La copropri\u00e9taire d\u2019un lot a \u00e9t\u00e9 assign\u00e9e en janvier 2023 pour des impay\u00e9s et condamn\u00e9e en novembre 2023 pour les sommes arr\u00eat\u00e9es au 31 d\u00e9cembre 2022. Le premier juge a d\u00e9clar\u00e9 irrecevables les pr\u00e9tentions additionnelles relatives aux provisions 2023. L\u2019appel a \u00e9t\u00e9 limit\u00e9 \u00e0 ce chef, l\u2019intim\u00e9e n\u2019ayant pas constitu\u00e9, et le dossier a \u00e9t\u00e9 jug\u00e9 par d\u00e9faut. La question portait sur la possibilit\u00e9 de statuer en appel sur des charges devenues exigibles apr\u00e8s l\u2019assignation. La cour admet cette extension, infirme l\u2019irrecevabilit\u00e9 et prononce une condamnation compl\u00e9mentaire. La motivation s\u2019ouvre par la formule \u00ab Vu l\u2019\u00e9volution du litige, \u00bb qui commande l\u2019office du juge d\u2019appel.<\/p>\n<p>I. Le sens de la d\u00e9cision<\/p>\n<p>A. L\u2019admission des demandes compl\u00e9mentaires en cause d\u2019appel<br \/>\nLe litige initial portait sur le recouvrement de charges certaines, liquides et exigibles. Les pr\u00e9tentions additionnelles, chiffr\u00e9es au vu des comptes ult\u00e9rieurs, tendent aux m\u00eames fins et r\u00e9sultent de l\u2019\u00e9volution du diff\u00e9rend. La cour, se fondant sur cette dynamique proc\u00e9durale, accueille les sommes post\u00e9rieures d\u00e8s lors qu\u2019elles prolongent la pr\u00e9tention principale et reposent sur des pi\u00e8ces mises aux d\u00e9bats. Elle juge en ce sens que \u00ab L\u2019intim\u00e9e sera condamn\u00e9e au paiement de cette somme et aux d\u00e9pens d\u2019appel. \u00bb L\u2019extension ne bouleverse pas l\u2019objet du litige, elle l\u2019actualise, conform\u00e9ment aux textes permettant d\u2019int\u00e9grer ce qui est la cons\u00e9quence directe des faits survenus apr\u00e8s le premier jugement.<\/p>\n<p>B. Le fondement l\u00e9gal et la mat\u00e9rialit\u00e9 de la dette<br \/>\nLa d\u00e9cision rappelle le principe gouvernant la contribution aux charges. Elle \u00e9nonce que \u00ab En application de l&#8217;article 10 de la loi du 10 juillet 1965 telle que modifi\u00e9e, les copropri\u00e9taires sont tenus de participer aux charges entra\u00een\u00e9es par les services collectifs et les \u00e9l\u00e9ments d&#8217;\u00e9quipement commun en fonction de l&#8217;utilit\u00e9 que ces services et \u00e9l\u00e9ments pr\u00e9sentent \u00e0 l&#8217;\u00e9gard de chaque lot et aux charges relatives \u00e0 la conservation, \u00e0 l&#8217;entretien et \u00e0 l&#8217;administration des parties communes proportionnellement aux valeurs relatives des parties privatives comprises dans leurs lots. \u00bb La cour s\u2019appuie sur le proc\u00e8s-verbal d\u2019assembl\u00e9e approuvant les comptes et votant les budgets, ainsi que sur les appels de charges et l\u2019arr\u00eat\u00e9 de compte. Elle fixe la cr\u00e9ance additionnelle au 30 mars 2024 et pr\u00e9cise, sur les accessoires, que \u00ab Cette condamnation aux charges de copropri\u00e9t\u00e9 portera int\u00e9r\u00eats au taux l\u00e9gal \u00e0 compter de la pr\u00e9sente d\u00e9cision en l&#8217;absence de justificatif de mise en demeure en paiement de cette somme. \u00bb<\/p>\n<p>II. La valeur et la port\u00e9e de la solution<\/p>\n<p>A. Conformit\u00e9 au droit processuel de l\u2019appel<br \/>\nLa solution s\u2019accorde avec la logique des pr\u00e9tentions recevables en appel lorsqu\u2019elles tendent au m\u00eame but ou proc\u00e8dent de l\u2019\u00e9volution du litige. Elle s\u00e9curise l\u2019actualisation des montants dus sans imposer une nouvelle instance pour chaque \u00e9ch\u00e9ance. La formule \u00ab Vu l\u2019\u00e9volution du litige, \u00bb traduit le contr\u00f4le exerc\u00e9 sur le p\u00e9rim\u00e8tre de l\u2019instance d\u2019appel. La cour canalise l\u2019extension par l\u2019exigence de pi\u00e8ces probantes et par une stricte continuit\u00e9 entre l\u2019objet initial et les demandes compl\u00e9mentaires.<\/p>\n<p>B. Incidences pratiques en mati\u00e8re de copropri\u00e9t\u00e9<br \/>\nL\u2019arr\u00eat \u00e9claire la charge de la preuve du syndicat et l\u2019int\u00e9r\u00eat d\u2019une gestion documentaire rigoureuse, notamment le proc\u00e8s-verbal d\u2019approbation des comptes et les appels d\u00e9taill\u00e9s. Il rappelle aussi la discipline des accessoires : sans mise en demeure justifi\u00e9e, les int\u00e9r\u00eats ne courent qu\u2019\u00e0 compter de l\u2019arr\u00eat.
