Le bailleur, une personne morale, a sollicit\u00e9 le constat de la r\u00e9solution du contrat et le paiement des sommes dues. Apr\u00e8s avoir v\u00e9rifi\u00e9 la recevabilit\u00e9 de l\u2019action, le juge a accueilli la demande principale. Il a constat\u00e9 la r\u00e9siliation du bail et condamn\u00e9 les locataires au paiement d\u2019une cr\u00e9ance et \u00e0 l\u2019expulsion.<\/p>\n<p>Le formalisme proc\u00e9dural pr\u00e9alable \u00e0 l\u2019action en r\u00e9siliation<\/p>\n<p>Le respect des conditions de saisine de la juridiction est strictement contr\u00f4l\u00e9. Le juge v\u00e9rifie d\u2019abord la r\u00e9gularit\u00e9 de la notification de l\u2019assignation au repr\u00e9sentant de l\u2019\u00c9tat. L\u2019assignation a \u00e9t\u00e9 notifi\u00e9e au repr\u00e9sentant de l&#8217;\u00c9tat dans le d\u00e9partement par voie \u00e9lectronique le 24 avril 2025, soit plus de six semaines avant l\u2019audience. Cette condition, issue de la loi du 6 juillet 1989, est une garantie proc\u00e9durale essentielle pour le locataire. Elle permet \u00e0 l\u2019autorit\u00e9 administrative de pr\u00e9parer un \u00e9ventuel relogement dans des d\u00e9lais suffisants. Le juge contr\u00f4le ensuite l\u2019obligation de saisine pr\u00e9alable d\u2019une commission de conciliation. Le bailleur justifie avoir saisi la Commission de Coordination des Actions de Pr\u00e9vention des Expulsions le 30 septembre 2024. Cette saisine intervient deux mois au moins avant la d\u00e9livrance de l\u2019assignation, conform\u00e9ment \u00e0 la loi. Ce formalisme constitue un filtre proc\u00e9dural visant \u00e0 favoriser une solution amiable. Son strict respect conditionne la recevabilit\u00e9 de l\u2019action en justice intent\u00e9e par le bailleur.<\/p>\n<p>Les conditions de mise en \u0153uvre de la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> l\u00e9gale<\/p>\n<p>Le r\u00e9gime de la clause r\u00e9solutoire en mati\u00e8re de baux d\u2019habitation est d\u2019ordre public. Le juge rappelle le principe l\u00e9gal encadrant les clauses r\u00e9solutoires de plein droit. Toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour un d\u00e9faut de paiement du loyer ou des charges aux termes convenus ne produit d\u2019effet que deux mois apr\u00e8s un <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> demeur\u00e9 infructueux. Ce texte impose un d\u00e9lai de gr\u00e2ce obligatoire apr\u00e8s un commandement infructueux. Il s\u2019applique de plein droit, ind\u00e9pendamment des stipulations contractuelles. Le juge proc\u00e8de ensuite \u00e0 l\u2019application de ce r\u00e9gime aux faits de l\u2019esp\u00e8ce. Le bail sign\u00e9 par les parties contient une clause r\u00e9solutoire pr\u00e9voyant une r\u00e9siliation de plein droit \u00e0 d\u00e9faut de paiement des loyers. Le commandement de payer est demeur\u00e9 sans effet au terme du d\u00e9lai de deux mois imparti par la loi. La r\u00e9siliation est donc constat\u00e9e \u00e0 la date d\u2019expiration de ce d\u00e9lai l\u00e9gal. Ce m\u00e9canisme prot\u00e8ge le locataire contre une rupture trop brutale du contrat pour un incident de paiement.<\/p>\n<p>La cons\u00e9quence principale de la r\u00e9siliation : l\u2019obligation de lib\u00e9rer les lieux<\/p>\n<p>La r\u00e9siliation du bail emporte l\u2019obligation pour l\u2019occupant de quitter les lieux. Le jugement constate d\u2019abord que les anciens locataires sont d\u00e9sormais sans titre d\u2019occupation. Il constate que depuis cette date, les d\u00e9fendeurs sont occupants sans droit ni titre du dit logement. Cette qualification juridique fonde la suite des d\u00e9cisions du juge concernant l\u2019expulsion. Le juge organise ensuite les modalit\u00e9s pratiques de la lib\u00e9ration des lieux. Il sera proc\u00e9d\u00e9 \u00e0 son expulsion et \u00e0 celle de tous occupants et tous biens de leur chef, avec le concours de la force publique. L\u2019expulsion est prononc\u00e9e, mais son ex\u00e9cution est subordonn\u00e9e \u00e0 un nouveau commandement et \u00e0 un d\u00e9lai de deux mois. Ce d\u00e9lai suppl\u00e9mentaire vise \u00e0 laisser une ultime possibilit\u00e9 de quitter les lieux sans intervention forc\u00e9e. La d\u00e9cision pr\u00e9voit \u00e9galement le sort des meubles laiss\u00e9s sur place conform\u00e9ment au code des proc\u00e9dures civiles d\u2019ex\u00e9cution.<\/p>\n<p>Les cons\u00e9quences p\u00e9cuniaires de la r\u00e9siliation et les frais de proc\u00e9dure<\/p>\n<p>La r\u00e9siliation n\u2019\u00e9teint pas les obligations p\u00e9cuniaires n\u00e9es du contrat. Le juge condamne d\u2019abord au paiement des loyers et charges impay\u00e9s jusqu\u2019\u00e0 la r\u00e9siliation. Il condamne les d\u00e9fendeurs \u00e0 payer au bailleur la somme de 5242,17 euros \u00e0 valoir sur le montant des loyers, indemnit\u00e9s d\u2019occupation et charges \u00e9chus non r\u00e9gl\u00e9s. Cette condamnation inclut les sommes dues avant le constat de r\u00e9siliation du bail. Il fixe ensuite le montant de l\u2019indemnit\u00e9 d\u2019occupation due apr\u00e8s la r\u00e9siliation. L\u2019indemnit\u00e9 d\u2019occupation est fix\u00e9e \u00e0 compter de cette date au montant du loyer en cours r\u00e9visable, augment\u00e9 des charges. Cette indemnit\u00e9, distincte du loyer, est due jusqu\u2019\u00e0 la remise effective des cl\u00e9s. Le juge statue enfin sur la prise en charge des frais de proc\u00e9dure. Il convient de condamner les d\u00e9fendeurs aux d\u00e9pens en ce inclus notamment les frais du commandement de payer et de l\u2019assignation. Les frais de commissaire de justice sont int\u00e9gr\u00e9s aux d\u00e9pens, conform\u00e9ment \u00e0 la proc\u00e9dure civile.
