Apr\u00e8s une proc\u00e9dure respectant les formalit\u00e9s requises, le juge a constat\u00e9 l&#8217;acquisition de la clause r\u00e9solutoire et ordonn\u00e9 l&#8217;expulsion des locataires. Il a \u00e9galement fix\u00e9 le montant de l&#8217;arri\u00e9r\u00e9 et accord\u00e9 des d\u00e9lais de paiement, tout en rejetant la demande d&#8217;astreinte.<\/p>\n<p>L&#8217;application temporelle de la loi r\u00e9formatrice<\/p>\n<p>Le juge op\u00e8re un examen minutieux de l&#8217;application dans le temps de la loi du 27 juillet 2023. Il distingue les dispositions proc\u00e9durales de celles affectant les droits substantiels. Les modifications des d\u00e9lais de paiement post\u00e9rieurs au commandement ne s&#8217;appliquent pas, ce dernier \u00e9tant ant\u00e9rieur \u00e0 la publication de la loi. &#8220;Or, le commandement de payer ayant \u00e9t\u00e9 d\u00e9livr\u00e9 avant le 29 juillet 2023, date de publication de la loi n\u00b086-1290 du 27 juillet 2023 au journal officiel, la disposition pr\u00e9cit\u00e9e relative \u00e0 la diminution du d\u00e9lai de r\u00e8glement de la dette suivant la d\u00e9livrance du commandement de payer ne peut recevoir application&#8221; (III. SUR LES TEXTES APPLICABLES). Cette solution respecte le principe de non-r\u00e9troactivit\u00e9 des lois, prot\u00e9geant la s\u00e9curit\u00e9 juridique des parties. En revanche, les r\u00e8gles de proc\u00e9dure applicables au jour de l&#8217;audience, comme la notification \u00e0 la pr\u00e9fecture, sont soumises au nouveau droit. Cette distinction classique assure une transition l\u00e9gislative \u00e9quitable entre l&#8217;ancien et le nouveau r\u00e9gime.<\/p>\n<p>Les conditions strictes du b\u00e9n\u00e9fice des d\u00e9lais de paiement<\/p>\n<p>La d\u00e9cision applique rigoureusement les nouvelles conditions pos\u00e9es par la loi de 2023 pour suspendre la clause r\u00e9solutoire. Le juge rappelle que ce b\u00e9n\u00e9fice est subordonn\u00e9 \u00e0 la reprise du paiement int\u00e9gral du loyer courant avant l&#8217;audience. L&#8217;examen des faits r\u00e9v\u00e8le l&#8217;absence de cette condition essentielle. &#8220;En l&#8217;esp\u00e8ce, il r\u00e9sulte du d\u00e9compte produit par le bailleur \u00e0 l\u2019audience que les locataires ont effectu\u00e9 un virement de 500 euros le 6 juin 2025 pour un loyer de 703,56 euros&#8221; (III. SUR L\u2019ACQUISITION DE LA CLAUSE RESOLUTOIRE). Le versement partiel d\u00e9montre l&#8217;inex\u00e9cution de l&#8217;obligation fondamentale de paiement du loyer. Les locataires reconnaissent par ailleurs leur incapacit\u00e9 \u00e0 apurer la dette mensuellement. Le juge ne peut donc accorder les d\u00e9lais de paiement sollicit\u00e9s, la loi conditionnant d\u00e9sormais strictement cette faveur. Cette application stricte vise \u00e0 pr\u00e9venir les abus et \u00e0 garantir la solvabilit\u00e9 du parc locatif social.<\/p>\n<p>La cons\u00e9cration de l&#8217;acquisition de la clause r\u00e9solutoire<\/p>\n<p>Le juge constate la r\u00e9gularit\u00e9 de l&#8217;acquisition de la clause r\u00e9solutoire selon l&#8217;ancien droit applicable. Le commandement de payer, demeur\u00e9 infructueux pendant plus de deux mois, a produit ses effets l\u00e9gaux. &#8220;Ce commandement est demeur\u00e9 infructueux pendant plus de deux mois, de sorte qu\u2019il y a lieu de constater que les conditions d\u2019acquisition de la clause r\u00e9solutoire contenue dans le bail \u00e9taient r\u00e9unies \u00e0 la date du 31 janvier 2022&#8221; (III. SUR L\u2019ACQUISITION DE LA CLAUSE RESOLUTOIRE). Cette situation rappelle une jurisprudence constante sur l&#8217;effet automatique de la clause apr\u00e8s l&#8217;inex\u00e9cution du commandement. &#8220;Il est constant que le commandement de payer est demeur\u00e9 infructueux de sorte que la clause r\u00e9solutoire s\u2019est trouv\u00e9e acquise&#8221; (Tribunal judiciaire de Nancy, le 28 janvier 2025, n\u00b024\/00500). La r\u00e9siliation du bail est donc act\u00e9e, transformant les locataires en occupants sans titre. Cette d\u00e9cision met fin \u00e0 un contrat gravement perturb\u00e9 par des impay\u00e9s r\u00e9p\u00e9t\u00e9s, justifiant la protection du bailleur.<\/p>\n<p>La modulation des mesures d&#8217;ex\u00e9cution et de recouvrement<\/p>\n<p>Le juge op\u00e8re une conciliation entre l&#8217;expulsion in\u00e9luctable et la situation pr\u00e9caire des locataires. L&#8217;expulsion est ordonn\u00e9e avec le concours possible de la force publique, mais l&#8217;astreinte est refus\u00e9e comme contrainte superflue. Parall\u00e8lement, le recouvrement de l&#8217;arri\u00e9r\u00e9 fait l&#8217;objet d&#8217;un am\u00e9nagement notable. Compte tenu de la pr\u00e9carit\u00e9 des revenus des d\u00e9biteurs, le juge use de son pouvoir d&#8217;\u00e9chelonnement. &#8220;Ils seront autoris\u00e9s \u00e0 se lib\u00e9rer du montant de la dette selon les modalit\u00e9s qui seront rappel\u00e9es au dispositif&#8221; (V. SUR LES DELAIS DE PAIEMENT). Un plan de vingt-quatre mensualit\u00e9s est ainsi impos\u00e9, avec une clause d&#8217;exigibilit\u00e9 acc\u00e9l\u00e9r\u00e9e en cas de d\u00e9faillance. Cette solution \u00e9quilibr\u00e9e permet l&#8217;ex\u00e9cution de la d\u00e9cision tout en tenant compte de la situation personnelle des condamn\u00e9s.
