Il statue sur une demande de constat de r\u00e9siliation de bail pour d\u00e9faut de paiement de loyers. Le bailleur justifie d&#8217;un commandement de payer demeur\u00e9 infructueux et du respect des formalit\u00e9s pr\u00e9alables. Les locataires ne comparaissent pas mais ont repris le paiement du loyer courant. Le juge constate l&#8217;acquisition de la clause r\u00e9solutoire tout en accordant des d\u00e9lais de paiement et en suspendant ses effets. La solution combine ainsi la sanction du d\u00e9faut de paiement et une mesure de traitement social du surendettement locatif.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale conditionne la recevabilit\u00e9 de la demande.<\/p>\n<p>Le juge v\u00e9rifie scrupuleusement le respect des formalit\u00e9s protectrices pr\u00e9vues par la loi. La notification de l&#8217;assignation au repr\u00e9sentant de l&#8217;\u00c9tat dans le d\u00e9partement est une condition de recevabilit\u00e9 imp\u00e9rative. &#8220;une copie de l&#8217;assignation aux fins de constat de la r\u00e9siliation du bail a \u00e9t\u00e9 notifi\u00e9e au repr\u00e9sentant de l&#8217;Etat dans le d\u00e9partement le 27 novembre 2024, soit au moins six semaines avant l&#8217;audience&#8221; (Motifs). La saisine pr\u00e9alable de la commission de coordination des actions de pr\u00e9vention est \u00e9galement contr\u00f4l\u00e9e. Cette exigence garantit une tentative de conciliation avant toute action judiciaire. Le formalisme strict prot\u00e8ge le locataire contre une expulsion pr\u00e9cipit\u00e9. Il rappelle le caract\u00e8re d&#8217;ordre public de ces r\u00e8gles proc\u00e9durales protectrices.<\/p>\n<p>Le juge op\u00e8re un contr\u00f4le substantiel des conditions de mise en \u0153uvre de la clause r\u00e9solutoire.<\/p>\n<p>L&#8217;existence d&#8217;une clause r\u00e9solutoire dans le contrat de bail est une obligation l\u00e9gale. &#8220;tout contrat de bail d&#8217;habitation contient une clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement du loyer ou des charges aux termes convenus&#8221; (Motifs). Son acquisition est subordonn\u00e9e \u00e0 un commandement de payer demeur\u00e9 sans effet pendant un d\u00e9lai l\u00e9gal. Le juge v\u00e9rifie la validit\u00e9 de ce commandement et l&#8217;absence de paiement dans le d\u00e9lai imparti. Il constate ensuite l&#8217;acquisition de la clause \u00e0 la date l\u00e9gale, produisant la r\u00e9siliation du bail. Cette approche rappelle que la clause, bien que de plein droit, n\u00e9cessite une intervention judiciaire pour \u00eatre constat\u00e9e. Elle assure une s\u00e9curit\u00e9 juridique tant pour le bailleur que pour le locataire.<\/p>\n<p>La suspension des effets de la clause r\u00e9solutoire illustre le pouvoir d&#8217;adaptation du juge.<\/p>\n<p>Face \u00e0 une situation de d\u00e9faut de paiement, le juge dispose d&#8217;une facult\u00e9 d&#8217;am\u00e9nagement. Il peut accorder des d\u00e9lais de paiement sous conditions strictes. &#8220;\u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu\u2019il ait repris le versement int\u00e9gral du loyer courant avant la date de l\u2019audience&#8221; (Motifs). En l&#8217;esp\u00e8ce, le juge use de ce pouvoir car les locataires ont recommenc\u00e9 \u00e0 payer. Il suspend alors les effets de la clause r\u00e9solutoire pendant la dur\u00e9e de l&#8217;\u00e9chelonnement. Cette suspension est une mesure de faveur qui vise \u00e0 pr\u00e9server le maintien dans les lieux. Elle t\u00e9moigne de la conciliation entre le droit du cr\u00e9ancier et la protection du d\u00e9biteur. Le juge devient ainsi le r\u00e9gulateur des cons\u00e9quences de l&#8217;inex\u00e9cution.<\/p>\n<p>Le dispositif de l&#8217;arr\u00eat organise un \u00e9quilibre pr\u00e9caire entre sanction et soutien.<\/p>\n<p>La d\u00e9cision est profond\u00e9ment biface, m\u00ealant condamnation et mesures d&#8217;accompagnement. Elle condamne solidairement les locataires au paiement des sommes dues. Elle constate simultan\u00e9ment la r\u00e9siliation du bail pour l&#8217;avenir. Mais elle suspend cet effet sous condition du respect d&#8217;un \u00e9chelonnement strict. &#8220;si les d\u00e9lais accord\u00e9s sont enti\u00e8rement respect\u00e9s, la clause r\u00e9solutoire sera r\u00e9put\u00e9e n\u2019avoir jamais \u00e9t\u00e9 acquise&#8221; (Dispositif). En cas de nouvel impay\u00e9, le m\u00e9canisme protecteur s&#8217;efface et la r\u00e9siliation reprend pleinement effet. L&#8217;expulsion devient alors possible avec le concours de la force publique. Ce syst\u00e8me incitatif place le locataire au centre d&#8217;un dispositif \u00e0 double d\u00e9tente.
