Le locataire a envoy\u00e9 son cong\u00e9, puis son projet tombe : nouveau logement refus\u00e9, cr\u00e9dit bloqu\u00e9, s\u00e9paration suspendue, mutation annul\u00e9e, logement de remplacement indisponible. Il veut rester. Le bailleur ou l&#8217;agence r\u00e9pond que le pr\u00e9avis est parti et que le logement va \u00eatre relou\u00e9.<\/p>\n<p>La r\u00e9ponse juridique est sobre : le locataire ne peut pas annuler seul un cong\u00e9 d\u00e9j\u00e0 re\u00e7u par le bailleur. Il doit obtenir un accord \u00e9crit. La difficult\u00e9 francilienne tient au rythme de relocation. \u00c0 Paris, Boulogne-Billancourt, Montreuil, Saint-Denis, Cr\u00e9teil, Nanterre, Versailles ou Cergy, un bailleur peut remettre le logement sur le march\u00e9 tr\u00e8s vite. Le locataire ne doit pas seulement pr\u00e9venir qu&#8217;il souhaite rester. Il doit demander l&#8217;accord du bailleur. La nuance est importante.<\/p>\n<p>Un message disant &#8220;j&#8217;annule mon pr\u00e9avis&#8221; ne suffit pas. Le bailleur peut r\u00e9pondre qu&#8217;il n&#8217;a jamais accept\u00e9 cette annulation. La formulation utile est la suivante : le locataire sollicite l&#8217;accord expr\u00e8s du bailleur pour r\u00e9tracter le cong\u00e9 d\u00e9j\u00e0 donn\u00e9 et poursuivre le bail. La r\u00e9ponse attendue doit \u00eatre claire.<\/p>\n<p>Lorsque l&#8217;agence g\u00e8re le bien, l&#8217;accord doit venir de la personne qui a mandat pour engager le bailleur. Dans certains dossiers, l&#8217;agence r\u00e9pond vite mais de mani\u00e8re incompl\u00e8te. Elle \u00e9crit par exemple : &#8220;nous revenons vers vous&#8221;, &#8220;nous voyons avec le propri\u00e9taire&#8221;, ou &#8220;nous avons bien not\u00e9 votre demande&#8221;. Ce n&#8217;est pas une acceptation.<\/p>\n<h2>Paris et zone tendue : ne pas confondre pr\u00e9avis r\u00e9duit et r\u00e9tractation<\/h2>\n<p>Paris et une grande partie de l&#8217;\u00cele-de-France rel\u00e8vent de zones o\u00f9 le d\u00e9lai de pr\u00e9avis du locataire peut \u00eatre r\u00e9duit \u00e0 un mois dans les conditions pr\u00e9vues par la loi. Beaucoup de conflits viennent d&#8217;une confusion.<\/p>\n<p>Le pr\u00e9avis r\u00e9duit concerne la dur\u00e9e du d\u00e9lai. La r\u00e9tractation concerne la d\u00e9cision de quitter le logement. Un locataire peut avoir droit \u00e0 un pr\u00e9avis d&#8217;un mois, mais cela ne lui donne pas le droit d&#8217;effacer un cong\u00e9 d\u00e9j\u00e0 donn\u00e9 sans accord du bailleur.<\/p>\n<p>Exemple. Un locataire parisien envoie une lettre de cong\u00e9 en indiquant trois mois. Deux semaines plus tard, il comprend qu&#8217;il pouvait invoquer la zone tendue. Il peut discuter la dur\u00e9e du pr\u00e9avis. Mais s&#8217;il veut finalement rester, il doit demander une acceptation de maintien dans les lieux. Ce sont deux demandes diff\u00e9rentes.<\/p>\n<h2>Quel tribunal en cas de conflit en \u00cele-de-France ?<\/h2>\n<p>Les litiges n\u00e9s d&#8217;un bail d&#8217;habitation rel\u00e8vent en principe du juge des contentieux de la protection. En \u00cele-de-France, le tribunal comp\u00e9tent d\u00e9pend du lieu de situation du logement.