Pour le salari\u00e9, le premier enjeu pratique est souvent plus imm\u00e9diat : combien doit \u00eatre pay\u00e9, \u00e0 quelle date, avec ou sans pr\u00e9avis, et que devient le contrat de s\u00e9curisation professionnelle si l&#8217;employeur pr\u00e9sente un calcul trop rapide.<\/p>\n<p>La recherche Google Ads confirme l&#8217;intention : la famille <code>indemnit\u00e9 licenciement \u00e9conomique<\/code>, <code>licenciement \u00e9conomique indemnit\u00e9s<\/code> et <code>indemnisation pour licenciement \u00e9conomique<\/code> repr\u00e9sente environ 6 600 recherches mensuelles en France. Les variantes <code>calcul indemnit\u00e9 licenciement \u00e9conomique<\/code>, <code>licenciement \u00e9conomique pr\u00e9avis<\/code>, <code>tableau indemnit\u00e9 de licenciement \u00e9conomique<\/code>, <code>solde de tout compte licenciement \u00e9conomique<\/code> montrent que l&#8217;utilisateur ne cherche pas une d\u00e9finition abstraite. Il cherche un ordre de grandeur, une m\u00e9thode et un contr\u00f4le des erreurs.<\/p>\n<p>Cet article sert de grille de v\u00e9rification. Il ne remplace pas le calcul complet sur bulletins de paie, convention collective et anciennet\u00e9 exacte, mais il permet d&#8217;identifier les lignes qui doivent \u00eatre pr\u00e9sentes avant de signer le solde de tout compte ou d&#8217;accepter le raisonnement de l&#8217;employeur.<\/p>\n<h2>Le socle l\u00e9gal : CDI, anciennet\u00e9 et absence de faute grave<\/h2>\n<p>Le droit \u00e0 l&#8217;indemnit\u00e9 l\u00e9gale de licenciement est pos\u00e9 par l&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035644154\">L. 1234-9 du Code du travail<\/a>. Le salari\u00e9 en CDI, licenci\u00e9 avec au moins huit mois d&#8217;anciennet\u00e9 ininterrompue chez le m\u00eame employeur, y a droit, sauf faute grave. Le licenciement \u00e9conomique n&#8217;est donc pas une cat\u00e9gorie \u00e0 part sur le principe : il ouvre droit \u00e0 l&#8217;indemnit\u00e9 l\u00e9gale, ou \u00e0 une indemnit\u00e9 conventionnelle si celle-ci est plus favorable.<\/p>\n<p>Le montant minimal est fix\u00e9 par l&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035644692\">R. 1234-2 du Code du travail<\/a> : un quart de mois de salaire par ann\u00e9e d&#8217;anciennet\u00e9 jusqu&#8217;\u00e0 dix ans, puis un tiers de mois par ann\u00e9e au-del\u00e0 de dix ans. Les ann\u00e9es incompl\u00e8tes se calculent au prorata des mois complets.<\/p>\n<p>En pratique, il faut donc v\u00e9rifier trois choses avant toute discussion sur le total :<\/p>\n<ul>\n<li>la date d&#8217;entr\u00e9e et la date retenue pour la fin du contrat ;<\/li>\n<li>le salaire de r\u00e9f\u00e9rence utilis\u00e9 ;<\/li>\n<li>la convention collective, qui peut pr\u00e9voir mieux que le minimum l\u00e9gal.<\/li>\n<\/ul>\n<h2>La formule de calcul \u00e0 contr\u00f4ler<\/h2>\n<p>La formule simple est la suivante. Jusqu&#8217;\u00e0 dix ans d&#8217;anciennet\u00e9, l&#8217;indemnit\u00e9 minimale correspond \u00e0 <code>1\/4 de mois de salaire x nombre d'ann\u00e9es<\/code>. Au-del\u00e0 de dix ans, il faut ajouter <code>1\/3 de mois de salaire x nombre d'ann\u00e9es au-del\u00e0 de dix ans<\/code>.<\/p>\n<p>Exemple : un salari\u00e9 ayant 12 ans d&#8217;anciennet\u00e9 et un salaire de r\u00e9f\u00e9rence de 2 800 euros bruts aura, au minimum, droit \u00e0 :<\/p>\n<ul>\n<li>10 ann\u00e9es x 1\/4 x 2 800 euros = 7 000 euros ;<\/li>\n<li>2 ann\u00e9es x 1\/3 x 2 800 euros = 1 866,66 euros ;<\/li>\n<li>total minimal : 8 866,66 euros.<\/li>\n<\/ul>\n<p>Ce calcul ne r\u00e8gle pas tout. Il faut encore regarder si le contrat, l&#8217;usage, un accord d&#8217;entreprise ou la convention collective donnent un montant plus favorable. Dans certains secteurs, l&#8217;\u00e9cart peut \u00eatre important, notamment pour les cadres ou les salari\u00e9s ayant une forte anciennet\u00e9.