Le demandeur invoque une possession trentenaire d\u2019un immeuble et r\u00e9clame une indemnit\u00e9 pour un sinistre. Le tribunal accueille la demande en usucapion et condamne l\u2019assureur \u00e0 indemniser le sinistre.<\/p>\n<p>La cons\u00e9cration d\u2019une possession trentenaire caract\u00e9ris\u00e9e<br \/>\nLe juge v\u00e9rifie d\u2019abord la r\u00e9union des conditions l\u00e9gales de la prescription acquisitive. Il rappelle les textes exigeant une possession continue et non interrompue, paisible, publique, non \u00e9quivoque, et \u00e0 titre de propri\u00e9taire. L\u2019examen des preuves permet de caract\u00e9riser cette possession. Le tribunal rel\u00e8ve la concordance de plusieurs attestations pr\u00e9cisant que le demandeur &#8220;a occup\u00e9 en qualit\u00e9 de propri\u00e9taire la maison&#8221; et l\u2019a r\u00e9nov\u00e9e depuis 1985. Ces t\u00e9moignages sont corrobor\u00e9s par un acte de 1986, des factures et le paiement des taxes fonci\u00e8res. Le sens de cette analyse est un examen rigoureux des \u00e9l\u00e9ments de preuve. La valeur r\u00e9side dans l\u2019application stricte de l\u2019article 2261 du code civil. La port\u00e9e est de confirmer que des attestations circonstanci\u00e9es peuvent suffire \u00e0 \u00e9tablir la possession.<\/p>\n<p>La pr\u00e9somption de continuit\u00e9 de la possession joue ensuite en faveur du demandeur. Le tribunal applique l\u2019article 2264 du code civil disposant que &#8220;le possesseur actuel qui prouve avoir poss\u00e9d\u00e9 anciennement est pr\u00e9sum\u00e9 avoir poss\u00e9d\u00e9 dans le temps interm\u00e9diaire&#8221;. Cette pr\u00e9somption, combin\u00e9e aux preuves apport\u00e9es, permet de couvrir la totalit\u00e9 de la p\u00e9riode requise. Le sens est de faciliter la preuve de la continuit\u00e9 possessionnelle. La valeur est l\u2019application d\u2019une pr\u00e9somption l\u00e9gale favorable au possesseur. La port\u00e9e est align\u00e9e sur une jurisprudence constante, comme le rappelle un arr\u00eat pr\u00e9cisant qu\u2019il suffit de justifier &#8220;pendant trente ans d&#8217;une possession continue et non interrompue, paisible, publique, non \u00e9quivoque, et \u00e0 titre de propri\u00e9taire&#8221; (Tribunal judiciaire de Paris, le 9 septembre 2025, n\u00b023\/02496).<\/p>\n<p>La double sanction : transfert de propri\u00e9t\u00e9 et obligation de garantie<br \/>\nL\u2019acquisition par usucapion produit l\u2019effet imm\u00e9diat de transf\u00e9rer la propri\u00e9t\u00e9. Le tribunal constate que les conditions sont r\u00e9unies et d\u00e9clare le demandeur propri\u00e9taire. Il ajoute que &#8220;le jugement vaut titre de propri\u00e9t\u00e9&#8221;. Cette d\u00e9cision a une autorit\u00e9 de la chose jug\u00e9e et doit \u00eatre publi\u00e9e \u00e0 la publicit\u00e9 fonci\u00e8re. Le sens est de donner une sanction d\u00e9finitive \u00e0 la possession prolong\u00e9e. La valeur est l\u2019application du principe selon lequel l\u2019usucapion est un mode d\u2019acquisition de la propri\u00e9t\u00e9. La port\u00e9e est pratique, le jugement tenant lieu de titre pour les formalit\u00e9s ult\u00e9rieures.<\/p>\n<p>La condamnation de l\u2019assureur \u00e0 indemniser le sinistre intervient malgr\u00e9 la discussion sur la propri\u00e9t\u00e9. Le tribunal rappelle que la soci\u00e9t\u00e9 &#8220;ne conteste pas devoir sa garantie&#8221; et la condamne en cons\u00e9quence. Cette solution s\u2019appuie sur le principe de la transmission des droits n\u00e9s du contrat d\u2019assurance au nouvel acqu\u00e9reur. Le sens est de dissocier la question de la propri\u00e9t\u00e9 de celle du droit \u00e0 indemnisation. La valeur est la protection de l\u2019assur\u00e9, possesseur de l\u2019immeuble, contre les risques.
