Le bailleur avait obtenu en premi\u00e8re instance la r\u00e9siliation du bail pour impay\u00e9s et l\u2019expulsion. La locataire fait appel en contestant le montant de la dette et la r\u00e9gularit\u00e9 de la proc\u00e9dure. La cour rejette son appel et confirme int\u00e9gralement le jugement d\u00e9f\u00e9r\u00e9.<\/p>\n<p>La confirmation des obligations p\u00e9cuniaires du preneur<\/p>\n<p>L\u2019exigence de preuve du paiement des loyers<\/p>\n<p>La cour rappelle le principe fondamental de la charge de la preuve en mati\u00e8re contractuelle. Le bailleur \u00e9tablit l\u2019existence de la cr\u00e9ance par la production d\u2019un d\u00e9compte locatif d\u00e9taill\u00e9. Il appartient alors au locataire de d\u00e9montrer qu\u2019il s\u2019est lib\u00e9r\u00e9 de son obligation. &#8220;Celui qui r\u00e9clame l&#8217;ex\u00e9cution d&#8217;une obligation doit la prouver ; r\u00e9ciproquement, celui qui se pr\u00e9tend lib\u00e9r\u00e9 doit justifier le paiement ou le fait qui a produit l&#8217;extinction de son obligation&#8221; (article 1353 du code civil). La locataire produit des relev\u00e9s d\u2019allocations logement ant\u00e9rieurs \u00e0 mars 2023, insuffisants pour contester le solde r\u00e9clam\u00e9. Elle ne fournit aucune preuve de paiement du loyer r\u00e9siduel ou de versements ult\u00e9rieurs par la caisse d\u2019allocations familiales. La cour estime donc que le d\u00e9compte du bailleur est exact et que la dette de 3 964,51 euros est \u00e9tablie.<\/p>\n<p>Le rejet des moyens fond\u00e9s sur l\u2019impr\u00e9cision du d\u00e9compte<\/p>\n<p>La locataire soutenait que le d\u00e9compte pr\u00e9sent\u00e9 manquait de pr\u00e9cision. La cour \u00e9carte cet argument en le qualifiant d\u2019inversion de la charge de la preuve. Elle constate que les relev\u00e9s produits par la locataire elle-m\u00eame corroborent la fiabilit\u00e9 du d\u00e9compte du bailleur pour la p\u00e9riode couverte. D\u00e8s lors, les conclusions de la locataire &#8220;se trouvent particuli\u00e8rement mal fond\u00e9es&#8221;. La confirmation de la condamnation au paiement s\u2019impose, le premier juge ayant motiv\u00e9 sa d\u00e9cision de mani\u00e8re &#8220;exacte et circonstanci\u00e9e&#8221;. Ce point rappelle que l\u2019all\u00e9gation d\u2019une impr\u00e9cision comptable ne suffit pas \u00e0 renverser la pr\u00e9somption de validit\u00e9 d\u2019un d\u00e9compte r\u00e9gulier.<\/p>\n<p>La r\u00e9gularit\u00e9 de la r\u00e9siliation du bail et ses cons\u00e9quences<\/p>\n<p>L\u2019acquisition de plein droit de la clause r\u00e9solutoire<\/p>\n<p>Le bail contenait une clause r\u00e9solutoire en cas de d\u00e9faut de paiement. Le bailleur a signifi\u00e9 un commandement de payer visant cette clause le 3 novembre 2022. La cour constate que le locataire n\u2019a pas r\u00e9gularis\u00e9 sa situation dans le d\u00e9lai contractuel. Elle adopte les motifs du premier juge qui avait &#8220;fait une analyse exactement circonstanci\u00e9e&#8221; de la proc\u00e9dure. Les conditions d\u2019acquisition de la clause sont donc r\u00e9unies depuis le 4 janvier 2023. Cette solution est conforme \u00e0 la jurisprudence qui estime qu\u2019un commandement de payer visant la clause et rest\u00e9 sans effet produit la r\u00e9siliation de plein droit. &#8220;En cons\u00e9quence, il convient de constater l&#8217;acquisition de la clause r\u00e9solutoire \u00e0 compter du 17 novembre 2022 \u00e0 24h&#8221; (Tribunal judiciaire de Paris, le 9 octobre 2025, n\u00b022\/14277). La cour ne fait ainsi que constater un effet de droit d\u00e9j\u00e0 produit.<\/p>\n<p>Les suites in\u00e9luctables de la r\u00e9siliation constat\u00e9e<\/p>\n<p>La r\u00e9siliation du bail \u00e9tant acquise, ses cons\u00e9quences l\u00e9gales s\u2019ensuivent automatiquement. La cour confirme l\u2019obligation de lib\u00e9rer les lieux et le principe d\u2019une indemnit\u00e9 d\u2019occupation due jusqu\u2019\u00e0 la restitution effective. Elle rejette la demande de la locataire tendant \u00e0 ce que la cour &#8220;dise n&#8217;y avoir lieu \u00e0 constater la r\u00e9siliation du bail ou \u00e0 la prononcer&#8221;. Cette demande est irrecevable car la cour, saisie en appel, ne peut que constater un fait juridique d\u00e9j\u00e0 r\u00e9alis\u00e9. &#8220;La cour ne peut donc que confirmer le jugement en ce qu&#8217;il a &#8216;constat\u00e9&#8217; la r\u00e9siliation du bail&#8221; (Cour d&#8217;appel de Paris, le 6 mars 2025, n\u00b022\/16762). Les d\u00e9lais de paiement accord\u00e9s en premi\u00e8re instance, non contest\u00e9s, ne suspendent pas les effets de la r\u00e9siliation.
