Le bailleur a d\u00e9livr\u00e9 un commandement de payer en novembre 2024, demeur\u00e9 partiellement impay\u00e9 apr\u00e8s le d\u00e9lai l\u00e9gal. Le juge constate la r\u00e9siliation du bail et ordonne l&#8217;expulsion, tout en rejetant une demande de dommages-int\u00e9r\u00eats pour r\u00e9sistance abusive.<\/p>\n<p>La mise en \u0153uvre rigoureuse de la clause r\u00e9solutoire<\/p>\n<p>Le juge v\u00e9rifie scrupuleusement le respect des conditions proc\u00e9durales pr\u00e9vues par la loi. L&#8217;assignation est d\u00e9clar\u00e9e recevable car notifi\u00e9e dans le d\u00e9lai de six semaines requis par l&#8217;article 24 de la loi du 6 juillet 1989. Le commandement de payer du 19 novembre 2024 est r\u00e9gulier en la forme et rappelle express\u00e9ment la clause r\u00e9solutoire et les d\u00e9lais applicables. Le juge souligne que la loi nouvelle r\u00e9duisant le d\u00e9lai \u00e0 six semaines n&#8217;\u00e9tait pas applicable \u00e0 la date de l&#8217;exploit, confirmant l&#8217;application de la loi ancienne.<\/p>\n<p>Le d\u00e9faut de paiement substantiel permet l&#8217;activation de la clause. Le juge rel\u00e8ve qu&#8217;aucune r\u00e9gularisation totale n&#8217;est intervenue dans les deux mois suivant le commandement. Le relev\u00e9 de compte produit \u00e9tablit une dette persistante de loyer et charges. &#8220;D&#8217;une part, aucune r\u00e9gularisation totale n\u2019a eu lieu dans les deux mois suivant la d\u00e9livrance du commandement de payer. D&#8217;autre part, il est \u00e9tabli par le relev\u00e9 de compte que le locataire n&#8217;est pas \u00e0 jour de ses loyers et charges.&#8221; (Motifs de la d\u00e9cision). Cette analyse rejoint une jurisprudence constante exigeant un d\u00e9faut de paiement non apur\u00e9 pour activer la clause. &#8220;Or, il est constant que l&#8217;arri\u00e9r\u00e9 locatif \u00e0 la date du commandement de payer s&#8217;\u00e9levait au moins \u00e0 la somme de 3.213,30 euros. Or, les versements effectu\u00e9s avant le 9 janvier 2023, d&#8217;un montant de 1.450,00 euros, \u00e9taient insuffisants pour apurer la dette locative.&#8221; (Tribunal judiciaire de Tours, le 6 juin 2025, n\u00b024\/04916). La r\u00e9siliation est donc constat\u00e9e de plein droit \u00e0 la date anniversaire des deux mois.<\/p>\n<p>Les cons\u00e9quences de la r\u00e9siliation et le rejet des demandes excessives<\/p>\n<p>La d\u00e9cision organise les suites pratiques de la r\u00e9siliation avec pr\u00e9cision. Le bail est r\u00e9sili\u00e9 au 19 janvier 2025, date anniversaire du d\u00e9lai de deux mois. Les locataires sont condamn\u00e9s solidairement au paiement des loyers impay\u00e9s arr\u00eat\u00e9s \u00e0 juin 2025. Une indemnit\u00e9 d&#8217;occupation, \u00e9quivalente au loyer, est due \u00e0 compter de cette date jusqu&#8217;\u00e0 la lib\u00e9ration effective des lieux. Le juge pr\u00e9voit l&#8217;expulsion avec le concours de la force publique apr\u00e8s un commandement de quitter les lieux, et autorise la saisie des animaux pr\u00e9sents.<\/p>\n<p>Le juge op\u00e8re un contr\u00f4le strict des demandes indemnitaires accessoires. La demande de dommages et int\u00e9r\u00eats pour r\u00e9sistance abusive est rejet\u00e9e. Le bailleur invoquait un pr\u00e9judice distinct du retard de paiement mais n&#8217;en a pas rapport\u00e9 la preuve. &#8220;Or, la SCI SAINT EBREMOND doit pouvoir justifier un pr\u00e9judice distinct de celui caus\u00e9 par le d\u00e9faut de paiement de la dette, ce qu&#8217;elle ne fait pas.&#8221; (Motifs de la d\u00e9cision). Cette solution rappelle l&#8217;exigence de preuve du pr\u00e9judice et de la mauvaise foi du d\u00e9biteur. En revanche, une somme au titre de l&#8217;article 700 du code de proc\u00e9dure civile est allou\u00e9e pour les frais non compris dans les d\u00e9pens. La d\u00e9cision rappelle enfin les voies de recours possibles pour la locataire face \u00e0 l&#8217;expulsion, comme la saisine de la commission du DALO.<\/p>\n<p>Cette d\u00e9cision illustre l&#8217;\u00e9quilibre recherch\u00e9 entre la protection du droit du bailleur et les garanties proc\u00e9durales du locataire. Elle applique strictement le r\u00e9gime de la clause r\u00e9solutoire en exigeant un commandement r\u00e9gulier et un d\u00e9faut de paiement non couvert. Elle limite les cons\u00e9quences pour le locataire au strict n\u00e9cessaire en rejetant les demandes indemnitaires non justifi\u00e9es.
