Le litige na\u00eet d\u2019un bail conclu en 2019, portant sur un logement avec stationnement, assorti d\u2019un loyer et de charges. Des impay\u00e9s conduisent \u00e0 un commandement de payer visant la clause r\u00e9solutoire, d\u00e9livr\u00e9 le 13 d\u00e9cembre 2023, puis \u00e0 une assignation en r\u00e9f\u00e9r\u00e9.<\/p>\n<p>Par ordonnance du 6 ao\u00fbt 2024, le juge des contentieux de la protection constate l\u2019acquisition de la clause au 14 f\u00e9vrier 2024, ordonne la lib\u00e9ration des lieux, fixe une indemnit\u00e9 d\u2019occupation et condamne le locataire \u00e0 un arri\u00e9r\u00e9 provisionnel, le tout assorti de l\u2019ex\u00e9cution provisoire. Le locataire interjette appel le 10 septembre 2025. Il soutient avoir repris le paiement du loyer courant avant l\u2019audience, puis apur\u00e9 sa dette dans le cours de la proc\u00e9dure. Il sollicite la suspension des effets de la clause et des d\u00e9lais de paiement, ainsi que l\u2019infirmation des condamnations accessoires.<\/p>\n<p>Le bailleur sollicite la confirmation de l\u2019acquisition de la clause, admet la reprise r\u00e9guli\u00e8re des paiements et l\u2019apurement au plus tard au 31 mars 2025, et ne s\u2019oppose pas au maintien dans les lieux. La question pos\u00e9e tient aux conditions de la suspension des effets d\u2019une clause r\u00e9solutoire, \u00e0 la possibilit\u00e9 d\u2019accorder des d\u00e9lais, y compris r\u00e9troactivement, et \u00e0 l\u2019articulation de l\u2019office du juge au regard de l\u2019article 24 de la loi du 6 juillet 1989.<\/p>\n<p>La cour confirme l\u2019acquisition initiale de la clause et neutralise ensuite ses effets au vu de l\u2019apurement complet. Elle rel\u00e8ve que \u00ab La cour observe que le premier juge a statu\u00e9 sur la base d&#8217;un d\u00e9compte \u00e9dit\u00e9 le 03 juin 2024 [\u2026] Le paiement du loyer courant avait effectivement repris. \u00bb Elle ajoute que \u00ab La d\u00e9cision entreprise n&#8217;encourt aucune infirmation de ce chef. \u00bb Elle retient enfin, apr\u00e8s actualisation du d\u00e9compte, que \u00ab D\u00e8s lors, il ressort de ce d\u00e9compte qu&#8217;au 31 mars 2025, la dette de loyer, charges et indemnit\u00e9s d&#8217;occupation [\u2026] \u00e9tait int\u00e9gralement sold\u00e9e, en ce compris les d\u00e9pens et frais irr\u00e9p\u00e9tibles de premi\u00e8re instance de la pr\u00e9sente proc\u00e9dure. \u00bb Le dispositif \u00ab Ordonne la suspension des effets de la clause r\u00e9solutoire \u00bb et \u00ab Constate que ces d\u00e9lais de paiement ayant \u00e9t\u00e9 respect\u00e9s, la clause r\u00e9solutoire est r\u00e9put\u00e9e ne jamais avoir jou\u00e9. \u00bb<\/p>\n<p>I. Le sens de la solution et son fondement textuel<\/p>\n<p>A. L\u2019acquisition r\u00e9guli\u00e8re de la clause et l\u2019impossibilit\u00e9 d\u2019une suspension d\u2019office en premi\u00e8re instance<br \/>\nLe raisonnement d\u00e9bute par la v\u00e9rification des conditions d\u2019exercice de la clause r\u00e9solutoire apr\u00e8s commandement, d\u00e9lai, et absence de r\u00e9gularisation \u00e0 terme. La cour valide l\u2019analyse du premier juge, fond\u00e9e sur un d\u00e9compte arr\u00eat\u00e9 au 3 juin 2024, qui int\u00e8gre des versements sans \u00e9teindre les causes du commandement. La motivation souligne que \u00ab La cour observe que le premier juge a statu\u00e9 sur la base d&#8217;un d\u00e9compte \u00e9dit\u00e9 le 03 juin 2024 [\u2026] la dette locative s&#8217;\u00e9levant \u00e0 la somme de 1 134,15 euros [\u2026]. \u00bb L\u2019office du juge de r\u00e9f\u00e9r\u00e9, en pareil cas, reste born\u00e9 par l\u2019article 24 de la loi de 1989.<\/p>\n<p>La cour pr\u00e9cise surtout que \u00ab La suspension de la clause r\u00e9solutoire n&#8217;aurait pu \u00eatre accord\u00e9e d&#8217;office en application de l&#8217;article 24 VII. de la loi du 06 juillet 1989 [\u2026] \u00bb et qu\u2019en cons\u00e9quence \u00ab La d\u00e9cision entreprise n&#8217;encourt aucune infirmation de ce chef. \u00bb La port\u00e9e est claire. La suspension des effets suppose une saisine en ce sens et la reprise int\u00e9grale du loyer courant avant l\u2019audience. Le premier juge, saisi alors d\u2019un dossier encore d\u00e9biteur, ne pouvait neutraliser ex officio la clause d\u00e9j\u00e0 acquise.