Une salari\u00e9e ayant successivement travaill\u00e9 pour le compte d&#8217;une entreprise utilisatrice via deux soci\u00e9t\u00e9s de travail temporaire sollicite cette requalification en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e. Les juges du fond accueillent partiellement sa demande et en pr\u00e9cisent les effets indemnitaires complexes.<\/p>\n<p>La responsabilit\u00e9 de l&#8217;entreprise utilisatrice en cas d&#8217;emploi permanent<br \/>\nLe recours au travail temporaire est strictement encadr\u00e9 par la loi. Le contrat de mission ne peut avoir pour effet de pourvoir durablement un emploi li\u00e9 \u00e0 l&#8217;activit\u00e9 normale de l&#8217;entreprise utilisatrice. L&#8217;entreprise de travail temporaire qui, en connaissance de cause, met \u00e0 disposition un salari\u00e9 pour un tel emploi engage sa responsabilit\u00e9. La charge de la preuve d&#8217;une collusion frauduleuse pour contourner cette interdiction incombe au salari\u00e9. En l&#8217;esp\u00e8ce, la cour estime que le simple changement de soci\u00e9t\u00e9 de travail temporaire ou l&#8217;absence de proposition d&#8217;autres missions ne suffit pas \u00e0 \u00e9tablir cette collusion. &#8220;Il incombe au salari\u00e9 de d\u00e9montrer l&#8217;existence d&#8217;une collusion frauduleuse en vue de contourner l&#8217;interdiction susvis\u00e9e.&#8221; (Motifs) Cette solution rappelle que la preuve d&#8217;une entente consciente entre les soci\u00e9t\u00e9s est n\u00e9cessaire pour engager la responsabilit\u00e9 de l&#8217;entreprise de travail temporaire. La libert\u00e9 de changer de prestataire est ainsi pr\u00e9serv\u00e9e, sauf preuve contraire apport\u00e9e par le salari\u00e9.<\/p>\n<p>Les cons\u00e9quences indemnitaires de la requalification \u00e0 l&#8217;\u00e9gard de l&#8217;utilisatrice<br \/>\nLa requalification entra\u00eene une multitude de cr\u00e9ances \u00e0 la charge de l&#8217;entreprise utilisatrice. Celle-ci est seule d\u00e9bitrice de l&#8217;indemnit\u00e9 de requalification pr\u00e9vue par le code du travail. Le salari\u00e9 peut \u00e9galement pr\u00e9tendre au rappel des salaires des p\u00e9riodes interstitielles s&#8217;il prouve s&#8217;\u00eatre tenu \u00e0 disposition. &#8220;Le travailleur dont la relation de travail est requalifi\u00e9e en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e ne peut pr\u00e9tendre \u00e0 un rappel de salaire au titre des p\u00e9riodes non travaill\u00e9es entre plusieurs missions ou contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e que s&#8217;il s&#8217;est tenu \u00e0 la disposition de l&#8217;entreprise pendant ces p\u00e9riodes interstitielles, cette preuve lui incombant.&#8221; (Motifs) La rupture cons\u00e9cutive au terme du dernier contrat temporaire s&#8217;analyse en un licenciement sans cause r\u00e9elle et s\u00e9rieuse. La cour accorde donc des dommages-int\u00e9r\u00eats pour ce licenciement et pour la perte de chance de b\u00e9n\u00e9ficier d&#8217;un contrat de s\u00e9curisation professionnelle. Le salari\u00e9 requalifi\u00e9 b\u00e9n\u00e9ficie aussi des avantages conventionnels de l&#8217;entreprise, comme les cong\u00e9s suppl\u00e9mentaires. Cette approche garantit une r\u00e9paration int\u00e9grale du pr\u00e9judice subi du fait du contournement de la loi.<\/p>\n<p>La r\u00e9partition des obligations entre l&#8217;utilisatrice et l&#8217;entreprise de travail temporaire<br \/>\nLa responsabilit\u00e9 des rappels de salaire pour les p\u00e9riodes interstitielles peut \u00eatre partag\u00e9e. La cour consid\u00e8re que la dette de rappel de salaire pour une p\u00e9riode d\u00e9termin\u00e9e constitue une dette commune entre l&#8217;entreprise utilisatrice et la premi\u00e8re soci\u00e9t\u00e9 de travail temporaire. Elle proc\u00e8de alors \u00e0 une division de cette obligation selon la responsabilit\u00e9 propre de chaque d\u00e9biteur. &#8220;La cour n&#8217;\u00e9tant pas saisie d&#8217;une demande in solidum (ou solidaire) entre les entreprises SAD et PSI, ces derni\u00e8res seront tenues \u00e0 la dette commune envers le salari\u00e9, \u00e0 savoir le rappel de salaire retenu sur les p\u00e9riodes interstitielles du 15 mai 2017 au 26 juillet 2019, \u00e0 proportion de leur part de responsabilit\u00e9 propre.&#8221; (Motifs) En l&#8217;esp\u00e8ce, la responsabilit\u00e9 de la soci\u00e9t\u00e9 de travail temporaire est fix\u00e9e \u00e0 soixante-dix pour cent. Cette solution pragmatique permet une indemnisation compl\u00e8te du salari\u00e9 tout en tenant compte du r\u00f4le actif de chaque employeur dans le maintien de la situation irr\u00e9guli\u00e8re. Elle \u00e9vite les d\u00e9nis de justice tout en recherchant une \u00e9quitable r\u00e9partition des charges.<\/p>\n<p>Les limites des demandes indemnitaires du salari\u00e9<br \/>\nPlusieurs demandes indemnitaires suppl\u00e9mentaires sont rejet\u00e9es par la cour. La demande pour ex\u00e9cution d\u00e9loyale du contrat est \u00e9cart\u00e9e, les juges relevant que de nombreux droits sont communs aux int\u00e9rimaires et que d&#8217;autres pr\u00e9judices sont d\u00e9j\u00e0 indemnis\u00e9s. La violation de l&#8217;obligation de s\u00e9curit\u00e9 de r\u00e9sultat n&#8217;ouvre pas droit \u00e0 r\u00e9paration en l&#8217;absence de preuve d&#8217;un pr\u00e9judice personnel distinct. Enfin, la demande relative aux points de p\u00e9nibilit\u00e9 est jug\u00e9e irrecevable. La proc\u00e9dure sp\u00e9cifique de contestation aupr\u00e8s de l&#8217;employeur puis de l&#8217;organisme gestionnaire n&#8217;a pas \u00e9t\u00e9 respect\u00e9e. &#8220;Il incombe \u00e0 l&#8217;entreprise de travail temporaire, sur la base des informations communiqu\u00e9es par l&#8217;entreprise utilisatrice, de d\u00e9clarer \u00e0 la fin de chaque ann\u00e9e civile l&#8217;exposition de ses salari\u00e9s int\u00e9rimaires \u00e0 la p\u00e9nibilit\u00e9 aupr\u00e8s des organismes de s\u00e9curit\u00e9 sociale.&#8221; (Motifs) Cette d\u00e9cision rappelle le strict respect des voies de recours sp\u00e9ciales et le r\u00f4le d\u00e9claratif des entreprises de travail temporaire.
