Le litige porte sur des loyers impay\u00e9s, une mise en demeure visant la clause r\u00e9solutoire, puis la demande d\u2019expulsion assortie d\u2019un arri\u00e9r\u00e9 et d\u2019accessoires p\u00e9cuniaires. La juridiction rel\u00e8ve la r\u00e9gularit\u00e9 des formalit\u00e9s pr\u00e9alables et tranche la question de l\u2019effet de la clause en pr\u00e9sence d\u2019une proposition d\u2019apurement jug\u00e9e insuffisante.<\/p>\n<p>Les faits utiles tiennent \u00e0 un bail meubl\u00e9, d\u2019abord conclu dans un cadre de colocation, puis remplac\u00e9 par un contrat du 30 mars 2024, prenant effet au 1er juin 2024 pour un loyer de 650 euros. Des impay\u00e9s surviennent apr\u00e8s le d\u00e9part du colocataire. Un commandement visant la clause r\u00e9solutoire est d\u00e9livr\u00e9 le 17 octobre 2024. Une assignation suit, la personne locataire demeurant dans les lieux.<\/p>\n<p>La proc\u00e9dure r\u00e9v\u00e8le des positions tranch\u00e9es. Le bailleur sollicite la constatation de la clause r\u00e9solutoire, l\u2019expulsion, un arri\u00e9r\u00e9 arr\u00eat\u00e9 \u00e0 8 275 euros \u00e0 la date du 30 avril 2025, une indemnit\u00e9 d\u2019occupation au montant du loyer, ainsi que des sommes au titre des dommages et int\u00e9r\u00eats, de l\u2019article 700 et des d\u00e9pens. Le locataire reconna\u00eet la dette, propose un apurement de 50 euros mensuels en sus du loyer courant, et annonce son prochain d\u00e9part des lieux.<\/p>\n<p>La question de droit tient \u00e0 la r\u00e9union des conditions d\u2019acquisition de la clause r\u00e9solutoire au regard de l\u2019article 24 de la loi du 6 juillet 1989 et au r\u00f4le du juge dans l\u2019octroi \u00e9ventuel de d\u00e9lais. Elle appelle aussi l\u2019examen de la charge de la preuve des cr\u00e9ances invoqu\u00e9es et de la fixation d\u2019une indemnit\u00e9 d\u2019occupation post\u00e9rieurement \u00e0 la r\u00e9siliation. La juridiction constate que \u00ab le d\u00e9lai de deux mois entre l&#8217;acte d&#8217;assignation et la date d&#8217;audience [&#8230;] a bien \u00e9t\u00e9 respect\u00e9 \u00bb, retient l\u2019absence de r\u00e8glement int\u00e9gral \u00ab des loyers \u00bb et la faiblesse d\u2019un plan d\u2019apurement sans garantie. Elle en d\u00e9duit que \u00ab la r\u00e9siliation du bail ne peut \u00eatre que constat\u00e9e au 18 d\u00e9cembre 2024 \u00bb, ordonne la lib\u00e9ration des lieux, fixe l\u2019indemnit\u00e9 d\u2019occupation \u00e0 650 euros mensuels \u00e0 compter du 1er mai 2025, rejette les dommages et int\u00e9r\u00eats, et alloue 300 euros sur le fondement de l\u2019article 700.<\/p>\n<p>I \u2013 Le contr\u00f4le des conditions d\u2019acquisition de la clause r\u00e9solutoire<\/p>\n<p>A \u2013 La r\u00e9gularit\u00e9 des formalit\u00e9s pr\u00e9alables et la charge de la preuve<\/p>\n<p>La juridiction commence par cadrer la charge probatoire. Elle cite l\u2019article 1353 du code civil, rappel\u00e9 en ces termes: \u00ab Celui qui r\u00e9clame l\u2019ex\u00e9cution d\u2019une obligation doit la prouver. R\u00e9ciproquement, celui qui se pr\u00e9tend lib\u00e9r\u00e9, doit justifier le payement \u00bb. Ce rappel fonde l\u2019exigence de preuves crois\u00e9es, concernant d\u2019une part la cr\u00e9ance locative, d\u2019autre part l\u2019extinction all\u00e9gu\u00e9e.