaissance.<\/p>\n<p>Cette d\u00e9cision illustre l&#8217;importance cruciale de la preuve dans les litiges individuels du travail.