<\/p>\n<p>La jurisprudence sociale v\u00e9rifi\u00e9e via Voyage rappelle que les juges reviennent aux articles L. 1234-9, R. 1234-1 et suivants pour recalculer l&#8217;indemnit\u00e9 lorsque le salaire moyen ou l&#8217;anciennet\u00e9 ont \u00e9t\u00e9 mal retenus. Une d\u00e9cision de la cour d&#8217;appel de Lyon du 17 d\u00e9cembre 2025 illustre ce contr\u00f4le : la cour reprend le salaire moyen et l&#8217;anciennet\u00e9 exacte pour fixer une indemnit\u00e9 l\u00e9gale diff\u00e9rente de celle retenue initialement.<\/p>\n<h2>Le salaire de r\u00e9f\u00e9rence : l&#8217;erreur la plus fr\u00e9quente<\/h2>\n<p>Le salaire de r\u00e9f\u00e9rence n&#8217;est pas toujours le dernier salaire brut. L&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035644703\">R. 1234-4 du Code du travail<\/a> impose de retenir la formule la plus avantageuse entre la moyenne mensuelle des douze derniers mois pr\u00e9c\u00e9dant le licenciement et le tiers des trois derniers mois. Les primes annuelles ou exceptionnelles doivent \u00eatre int\u00e9gr\u00e9es au prorata quand elles entrent dans la r\u00e9mun\u00e9ration de r\u00e9f\u00e9rence.<\/p>\n<p>Plusieurs erreurs reviennent en pratique :<\/p>\n<ul>\n<li>l&#8217;employeur prend seulement le dernier mois, alors qu&#8217;il est plus bas que la moyenne ;<\/li>\n<li>une prime annuelle est oubli\u00e9e ;<\/li>\n<li>une p\u00e9riode d&#8217;activit\u00e9 partielle, d&#8217;arr\u00eat ou de temps partiel th\u00e9rapeutique est utilis\u00e9e sans reconstitution s\u00e9rieuse ;<\/li>\n<li>les variables, commissions ou primes d&#8217;objectif ne sont pas int\u00e9gr\u00e9es ;<\/li>\n<li>le solde de tout compte confond indemnit\u00e9 l\u00e9gale, indemnit\u00e9 de pr\u00e9avis et cong\u00e9s pay\u00e9s.<\/li>\n<\/ul>\n<p>Le salari\u00e9 doit donc r\u00e9unir au minimum les douze derniers bulletins de paie, le contrat, les avenants, la convention collective applicable, les courriers de licenciement \u00e9conomique, le document CSP si propos\u00e9, et le solde de tout compte.<\/p>\n<h2>Pr\u00e9avis : pay\u00e9, ex\u00e9cut\u00e9 ou absorb\u00e9 par le CSP<\/h2>\n<p>Le pr\u00e9avis d\u00e9pend de l&#8217;anciennet\u00e9, du statut et de la convention collective. Dans un licenciement \u00e9conomique classique, si l&#8217;employeur dispense le salari\u00e9 d&#8217;ex\u00e9cuter son pr\u00e9avis, l&#8217;indemnit\u00e9 compensatrice de pr\u00e9avis doit \u00eatre pay\u00e9e, avec les cong\u00e9s pay\u00e9s aff\u00e9rents. La page officielle Service-Public sur les indemnit\u00e9s du licenciement \u00e9conomique distingue clairement l&#8217;indemnit\u00e9 de licenciement, le pr\u00e9avis et les cong\u00e9s pay\u00e9s.<\/p>\n<p>Le CSP change la m\u00e9canique. L&#8217;article <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000024422260\/2011-07-30\">L. 1233-67 du Code du travail<\/a> pr\u00e9voit que l&#8217;acceptation du contrat de s\u00e9curisation professionnelle entra\u00eene une rupture sans pr\u00e9avis ni indemnit\u00e9 compensatrice de pr\u00e9avis, sauf situations particuli\u00e8res li\u00e9es notamment au solde de ce qu&#8217;aurait \u00e9t\u00e9 le pr\u00e9avis. Une partie correspondant au pr\u00e9avis est en principe vers\u00e9e \u00e0 France Travail pour financer le dispositif.<\/p>\n<p>Cela cr\u00e9e beaucoup d&#8217;incompr\u00e9hensions. Accepter le CSP ne supprime pas l&#8217;indemnit\u00e9 l\u00e9gale ou conventionnelle de licenciement. En revanche, cela modifie la mani\u00e8re dont le pr\u00e9avis est trait\u00e9. Il faut donc faire deux colonnes : ce qui reste pay\u00e9 au salari\u00e9, et ce qui est affect\u00e9 au dispositif CSP.