<\/p>\n<p>B. Le pouvoir du juge d\u2019appel d\u2019accorder des d\u00e9lais r\u00e9troactifs et de neutraliser les effets<br \/>\nLe contentieux se d\u00e9place vers l\u2019\u00e9tat de la dette au jour o\u00f9 la cour statue, et vers les pouvoirs d\u2019am\u00e9nagement du temps de paiement. La cour retient, au vu d\u2019un d\u00e9compte actualis\u00e9, que \u00ab D\u00e8s lors, il ressort de ce d\u00e9compte qu&#8217;au 31 mars 2025, la dette [\u2026] \u00e9tait int\u00e9gralement sold\u00e9e [\u2026]. \u00bb Cette constatation fonde un traitement distinct entre l\u2019acquisition de la clause et ses effets. Le texte de l\u2019article 24, V et VII, autorise des d\u00e9lais dans la limite de trois ans et la suspension des effets pendant leur cours, sous conditions.<\/p>\n<p>La cour en tire une cons\u00e9quence normative double. D\u2019abord, le prononc\u00e9 de d\u00e9lais peut \u00eatre envisag\u00e9 de mani\u00e8re r\u00e9troactive, d\u00e8s lors que le d\u00e9bat contradictoire a eu lieu. Ensuite, la neutralisation des effets suit l\u2019ex\u00e9cution int\u00e9grale des sommes, ce que consacre le dispositif, qui \u00ab Ordonne la suspension des effets de la clause r\u00e9solutoire \u00bb et \u00ab Constate que ces d\u00e9lais de paiement ayant \u00e9t\u00e9 respect\u00e9s, la clause r\u00e9solutoire est r\u00e9put\u00e9e ne jamais avoir jou\u00e9. \u00bb La solution op\u00e8re ainsi une dissociation rigoureuse entre la constatation de l\u2019acquisition et la disparition de ses cons\u00e9quences, par l\u2019apurement.<\/p>\n<p>II. La valeur de la motivation et sa port\u00e9e pratique<\/p>\n<p>A. Une motivation mesur\u00e9e sur l\u2019office du juge et les conditions de protection<br \/>\nLa d\u00e9cision m\u00e9nage l\u2019\u00e9quilibre entre force obligatoire des clauses et protection du d\u00e9biteur de bonne foi qui reprend ses paiements. Elle distingue le temps de la constatation, fix\u00e9e \u00e0 la date o\u00f9 l\u2019impay\u00e9 persiste, et le temps de l\u2019ex\u00e9cution, appr\u00e9ci\u00e9 in concreto lors de l\u2019examen des d\u00e9lais. La r\u00e9f\u00e9rence \u00e0 l\u2019article 24, V et VII, structure la d\u00e9marche, sans surcharge doctrinale inutile. L\u2019emploi du d\u00e9compte actualis\u00e9 pr\u00e9serve la s\u00e9curit\u00e9 juridique et \u00e9vite une solution d\u00e9connect\u00e9e de la r\u00e9alit\u00e9 des paiements.<\/p>\n<p>La motivation reste sobre, mais d\u00e9cisive, lorsqu\u2019elle rappelle l\u2019impossibilit\u00e9 d\u2019une suspension d\u2019office en premi\u00e8re instance dans le cadre du VII, et la latitude d\u2019octroi de d\u00e9lais de paiement dans le V. L\u2019articulation temporelle sert la coh\u00e9rence de la solution. La phrase \u00ab La d\u00e9cision entreprise n&#8217;encourt aucune infirmation de ce chef \u00bb exprime cette prudence m\u00e9thodologique, avant l\u2019am\u00e9nagement curatif cons\u00e9cutif \u00e0 l\u2019apurement total.<\/p>\n<p>B. Des enseignements op\u00e9rationnels pour les rapports locatifs et le contentieux<br \/>\nLa port\u00e9e est nette. La reprise effective du loyer courant avant audience demeure d\u00e9terminante pour solliciter la suspension des effets, tandis que l\u2019apurement int\u00e9gral peut emporter, in fine, extinction r\u00e9troactive des cons\u00e9quences de la clause. Le dispositif le confirme en ce qu\u2019il \u00ab Ordonne la suspension des effets de la clause r\u00e9solutoire \u00bb et \u00ab Constate que [\u2026] la clause r\u00e9solutoire est r\u00e9put\u00e9e ne jamais avoir jou\u00e9. \u00bb La solution donne un cap clair aux parties sur la hi\u00e9rarchie des exigences.<\/p>\n<p>Sur l\u2019accessoire, la cour maintient une ligne de responsabilit\u00e9 proc\u00e9durale.
