Le bail, conclu le 1er mars 2023, fait l&#8217;objet d&#8217;un commandement de payer du 28 novembre 2023. Le juge examine l&#8217;application dans le temps de la loi du 27 juillet 2023, qui a r\u00e9duit le d\u00e9lai de gr\u00e2ce de deux mois \u00e0 six semaines. Il constate la r\u00e9siliation du bail \u00e0 la date du 29 janvier 2024 et ordonne l&#8217;expulsion de la locataire, tout en rejetant sa demande de d\u00e9lais de paiement.<\/p>\n<p>Le principe de non-r\u00e9troactivit\u00e9 de la loi nouvelle<\/p>\n<p>La d\u00e9cision applique strictement le principe de l&#8217;effet imm\u00e9diat de la loi dans le temps. Le juge rel\u00e8ve que la loi du 27 juillet 2023 modifiant l&#8217;article 24 de la loi du 6 juillet 1989 ne comporte pas de dispositions transitoires. Il en d\u00e9duit que son application est r\u00e9gie par l&#8217;article 2 du code civil. &#8220;Cette loi ne comprend pas de disposition d\u00e9rogeant \u00e0 l\u2019article 2 du code civil, selon lequel la loi ne dispose que pour l&#8217;avenir et n&#8217;a point d&#8217;effet r\u00e9troactif&#8221; (Motifs). La solution prot\u00e8ge la s\u00e9curit\u00e9 juridique des contrats en cours. Elle \u00e9vite une r\u00e9faction impr\u00e9vue des conventions l\u00e9galement form\u00e9es, pr\u00e9servant ainsi les droits acquis des parties. Cette approche est conforme \u00e0 la jurisprudence \u00e9tablie sur le sujet. &#8220;En l\u2019absence de dispositions transitoires, l\u2019application de la loi du 27 juillet 2023 dans le temps est r\u00e9gie par l\u2019article 2 du code civil&#8221; (Tribunal judiciaire de Bobigny, le 2 juin 2025, n\u00b024\/07001). Le d\u00e9lai contractuel de deux mois reste donc applicable.<\/p>\n<p>L&#8217;encadrement proc\u00e9dural de la r\u00e9siliation pour impay\u00e9s<\/p>\n<p>Le juge v\u00e9rifie scrupuleusement le respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;action en justice. Il constate que le bailleur a saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives. Cette saisine est intervenue plus de deux mois avant l&#8217;assignation, comme la loi l&#8217;exige. Il note \u00e9galement que la copie de l&#8217;assignation a \u00e9t\u00e9 notifi\u00e9e au pr\u00e9fet six semaines avant l&#8217;audience. Ces v\u00e9rifications assurent le respect des garanties proc\u00e9durales protectrices du locataire. Elles conditionnent la recevabilit\u00e9 de la demande du bailleur, garantissant un \u00e9quilibre entre les droits des parties. Le contr\u00f4le de ces conditions substantielles est une \u00e9tape indispensable avant tout examen au fond. Il vise \u00e0 pr\u00e9venir les expulsions brutales en assurant un dialogue social pr\u00e9alable. La r\u00e9gularit\u00e9 de la proc\u00e9dure est ainsi \u00e9tablie de mani\u00e8re incontestable.<\/p>\n<p>Les conditions strictes de l&#8217;octroi de d\u00e9lais de paiement<\/p>\n<p>Le rejet de la demande de d\u00e9lais de paiement illustre l&#8217;interpr\u00e9tation rigoureuse des conditions l\u00e9gales. Le juge reconna\u00eet que la locataire dispose de revenus stables, ce qui la met en situation de r\u00e9gler sa dette. Cependant, il rel\u00e8ve l&#8217;absence de reprise du versement int\u00e9gral du loyer courant. &#8220;Il ressort cependant du d\u00e9compte actualis\u00e9 au 3 juin 2025 qu\u2019elle n\u2019a pas repris le versement int\u00e9gral du loyer courant avant la date de l\u2019audience&#8221; (Motifs). Cette condition cumulative est interpr\u00e9t\u00e9e de mani\u00e8re stricte et objective. Le juge n&#8217;a donc pas le pouvoir discr\u00e9tionnaire d&#8217;accorder des d\u00e9lais en l&#8217;absence d&#8217;une reprise compl\u00e8te des paiements courants. Cette s\u00e9v\u00e9rit\u00e9 vise \u00e0 pr\u00e9server l&#8217;\u00e9quilibre financier du contrat et \u00e0 \u00e9viter les abus. Elle rappelle que la bienveillance du juge est subordonn\u00e9e \u00e0 un effort pr\u00e9alable du locataire.<\/p>\n<p>La port\u00e9e pratique d&#8217;une application non r\u00e9troactive<\/p>\n<p>L&#8217;application de l&#8217;ancien d\u00e9lai de deux mois est d\u00e9terminante pour la date d&#8217;acquisition de la clause r\u00e9solutoire. Le commandement de payer ayant \u00e9t\u00e9 d\u00e9livr\u00e9 le 28 novembre 2023, le d\u00e9lai de deux mois expire le 29 janvier 2024. Le juge constate que les sommes dues n&#8217;ont pas \u00e9t\u00e9 r\u00e9gl\u00e9es dans ce d\u00e9lai. &#8220;Il y a donc lieu de constater que les conditions d\u2019acquisition de la clause r\u00e9solutoire contenue dans le bail \u00e9taient r\u00e9unies \u00e0 la date du 29 janvier 2024&#8221; (Motifs). Si le nouveau d\u00e9lai de six semaines avait \u00e9t\u00e9 appliqu\u00e9, la clause serait devenue ex\u00e9cutoire plus t\u00f4t. Cette diff\u00e9rence concrete d\u00e9montre l&#8217;impact substantiel du choix du droit applicable. La d\u00e9cision s\u00e9curise ainsi les situations juridiques n\u00e9es sous l&#8217;empire de la loi ancienne.