<\/p>\n<h2>Solde de tout compte : les lignes \u00e0 retrouver<\/h2>\n<p>Le solde de tout compte doit \u00eatre lisible. Un document trop global, avec une ligne unique <code>indemnit\u00e9s diverses<\/code>, ne permet pas un contr\u00f4le s\u00e9rieux. Pour un licenciement \u00e9conomique, les lignes attendues peuvent notamment \u00eatre :<\/p>\n<ul>\n<li>salaire du dernier mois ;<\/li>\n<li>indemnit\u00e9 l\u00e9gale ou conventionnelle de licenciement ;<\/li>\n<li>indemnit\u00e9 compensatrice de pr\u00e9avis si elle est due ;<\/li>\n<li>cong\u00e9s pay\u00e9s acquis et non pris ;<\/li>\n<li>cong\u00e9s pay\u00e9s sur pr\u00e9avis si le pr\u00e9avis est indemnis\u00e9 ;<\/li>\n<li>primes dues au prorata ;<\/li>\n<li><a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-heures-supplementaires-paris\/\" target=\"_blank\" title=\"rappel de salaire\">rappel de salaire<\/a> ou variable restant d\u00fb ;<\/li>\n<li>\u00e9ventuelle indemnit\u00e9 supra-l\u00e9gale pr\u00e9vue par un accord, un <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-restructuration-pse-paris\/\" target=\"_blank\" title=\"PSE\">PSE<\/a> ou une n\u00e9gociation individuelle.<\/li>\n<\/ul>\n<p>Signer le re\u00e7u pour solde de tout compte n&#8217;interdit pas toute action, mais la d\u00e9nonciation doit \u00eatre trait\u00e9e rapidement. La strat\u00e9gie d\u00e9pend du poste contest\u00e9 : erreur de calcul, convention collective ignor\u00e9e, pr\u00e9avis mal trait\u00e9, CSP mal expliqu\u00e9, anciennet\u00e9 tronqu\u00e9e, ou motif \u00e9conomique lui-m\u00eame contestable.<\/p>\n<h2>Et si le licenciement \u00e9conomique est contest\u00e9 ?<\/h2>\n<p>Le calcul des indemnit\u00e9s de rupture ne remplace pas l&#8217;analyse du motif \u00e9conomique. Il faut distinguer deux \u00e9tages. D&#8217;abord, les sommes automatiquement dues si le licenciement \u00e9conomique est notifi\u00e9. Ensuite, les demandes contentieuses si le licenciement est irr\u00e9gulier ou sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p>Le salari\u00e9 peut donc r\u00e9clamer \u00e0 la fois un compl\u00e9ment d&#8217;indemnit\u00e9 de licenciement et des dommages-int\u00e9r\u00eats si le motif \u00e9conomique, le reclassement, les crit\u00e8res d&#8217;ordre ou la proc\u00e9dure sont contestables. Pour ce second \u00e9tage, le dossier doit \u00eatre reli\u00e9 au contentieux du licenciement \u00e9conomique, notamment la page du cabinet sur le <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-licenciement-economique-paris\/\">licenciement \u00e9conomique \u00e0 Paris<\/a>.<\/p>\n<p>Le d\u00e9lai de contestation du licenciement est court. La prudence consiste \u00e0 ne pas attendre la fin du CSP ou la stabilisation avec France Travail pour faire v\u00e9rifier le dossier. Les pi\u00e8ces financi\u00e8res se r\u00e9cup\u00e8rent tout de suite, pendant que les \u00e9changes avec l&#8217;employeur sont encore accessibles.<\/p>\n<h2>Comment construire un contr\u00f4le utile avant d&#8217;agir<\/h2>\n<p>La m\u00e9thode la plus efficace tient en cinq \u00e9tapes.<\/p>\n<ol>\n<li>Reconstituer l&#8217;anciennet\u00e9 : date d&#8217;entr\u00e9e, p\u00e9riodes de suspension, pr\u00e9avis th\u00e9orique, date de rupture effective.<\/li>\n<li>Calculer deux salaires de r\u00e9f\u00e9rence : douze derniers mois et trois derniers mois, avec les primes.<\/li>\n<li>Comparer l\u00e9gal, conventionnel et \u00e9ventuel accord collectif.<\/li>\n<li>S\u00e9parer indemnit\u00e9 de licenciement, pr\u00e9avis, cong\u00e9s pay\u00e9s et primes.<\/li>\n<li>V\u00e9rifier si le CSP, le cong\u00e9 de reclassement ou un PSE modifie la ventilation.<\/li>\n<\/ol>\n<p>Cette approche donne un tableau simple : montant vers\u00e9, montant qui aurait d\u00fb \u00eatre vers\u00e9, pi\u00e8ce justificative, fondement juridique, action possible. Elle \u00e9vite de lancer une proc\u00e9dure pour une intuition vague et permet de cibler la contestation.<\/p>\n<h2>Le delta par rapport aux contenus concurrents<\/h2>\n<p>Le benchmark r\u00e9alis\u00e9 sur Service-Public, LegalPlace et PayFit montre que les contenus concurrents expliquent correctement les grands principes, mais traitent moins directement le sc\u00e9nario de crise : salari\u00e9 qui re\u00e7oit un solde de tout compte, ne comprend pas l&#8217;effet du CSP, soup\u00e7onne une erreur de salaire de r\u00e9f\u00e9rence et doit d\u00e9cider s&#8217;il conteste vite.
