Cette d\u00e9cision intervient dans un litige locatif opposant un organisme bailleur \u00e0 ses locataires pour d\u00e9faut de paiement. Le juge constate la r\u00e9siliation du bail mais accorde \u00e9galement des d\u00e9lais de paiement et suspend la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> sous conditions. Cette solution illustre la conciliation entre la sanction de l\u2019inex\u00e9cution et la protection du locataire dans le cadre du droit au logement.<\/p>\n<p>La constatation judiciaire de la r\u00e9siliation du bail pour inex\u00e9cution<\/p>\n<p>Le juge rappelle d\u2019abord le cadre l\u00e9gal strict encadrant la r\u00e9solution du bail pour impay\u00e9s. Le paiement des loyers constitue une obligation essentielle du locataire d\u00e9coulant de la loi. Le juge souligne que &#8220;toute clause pr\u00e9voyant la r\u00e9solution de plein droit du contrat de location pour d\u00e9faut de paiement du loyer ou des charges locatives aux termes convenus ou pour non-versement du <a href=\"https:\/\/kohenavocats.fr\/avocat-depot-garantie-paris\/\" target=\"_blank\" title=\"d\u00e9p\u00f4t de garantie\">d\u00e9p\u00f4t de garantie<\/a> ne produit effet que six semaines apr\u00e8s un <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> demeur\u00e9 infructueux&#8221; (Motifs de la d\u00e9cision). Ce d\u00e9lai, d\u2019ordre public, vise \u00e0 prot\u00e9ger le locataire en lui laissant un temps pour r\u00e9gulariser sa situation. En l\u2019esp\u00e8ce, un commandement r\u00e9gulier est demeur\u00e9 sans effet dans le d\u00e9lai applicable. Le juge constate donc la r\u00e9siliation du bail \u00e0 une date d\u00e9termin\u00e9e, faisant ainsi jouer la clause contractuelle dans le respect de la proc\u00e9dure l\u00e9gale. Cette premi\u00e8re \u00e9tape affirme le principe de l\u2019exigibilit\u00e9 des obligations locatives et la sanction de leur inex\u00e9cution.<\/p>\n<p>La d\u00e9cision proc\u00e8de ensuite \u00e0 l\u2019examen des cons\u00e9quences p\u00e9cuniaires de cette r\u00e9siliation. Conform\u00e9ment \u00e0 la loi, le locataire reste redevable des loyers et charges impay\u00e9s jusqu\u2019\u00e0 la date de r\u00e9siliation. Le juge condamne ainsi la locataire au paiement d\u2019un arri\u00e9r\u00e9 pr\u00e9cis\u00e9ment chiffr\u00e9. Cette condamnation s\u2019inscrit dans le droit commun des obligations. Elle rappelle que la r\u00e9siliation n\u2019efface pas les dettes ant\u00e9rieures n\u00e9es de l\u2019ex\u00e9cution d\u00e9faillante du contrat. Le juge veille \u00e9galement \u00e0 \u00e9carter toute clause abusive, en rappelant que sont r\u00e9put\u00e9es non \u00e9crites les clauses pr\u00e9voyant des p\u00e9nalit\u00e9s ou des frais de relance \u00e0 la charge du locataire. Cette application stricte de la loi de 1989 prot\u00e8ge le locataire contre des exigences p\u00e9cuniaires excessives du bailleur au-del\u00e0 de la dette principale.<\/p>\n<p>L\u2019am\u00e9nagement judiciaire des cons\u00e9quences de la r\u00e9siliation<\/p>\n<p>Le c\u0153ur de la d\u00e9cision r\u00e9side dans le pouvoir d\u2019am\u00e9nagement conf\u00e9r\u00e9 au juge par la loi r\u00e9cente. Sur demande de la locataire, le juge examine la possibilit\u00e9 d\u2019accorder des d\u00e9lais de paiement. La loi pr\u00e9voit que &#8220;le juge peut, \u00e0 la demande du locataire, du bailleur ou d\u2019office, \u00e0 la condition que (1) le locataire soit en situation de r\u00e9gler sa dette locative (2) et qu\u2019il ait repris le versement int\u00e9gral du loyer courant avant la date de l\u2019audience, accorder des d\u00e9lais de paiement&#8221; (Motifs de la d\u00e9cision). En l\u2019esp\u00e8ce, la locataire ayant repris le paiement du loyer courant et justifiant de ressources modestes mais r\u00e9guli\u00e8res, le juge estime les conditions remplies. Il use de son pouvoir pour autoriser un apurement de la dette en trente-six mensualit\u00e9s. Cet \u00e9ch\u00e9ancier est adapt\u00e9 \u00e0 la capacit\u00e9 de remboursement de la locataire, incarnant la fonction sociale du juge du contentieux de la protection.<\/p>\n<p>Le m\u00e9canisme le plus notable est la suspension concomitante des effets de la clause r\u00e9solutoire. Le juge d\u00e9cide de &#8220;suspendre la clause r\u00e9solutoire stipul\u00e9e dans le bail&#8221; (Motifs de la d\u00e9cision) pendant la dur\u00e9e de l\u2019\u00e9ch\u00e9ancier. Cette suspension est conditionnelle et r\u00e9versible. Elle prendra fin, et la r\u00e9siliation reprendra son plein effet, d\u00e8s le premier impay\u00e9 sur l\u2019\u00e9ch\u00e9ancier ou sur le loyer courant. Ce dispositif hybride maintient le locataire dans les lieux tout en prot\u00e9geant le bailleur par une sanction automatique en cas de nouveau manquement. Il op\u00e8re une distinction temporelle fine entre la dette pass\u00e9e, payable \u00e0 temp\u00e9rament, et l\u2019obligation pr\u00e9sente de payer le loyer courant, dont le respect est imp\u00e9ratif pour conserver le logement. Cette mesure pr\u00e9ventive \u00e9vite une expulsion imm\u00e9diate tout en garantissant l\u2019ex\u00e9cution future.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est significative. Elle illustre l\u2019\u00e9volution du droit vers une recherche d\u2019\u00e9quilibre entre les int\u00e9r\u00eats des parties. Le juge ne se contente pas de constater la r\u00e9siliation, il utilise les outils l\u00e9gaux pour en am\u00e9nager les effets et tenter de pr\u00e9server la relation locative. Cette approche est coh\u00e9rente avec l\u2019objectif de pr\u00e9vention des expulsions. Elle rejoint la solution d\u2019une autre juridiction qui rappelait que &#8220;le locataire est redevable de l\u2019ensemble des loyers et charges impay\u00e9s jusqu\u2019\u00e0 la date de r\u00e9siliation du bail&#8221; (Tribunal judiciaire de Bobigny, le 31 mars 2025, n\u00b023\/03614), tout en permettant une indemnit\u00e9 d\u2019occupation post-r\u00e9siliation. Ici, le juge va plus loin en suspendant la r\u00e9siliation elle-m\u00eame sous conditions.
