Ce dernier contestait son <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-licenciement-faute-paris\/\" target=\"_blank\" title=\"licenciement pour faute\">licenciement pour faute<\/a> grave. La cour a confirm\u00e9 l&#8217;absence de cause r\u00e9elle et s\u00e9rieuse du licenciement en raison d&#8217;une notification tardive. Elle a \u00e9galement r\u00e9\u00e9valu\u00e9 \u00e0 la hausse plusieurs indemnit\u00e9s dues au salari\u00e9 tout en rejetant certaines de ses demandes.<\/p>\n<p>La sanction d&#8217;un licenciement irr\u00e9gulier<\/p>\n<p>Le caract\u00e8re imp\u00e9ratif du d\u00e9lai de notification<\/p>\n<p>La cour a jug\u00e9 le licenciement d\u00e9pourvu de cause r\u00e9elle et s\u00e9rieuse. Ce constat repose sur le non-respect du d\u00e9lai l\u00e9gal de notification de la sanction. Le texte pr\u00e9voit que &#8220;la sanction ne peut intervenir moins de deux jours ouvrables, ni plus d&#8217;un mois apr\u00e8s le jour fix\u00e9 pour l&#8217;entretien&#8221; (article L. 1332-2 du code du travail). En l&#8217;esp\u00e8ce, la lettre de licenciement a \u00e9t\u00e9 signifi\u00e9e plus d&#8217;un mois apr\u00e8s la date initiale de l&#8217;entretien pr\u00e9alable. La cour a pr\u00e9cis\u00e9 que &#8220;c&#8217;est cette date initiale de l&#8217;entretien pr\u00e9alable qui constitue le point de d\u00e9part du d\u00e9lai&#8221; (Motifs, sur le licenciement). Ce d\u00e9lai est qualifi\u00e9 de d\u00e9lai de fond imp\u00e9ratif et non d&#8217;une simple r\u00e8gle de forme proc\u00e9durale. Cette analyse consacre une protection forte des droits du salari\u00e9 face aux irr\u00e9gularit\u00e9s disciplinaires. Elle rappelle que la r\u00e9gularit\u00e9 de la proc\u00e9dure conditionne la validit\u00e9 m\u00eame de la cause du licenciement.<\/p>\n<p>La distinction entre faute grave et cause r\u00e9elle et s\u00e9rieuse<\/p>\n<p>La d\u00e9cision op\u00e8re une distinction nette entre la qualification de la faute et l&#8217;existence d&#8217;une cause r\u00e9elle et s\u00e9rieuse. Ici, la gravit\u00e9 des faits reproch\u00e9s, potentiellement constitutive d&#8217;une faute grave, est \u00e9clips\u00e9e par l&#8217;irr\u00e9gularit\u00e9 proc\u00e9durale. Cette solution rejoint une jurisprudence constante. Une autre chambre de la m\u00eame cour a ainsi jug\u00e9 que &#8220;le licenciement ne reposait pas sur une faute grave mais sur une faute simple constitutive d&#8217;une cause r\u00e9elle et s\u00e9rieuse&#8221; (Cour d&#8217;appel de Toulouse, le 26 juin 2025, n\u00b023\/03711). La pr\u00e9sente d\u00e9cision va plus loin en annulant le licenciement pour vice de forme substantiel. Elle d\u00e9montre qu&#8217;une proc\u00e9dure irr\u00e9guli\u00e8re peut vicier le licenciement m\u00eame lorsque les faits semblent graves. La notification tardive prive ainsi l&#8217;employeur du b\u00e9n\u00e9fice de la qualification disciplinaire qu&#8217;il entendait retenir.<\/p>\n<p>La r\u00e9paration du pr\u00e9judice du salari\u00e9<\/p>\n<p>L&#8217;application du bar\u00e8me l\u00e9gal pour le licenciement sans cause<\/p>\n<p>Apr\u00e8s avoir constat\u00e9 l&#8217;absence de cause r\u00e9elle et s\u00e9rieuse, la cour a fix\u00e9 l&#8217;indemnit\u00e9 correspondante. Elle a rejet\u00e9 la demande d&#8217;\u00e9carter le bar\u00e8me de l&#8217;article L. 1235-3 du code du travail. Elle a appliqu\u00e9 ce bar\u00e8me pour octroyer une indemnit\u00e9 de 20 000 euros. Pour ce faire, elle a proc\u00e9d\u00e9 \u00e0 une appr\u00e9ciation concr\u00e8te des circonstances. Elle a pris en compte &#8220;l&#8217;effectif de l&#8217;entreprise, des circonstances de la rupture, du montant de la r\u00e9mun\u00e9ration [&#8230;] de son anciennet\u00e9, de sa capacit\u00e9 \u00e0 trouver un nouvel emploi&#8221; (Motifs, sur les dommages et int\u00e9r\u00eats). Cette m\u00e9thode respecte le cadre l\u00e9gal tout en permettant une indemnisation personnalis\u00e9e. Elle assure une r\u00e9paration ad\u00e9quate de la perte d&#8217;emploi tout en maintenant un effet dissuasif pour l&#8217;employeur. La cour valide ainsi la conformit\u00e9 du bar\u00e8me fran\u00e7ais avec les standards internationaux.<\/p>\n<p>La liquidation d\u00e9taill\u00e9e des autres cr\u00e9ances salariales<\/p>\n<p>La d\u00e9cision proc\u00e8de \u00e0 une liquidation minutieuse de toutes les indemnit\u00e9s accessoires. La cour accorde l&#8217;indemnit\u00e9 compensatrice de pr\u00e9avis et l&#8217;indemnit\u00e9 de cong\u00e9s pay\u00e9s aff\u00e9rente. Elle retient \u00e9galement l&#8217;indemnit\u00e9 l\u00e9gale de licenciement, plus favorable que l&#8217;indemnit\u00e9 conventionnelle. Par ailleurs, elle alloue des dommages et int\u00e9r\u00eats sp\u00e9cifiques pour la remise tardive de l&#8217;attestation P\u00f4le emploi. En revanche, elle rejette les demandes pour licenciement brutal et vexatoire et pour perte du logement de fonction. Elle motive ces rejets par un d\u00e9faut de preuve du pr\u00e9judice distinct. &#8220;Il incombe \u00e0 chaque partie de prouver les faits n\u00e9cessaires au succ\u00e8s de sa pr\u00e9tention&#8221; (Motifs, sur les dommages et int\u00e9r\u00eats pour licenciement brutal). Cette approche \u00e9quilibre une r\u00e9paration int\u00e9grale du pr\u00e9judice avec un strict respect du droit de la preuve.