<\/p>\n<p>Le jugement v\u00e9rifie ensuite la r\u00e9gularit\u00e9 des formalit\u00e9s protectrices. Il rel\u00e8ve qu\u2019un commandement visant la clause r\u00e9solutoire a \u00e9t\u00e9 d\u00e9livr\u00e9, qu\u2019il reproduit les dispositions de l\u2019article 24 de la loi du 6 juillet 1989, et que la saisine de l\u2019autorit\u00e9 administrative a \u00e9t\u00e9 effectu\u00e9e. Il pr\u00e9cise que \u00ab le d\u00e9lai de deux mois [&#8230;] a bien \u00e9t\u00e9 respect\u00e9 \u00bb, ce qui conditionne l\u2019examen du jeu automatique de la clause. L\u2019office du juge se concentre alors sur l\u2019existence d\u2019impay\u00e9s persistants \u00e0 l\u2019expiration du d\u00e9lai et sur l\u2019absence de saisine utile aux fins d\u2019obtention de d\u00e9lais l\u00e9gaux.<\/p>\n<p>La motivation constate, de mani\u00e8re d\u00e9cisive, qu\u2019\u00ab il ressort des \u00e9l\u00e9ments vers\u00e9s aux d\u00e9bats que le locataire n\u2019a pas r\u00e9gl\u00e9 l&#8217;int\u00e9gralit\u00e9 de ses loyers \u00bb. Cette formulation, sobre et ferme, retient l\u2019inex\u00e9cution d\u2019une obligation essentielle et ouvre la voie \u00e0 la r\u00e9solution de plein droit. Elle n\u2019isole pas de grief proc\u00e9dural, mais r\u00e9unit la condition mat\u00e9rielle d\u2019impay\u00e9, suffisante \u00e0 faire produire effet \u00e0 la clause r\u00e9solutoire d\u00e8s l\u2019expiration du d\u00e9lai l\u00e9gal.<\/p>\n<p>B \u2013 Le refus de suspension en pr\u00e9sence d\u2019un apurement manifestement insuffisant<\/p>\n<p>Le juge se prononce sur la demande d\u2019\u00e9chelonnement, appr\u00e9ci\u00e9e au regard des moyens du d\u00e9biteur, de la cr\u00e9dibilit\u00e9 du plan, et des garanties offertes. La d\u00e9cision retient que \u00ab la proposition d&#8217;\u00e9talement [&#8230;] est manifestement insuffisante au regard du montant de celle-ci, d&#8217;autant qu&#8217;il ne pr\u00e9sente aucune garantie financi\u00e8re \u00bb. Le crit\u00e8re de suffisance est ici double, quantitatif et qualitatif, ce qui correspond \u00e0 la pratique des d\u00e9lais de paiement accord\u00e9s sous contr\u00f4le du juge.<\/p>\n<p>La solution est logique au regard d\u2019une dette de 8 275 euros, d\u2019un loyer mensuel de 650 euros, et d\u2019une proposition d\u2019apurement de 50 euros seulement. La bri\u00e8vet\u00e9 de l\u2019argumentation n\u2019alt\u00e8re pas sa coh\u00e9rence: l\u2019\u00e9cart manifeste entre la dette, le loyer courant et l\u2019offre additionnelle ne permet pas un apurement raisonnable. D\u00e8s lors, la juridiction conclut sans d\u00e9tour: \u00ab Dans ces conditions, la r\u00e9siliation du bail ne peut \u00eatre que constat\u00e9e au 18 d\u00e9cembre 2024. \u00bb Elle fixe ainsi la date d\u2019effet au lendemain de l\u2019expiration du d\u00e9lai de deux mois suivant le commandement, conforme \u00e0 la lettre de la clause et \u00e0 l\u2019\u00e9conomie du texte protecteur.