Un organisme public du logement a engag\u00e9 une action en r\u00e9siliation de bail pour impay\u00e9s de loyers. La juridiction a examin\u00e9 la recevabilit\u00e9 de la demande et le bien-fond\u00e9 des conclusions. Elle a d\u00e9clar\u00e9 l&#8217;action recevable et a constat\u00e9 la r\u00e9siliation du bail tout en accordant des d\u00e9lais de paiement. Cette solution illustre l&#8217;articulation complexe entre la protection du locataire et les droits du bailleur.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n<p>Le respect des conditions pr\u00e9alables \u00e0 l&#8217;assignation est strictement encadr\u00e9. La loi impose au bailleur de saisir la commission de pr\u00e9vention des expulsions avant toute action. &#8220;Cette saisine est r\u00e9put\u00e9e constitu\u00e9e d\u00e8s lors que persiste une situation d&#8217;impay\u00e9s pr\u00e9alablement signal\u00e9e dans les conditions r\u00e9glementaires aux organismes payeurs des aides au logement&#8221; (Motifs de la d\u00e9cision). La d\u00e9cision valide ainsi une saisine par courrier recommand\u00e9, confirmant la flexibilit\u00e9 des modalit\u00e9s de saisine. Elle rappelle \u00e9galement l&#8217;obligation de notification de l&#8217;assignation au pr\u00e9fet six semaines avant l&#8217;audience. Cette double condition garantit une intervention sociale pr\u00e9alable tout en s\u00e9curisant la proc\u00e9dure pour le bailleur.<\/p>\n<p>L&#8217;application temporelle des nouvelles r\u00e8gles sur la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a><\/p>\n<p>Le juge a d\u00fb trancher le conflit entre l&#8217;ancien et le nouveau droit concernant le d\u00e9lai de la clause. Le bail contenait une clause pr\u00e9voyant une r\u00e9siliation deux mois apr\u00e8s un <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> infructueux. La loi du 27 juillet 2023 a r\u00e9duit ce d\u00e9lai \u00e0 six semaines. Le juge a refus\u00e9 d&#8217;appliquer r\u00e9troactivement la nouvelle loi aux contrats en cours. &#8220;La loi du 27 juillet 2023 ne comprend pas de disposition d\u00e9rogeant \u00e0 l&#8217;article 2 du code civil, selon lequel la loi ne dispose que pour l&#8217;avenir&#8221; (Motifs de la d\u00e9cision). La solution pr\u00e9serve ainsi la s\u00e9curit\u00e9 juridique et les droits acquis des parties au contrat. Elle s&#8217;oppose \u00e0 une interpr\u00e9tation imm\u00e9diate de la r\u00e9forme, contrairement \u00e0 une autre jurisprudence. &#8220;Or, le contrat ayant \u00e9t\u00e9 reconduit apr\u00e8s l\u2019entr\u00e9e en vigueur de la loi du 27 juillet 2023, il convient de faire application des modalit\u00e9s de mise en \u0153uvre de la clause r\u00e9solutoire \u00e0 la date de la signification&#8221; (Tribunal judiciaire de Bobigny, le 6 novembre 2025, n\u00b025\/02444). La port\u00e9e de la d\u00e9cision comment\u00e9e est donc de fixer le point de d\u00e9part de la r\u00e9forme au renouvellement du contrat.<\/p>\n<p>L&#8217;am\u00e9nagement judiciaire des cons\u00e9quences de la r\u00e9siliation<\/p>\n<p>Le juge use de son pouvoir d&#8217;octroyer des d\u00e9lais de paiement pour suspendre l&#8217;expulsion. La loi autorise cette mesure si le locataire a repris le paiement du loyer courant. &#8220;Le juge peut, \u00e0 la demande du locataire, du bailleur ou d&#8217;office, \u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu&#8217;il ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience, accorder des d\u00e9lais de paiement&#8221; (Motifs de la d\u00e9cision). En l&#8217;esp\u00e8ce, une proposition de mensualisation accept\u00e9e par les deux parties a \u00e9t\u00e9 homologu\u00e9e. Cette conciliation permet d&#8217;\u00e9viter une expulsion tout en garantissant le recouvrement de la cr\u00e9ance. Le juge organise un dispositif incitatif et s\u00e9curis\u00e9 pour l&#8217;apurement de la dette.<\/p>\n<p>La suspension conditionnelle des effets de la clause r\u00e9solutoire<\/p>\n<p>L&#8217;octroi de d\u00e9lais de paiement entra\u00eene la suspension temporaire de la r\u00e9siliation d\u00e9j\u00e0 acquise. &#8220;Les effets de la clause de r\u00e9siliation de plein droit peuvent \u00eatre suspendus pendant le cours des d\u00e9lais accord\u00e9s par le juge&#8221; (Motifs de la d\u00e9cision). Cette suspension est r\u00e9versible et cesse au premier manquement \u00e0 l&#8217;\u00e9ch\u00e9ancier. Le juge pr\u00e9voit alors la reprise des effets de la clause et l&#8217;expulsion acc\u00e9l\u00e9r\u00e9e. Ce m\u00e9canisme place le locataire dans une situation probatoire o\u00f9 son comportement futur d\u00e9termine son maintien dans les lieux. La valeur de cette mesure est de transformer une r\u00e9siliation d\u00e9finitive en une simple menace, incitant au paiement.