<\/p>\n<p>Pour un logement \u00e0 Paris, le dossier rel\u00e8ve du tribunal judiciaire de Paris, avec le juge des contentieux de la protection comp\u00e9tent pour les litiges locatifs. Pour un logement \u00e0 Bobigny ou Saint-Denis, on raisonne dans le ressort de la Seine-Saint-Denis. Pour Cr\u00e9teil, dans le Val-de-Marne. Pour Nanterre, dans les Hauts-de-Seine. Pour Versailles, dans les Yvelines. Pour Pontoise, dans le Val-d&#8217;Oise. Pour \u00c9vry-Courcouronnes, dans l&#8217;Essonne. Pour Meaux, Melun ou Fontainebleau, en Seine-et-Marne selon la commune.<\/p>\n<p>L&#8217;int\u00e9r\u00eat de cette v\u00e9rification est pratique. Si le bailleur menace d&#8217;une proc\u00e9dure, si une assignation est d\u00e9livr\u00e9e, ou si le locataire veut saisir le juge, la juridiction se d\u00e9termine \u00e0 partir du logement, pas \u00e0 partir du domicile actuel du bailleur.<\/p>\n<h2>Quelles pi\u00e8ces pr\u00e9parer avant d&#8217;appeler un avocat<\/h2>\n<p>Le cabinet demandera d&#8217;abord les documents suivants : bail sign\u00e9, cong\u00e9 envoy\u00e9, preuve de r\u00e9ception, \u00e9changes avec l&#8217;agence, r\u00e9ponse du bailleur, justificatifs du motif de maintien dans les lieux, quittances, paiements r\u00e9cents, annonce \u00e9ventuelle de relocation, convocation \u00e0 l&#8217;\u00e9tat des lieux, messages sur la remise des cl\u00e9s.<\/p>\n<p>Il faut aussi pr\u00e9parer une chronologie courte. Date d&#8217;envoi du cong\u00e9. Date de r\u00e9ception. Date annonc\u00e9e de d\u00e9part. Date de la demande de r\u00e9tractation. R\u00e9ponse de l&#8217;agence. R\u00e9ponse du bailleur. \u00c9ventuelle date d&#8217;entr\u00e9e du nouveau locataire. Date pr\u00e9vue de remise des cl\u00e9s.<\/p>\n<p>Cette chronologie permet de savoir si le dossier se traite encore par n\u00e9gociation, par mise au point \u00e9crite ou par strat\u00e9gie contentieuse.<\/p>\n<h2>Le bailleur a d\u00e9j\u00e0 trouv\u00e9 un nouveau locataire<\/h2>\n<p>C&#8217;est le cas le plus sensible en \u00cele-de-France. Le bailleur peut avoir sign\u00e9 un nouveau bail ou donn\u00e9 un accord \u00e0 un candidat. Le locataire sortant demande alors \u00e0 rester. Le bailleur craint de perdre le nouveau locataire ou d&#8217;\u00eatre expos\u00e9 \u00e0 une demande indemnitaire.<\/p>\n<p>Dans cette situation, le locataire doit \u00e9viter toute position brutale. Il faut demander ce qui a \u00e9t\u00e9 sign\u00e9, proposer une solution \u00e9crite, et mesurer le risque financier. Le bailleur, de son c\u00f4t\u00e9, doit \u00e9viter les r\u00e9ponses ambigu\u00ebs. S&#8217;il refuse, il l&#8217;\u00e9crit. S&#8217;il accepte, il pr\u00e9cise les conditions.<\/p>\n<p>Un accord peut parfois \u00eatre trouv\u00e9 : maintien du bail, prise en charge de frais r\u00e9ellement expos\u00e9s, nouvelle date de d\u00e9part, ou signature d&#8217;un avenant. Mais cet accord doit \u00eatre formalis\u00e9. \u00c0 d\u00e9faut, chaque partie restera avec sa version.<\/p>\n<h2>Le locataire reste apr\u00e8s la date de fin du pr\u00e9avis<\/h2>\n<p>Si aucun accord n&#8217;a \u00e9t\u00e9 obtenu, le risque est l&#8217;occupation sans titre. Le bailleur peut r\u00e9clamer une indemnit\u00e9 d&#8217;occupation et demander la lib\u00e9ration du logement. Le locataire peut tenter de soutenir que le bail s&#8217;est poursuivi, mais il lui faudra des \u00e9l\u00e9ments.