Le bailleur a sollicit\u00e9 le paiement d\u2019arri\u00e9r\u00e9s, la r\u00e9siliation du bail et l\u2019expulsion du locataire pour d\u00e9faut de paiement. Le locataire a oppos\u00e9 une demande de d\u00e9lais de paiement. La juridiction a condamn\u00e9 le locataire au paiement des sommes dues, rejet\u00e9 sa demande de d\u00e9lais, constat\u00e9 la r\u00e9siliation du bail et ordonn\u00e9 son expulsion.<\/p>\n<p>Le rejet des d\u00e9lais de paiement pour absence de paiement courant<\/p>\n<p>La demande de d\u00e9lais de paiement a \u00e9t\u00e9 \u00e9cart\u00e9e en raison d\u2019un d\u00e9faut de paiement du loyer courant. Le juge rappelle que l\u2019octroi de d\u00e9lais est subordonn\u00e9 \u00e0 une condition pr\u00e9alable. &#8220;Ces dispositions imposent, \u00e0 titre de condition liminaire \u00e0 l\u2019octroi de d\u00e9lais de paiement, la reprise du r\u00e8glement int\u00e9grale du loyer courant&#8221; (II &#8211; Sur la demande de d\u00e9lais de paiement). Le d\u00e9compte produit d\u00e9montrait que cette condition n\u2019\u00e9tait pas remplie. La solution est conforme \u00e0 la lettre de l\u2019article 24 V de la loi du 6 juillet 1989. Elle rappelle avec rigueur que le l\u00e9gislateur a conditionn\u00e9 cette mesure de faveur \u00e0 la r\u00e9gularisation imm\u00e9diate de la situation locative courante. Cette interpr\u00e9tation stricte prot\u00e8ge le bailleur contre une occupation durable sans contrepartie financi\u00e8re.<\/p>\n<p>La constatation de la r\u00e9siliation de plein droit du bail<\/p>\n<p>La juridiction a constat\u00e9 la r\u00e9siliation automatique du contrat suite \u00e0 un <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> rest\u00e9 infructueux. Le bail contenait une <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> conforme \u00e0 la loi. &#8220;Il convient donc de constater la r\u00e9siliation de plein droit du bail \u00e0 la date du 14 d\u00e9cembre 2024&#8221; (III &#8211; Sur la r\u00e9siliation du bail et sur la demande en expulsion). Cette date correspond \u00e0 l\u2019expiration du d\u00e9lai de deux mois suivant le commandement signifi\u00e9 le 14 octobre 2024. Cette application est en parfaite conformit\u00e9 avec la jurisprudence existante. &#8220;Il r\u00e9sulte de l&#8217;article 24 I de la loi n\u00b089-462 du 6 juillet 1989 [&#8230;] que toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement [&#8230;] ne produit effet que deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#8221; (Tribunal judiciaire de Metz, le 18 novembre 2025, n\u00b025\/00047). La d\u00e9cision illustre le m\u00e9canisme automatique de la r\u00e9solution, le juge se bornant \u00e0 en constater la r\u00e9alisation.<\/p>\n<p>La port\u00e9e pratique de la d\u00e9cision<\/p>\n<p>Cette ordonnance renforce la s\u00e9curit\u00e9 juridique des proc\u00e9dures d\u2019expulsion pour impay\u00e9s. Elle rappelle le formalisme imp\u00e9ratif du commandement de payer, pr\u00e9alable n\u00e9cessaire \u00e0 la r\u00e9solution. Elle souligne \u00e9galement que le juge ne prononce pas la r\u00e9siliation mais en constate la survenance automatique. &#8220;Il convient de consid\u00e9rer que les conditions pour constater l&#8217;acquisition de la clause r\u00e9solutoire \u00e9taient r\u00e9unies&#8221; (Cour d&#8217;appel de Toulouse, le 12 juin 2025, n\u00b024\/02590). Enfin, le rejet des d\u00e9lais de paiement faute de paiement courant limite strictement l\u2019usage de cette mesure.