<\/p>\n<p>II \u2013 Les cons\u00e9quences de la r\u00e9siliation sur les cr\u00e9ances accessoires<\/p>\n<p>A \u2013 L\u2019indemnit\u00e9 d\u2019occupation et la temporalit\u00e9 retenue par le juge<\/p>\n<p>Apr\u00e8s la r\u00e9solution, la possession sans droit ouvre droit \u00e0 une indemnit\u00e9 d\u2019occupation. Le jugement affirme: \u00ab S\u2019agissant de l\u2019indemnit\u00e9 d&#8217;occupation, il sera accord\u00e9 \u00e0 ce titre la somme mensuelle de 650 euros correspondant aux loyers et charges, ce \u00e0 compter du 1er mai 2025 et jusqu\u2019\u00e0 lib\u00e9ration des lieux. \u00bb Cette fixation au niveau du dernier loyer, charges comprises, s\u2019aligne sur une conception r\u00e9paratoire, non punitive, de l\u2019occupation illicite.<\/p>\n<p>La date de d\u00e9part de l\u2019indemnit\u00e9 est ici post\u00e9rieure \u00e0 la r\u00e9siliation retenue. Le choix du 1er mai 2025 se justifie par la p\u00e9riode effectivement non couverte par des loyers exigibles et impay\u00e9s, l\u2019indemnit\u00e9 ne visant pas \u00e0 dupliquer des sommes d\u00e9j\u00e0 int\u00e9gr\u00e9es dans l\u2019arri\u00e9r\u00e9. La pr\u00e9cision facilite l\u2019ex\u00e9cution forc\u00e9e et limite les futurs contentieux de liquidation.<\/p>\n<p>B \u2013 L\u2019exigence probatoire pour les demandes annexes et l\u2019arri\u00e9r\u00e9 locatif<\/p>\n<p>Le tribunal combine rigueur probatoire et pragmatisme. Il indique d\u2019abord que \u00ab la partie demanderesse ne rapporte pas la preuve d&#8217;un pr\u00e9judice financier autre que celui directement li\u00e9 au d\u00e9faut de paiement des loyers \u00bb. Le rejet des dommages et int\u00e9r\u00eats distincts d\u00e9coule d\u2019une absence de d\u00e9monstration d\u2019un dommage autonome, conform\u00e9ment \u00e0 l\u2019\u00e9conomie de la responsabilit\u00e9 d\u00e9lictuelle. Il en r\u00e9sulte une solution sobre, respectueuse du principe de r\u00e9paration int\u00e9grale.<\/p>\n<p>S\u2019agissant de l\u2019arri\u00e9r\u00e9, la d\u00e9cision rel\u00e8ve l\u2019absence de d\u00e9compte actualis\u00e9, tout en notant l\u2019absence de contestation utile par la partie d\u00e9bitrice. La juridiction en tire une cons\u00e9quence mesur\u00e9e: \u00ab Il y a donc lieu d&#8217;\u00e9tablir la dette locative [&#8230;] \u00e0 la somme de 8 275 euros au titre des loyers impay\u00e9s, arr\u00eat\u00e9e au 30 avril 2025. \u00bb Cette fixation proc\u00e8de d\u2019une appr\u00e9ciation des \u00e9l\u00e9ments non contest\u00e9s \u00e0 l\u2019audience et s\u2019inscrit dans le cadre probatoire d\u00e9fini par l\u2019article 1353 rappel\u00e9 in limine. Le quantum retient d\u00e8s lors une base fiable, claire et imm\u00e9diatement ex\u00e9cutoire.<\/p>\n<p>La d\u00e9cision ordonne enfin l\u2019expulsion, alloue une somme mod\u00e9r\u00e9e au titre de l\u2019article 700 en consid\u00e9ration de l\u2019\u00e9quit\u00e9, et met les d\u00e9pens \u00e0 la charge du d\u00e9biteur. L\u2019ensemble dessine une solution ferme mais proportionn\u00e9e, fid\u00e8le au \u00ab sens \u00bb du r\u00e9gime l\u00e9gal de la clause r\u00e9solutoire dans les baux d\u2019habitation meubl\u00e9s, et coh\u00e9rente avec les \u00ab valeurs \u00bb de protection proc\u00e9durale du locataire et de garantie des cr\u00e9ances essentielles du bailleur.