<\/p>\n<p>Les paiements post\u00e9rieurs \u00e0 la date de fin du pr\u00e9avis ne suffisent pas toujours. Tout d\u00e9pend de la mani\u00e8re dont ils ont \u00e9t\u00e9 accept\u00e9s, des \u00e9changes, des quittances, et du comportement du bailleur. Une quittance de loyer apr\u00e8s la date de fin peut aider le locataire. Une simple indemnit\u00e9 ou un paiement accept\u00e9 sous r\u00e9serve n&#8217;a pas la m\u00eame port\u00e9e.<\/p>\n<p>Ce point doit \u00eatre trait\u00e9 t\u00f4t. Attendre plusieurs semaines en esp\u00e9rant que la situation se r\u00e9gularise cr\u00e9e souvent une proc\u00e9dure plus co\u00fbteuse.<\/p>\n<h2>C\u00f4t\u00e9 bailleur : comment \u00e9viter l&#8217;acceptation implicite<\/h2>\n<p>Le bailleur qui refuse la r\u00e9tractation doit r\u00e9pondre clairement. Il rappelle la date du cong\u00e9, la date de fin du bail, le rendez-vous d&#8217;\u00e9tat des lieux et la remise des cl\u00e9s. S&#8217;il accepte des sommes apr\u00e8s cette date, il doit les qualifier prudemment.<\/p>\n<p>Il doit aussi conserver les preuves de relocation : annonce, visites, candidature retenue, promesse faite au nouveau locataire, \u00e9changes avec l&#8217;agence. Ces \u00e9l\u00e9ments peuvent expliquer pourquoi la r\u00e9tractation n&#8217;\u00e9tait plus acceptable.<\/p>\n<p>Si le bailleur accepte finalement que le locataire reste, il doit formaliser la continuation du bail. Le plus simple est un \u00e9crit sign\u00e9 ou un \u00e9change \u00e9lectronique non \u00e9quivoque. En pr\u00e9sence d&#8217;une agence, le mandat doit \u00eatre clair.<\/p>\n<h2>C\u00f4t\u00e9 locataire : comment s\u00e9curiser la demande<\/h2>\n<p>Le locataire doit agir avant la fin du pr\u00e9avis, de pr\u00e9f\u00e9rence d\u00e8s que son projet change. Il doit envoyer une demande \u00e9crite, garder la preuve d&#8217;envoi, relancer rapidement et \u00e9viter de rendre les cl\u00e9s tant que l&#8217;accord n&#8217;est pas clarifi\u00e9.<\/p>\n<p>Il doit aussi \u00e9viter d&#8217;affirmer des choses juridiquement fragiles. Dire que le pr\u00e9avis est &#8220;nul&#8221; ou &#8220;annul\u00e9 automatiquement&#8221; peut tendre inutilement le dossier. Il vaut mieux demander un accord, expliquer la situation et proposer une solution.<\/p>\n<p>Lorsque le bailleur refuse et que le maintien dans les lieux est in\u00e9vitable, il faut pr\u00e9parer une d\u00e9fense structur\u00e9e : situation personnelle, impossibilit\u00e9 de d\u00e9part, \u00e9changes montrant une n\u00e9gociation, paiements, absence de pr\u00e9judice ou \u00e9ventuelle acceptation du bailleur. Cette d\u00e9fense n&#8217;efface pas le risque, mais elle \u00e9vite un dossier d\u00e9sordonn\u00e9.<\/p>\n<h2>Delta par rapport aux contenus concurrents<\/h2>\n<p>Les contenus g\u00e9n\u00e9ralistes expliquent le pr\u00e9avis, ses formes et ses d\u00e9lais. En pratique, le d\u00e9bat sur la r\u00e9tractation se construit ensuite autour de l&#8217;accord du bailleur, de la preuve de cet accord et des cons\u00e9quences de la poursuite dans les lieux.<\/p>\n<p>Si le logement est meubl\u00e9, il faut v\u00e9rifier le r\u00e9gime applicable au bail meubl\u00e9 et la r\u00e9daction du contrat.
