Un copropri\u00e9taire sollicitait l\u2019annulation de deux r\u00e9solutions d\u2019une assembl\u00e9e g\u00e9n\u00e9rale du 6 juin 2023, invoquant des irr\u00e9gularit\u00e9s de majorit\u00e9, l\u2019absence de devis et la nature des travaux. Il requ\u00e9rait aussi la convocation d\u2019une nouvelle assembl\u00e9e, afin de revoter une r\u00e9solution relative \u00e0 la cl\u00e9 de r\u00e9partition mentionn\u00e9e au proc\u00e8s-verbal. Le syndicat de copropri\u00e9taires opposait des fins de non-recevoir et demandait que les pr\u00e9tentions adverses soient d\u00e9clar\u00e9es irrecevables. L\u2019assignation datait du 18 ao\u00fbt 2023, l\u2019incident fut plaid\u00e9 le 20 mai 2025, puis mis en d\u00e9lib\u00e9r\u00e9 jusqu\u2019\u00e0 l\u2019ordonnance pr\u00e9cit\u00e9e.<\/p>\n<p>La juridiction devait d\u00e9terminer les conditions de recevabilit\u00e9 des contestations de r\u00e9solutions, l\u2019autorit\u00e9 du vote unanime et l\u2019impossibilit\u00e9 d\u2019imposer un nouveau scrutin. Elle a admis la contestation de certaines sous-r\u00e9solutions portant de nouveaux am\u00e9nagements, \u00e9cart\u00e9 toute contestation des points non vot\u00e9s, et rejet\u00e9 la voie de la convocation. La contestation d\u2019une r\u00e9solution adopt\u00e9e \u00e0 l\u2019unanimit\u00e9 a \u00e9t\u00e9 d\u00e9clar\u00e9e irrecevable, faute de qualit\u00e9 d\u2019opposant ou de d\u00e9faillant au sens du texte sp\u00e9cial.<\/p>\n<p>I \u2013 Le cadre proc\u00e9dural et la recevabilit\u00e9 en mati\u00e8re de copropri\u00e9t\u00e9<\/p>\n<p>A \u2013 La comp\u00e9tence du juge de la mise en \u00e9tat<\/p>\n<p>L\u2019ordonnance rappelle le pouvoir de statuer sur les fins de non\u2011recevoir durant l\u2019instruction, conform\u00e9ment \u00e0 l\u2019article 789 du code de proc\u00e9dure civile, dans sa version applicable aux instances en cours. Le juge n\u2019a pas us\u00e9 de la facult\u00e9 de renvoi \u00e0 la formation de jugement, privil\u00e9giant un traitement imm\u00e9diat de l\u2019incident. Cette d\u00e9marche assure l\u2019effet utile de l\u2019instruction, en circonscrivant le litige aux pr\u00e9tentions l\u00e9galement admissibles.<\/p>\n<p>La solution proc\u00e8de ainsi \u00e0 une s\u00e9lection proc\u00e9durale des demandes en lien avec l\u2019article 42 de la loi du 10 juillet 1965. Le contr\u00f4le se concentre sur la qualit\u00e9 pour agir, le caract\u00e8re d\u00e9cisoire de la r\u00e9solution et l\u2019existence d\u2019une voie l\u00e9gale de contestation, sans anticiper sur l\u2019examen du fond. La rigueur de cette grille permet de pr\u00e9server la stabilit\u00e9 des d\u00e9cisions collectives tout en laissant subsister l\u2019action lorsque les conditions sont r\u00e9unies.<\/p>\n<p>B \u2013 Les crit\u00e8res de recevabilit\u00e9 des contestations d\u2019assembl\u00e9e<\/p>\n<p>Le juge retient que les sous\u2011r\u00e9solutions d\u00e9pourvues d\u2019effet d\u00e9cisoire ne sont pas attaquables. Il \u00e9nonce que \u00ab Les r\u00e9solutions n\u00b013- b et n\u00b013- c n&#8217;\u00e9tant pas soumises au vote, ces derni\u00e8res ne peuvent \u00eatre contest\u00e9es en justice. \u00bb La motivation distingue, \u00e0 l\u2019inverse, les points emportant de nouveaux am\u00e9nagements, lesquels d\u00e9passent un simple rappel et justifient l\u2019ouverture du contentieux. D\u2019o\u00f9 la pr\u00e9cision selon laquelle \u00ab Ces r\u00e9solutions sont donc bien susceptibles d&#8217;annulation. \u00bb Le crit\u00e8re op\u00e9ratoire demeure le vote effectif produisant une d\u00e9cision, seul apte \u00e0 fonder l\u2019action pr\u00e9vue par le texte sp\u00e9cial.<\/p>\n<p>S\u2019agissant d\u2019une autre d\u00e9lib\u00e9ration, l\u2019ordonnance retient que \u00ab S&#8217;agissant de la r\u00e9solution n\u00b011 de l&#8217;assembl\u00e9e g\u00e9n\u00e9rale du 6 juin 2023, il est \u00e9tabli que cette derni\u00e8re a \u00e9t\u00e9 vot\u00e9e \u00e0 l&#8217;unanimit\u00e9. \u00bb L\u2019irrecevabilit\u00e9 d\u00e9coule alors de l\u2019article 42 de la loi de 1965, qui r\u00e9serve l\u2019action aux opposants ou d\u00e9faillants. En participant au vote unanime, le copropri\u00e9taire ne peut utilement contester la d\u00e9cision ainsi adopt\u00e9e, le d\u00e9bat se refermant sur l\u2019exigence de coh\u00e9rence proc\u00e9durale attach\u00e9e \u00e0 la qualit\u00e9 pour agir.<\/p>\n<p>II \u2013 Port\u00e9e et appr\u00e9ciation critique de la solution<\/p>\n<p>A \u2013 L\u2019exclusivit\u00e9 de la voie de l\u2019article 42 et la discipline de l\u2019instance<\/p>\n<p>L\u2019ordonnance refuse de substituer une injonction de convocation \u00e0 la voie sp\u00e9ciale d\u2019annulation, rappelant que \u00ab Il n&#8217;y a donc pas lieu de demander la convocation d&#8217;une nouvelle assembl\u00e9e g\u00e9n\u00e9rale afin de proc\u00e9der \u00e0 un nouveau vote sur la r\u00e9solution litigieuse d\u00e8s lors qu&#8217;un m\u00e9canisme de contestation existe d\u00e9j\u00e0 en vertu de l&#8217;article 42 de la loi n\u00b065-557 du 10 juillet 1965. \u00bb Cette affirmation consolide l\u2019\u00e9conomie de la loi de 1965, qui organise un contentieux encadr\u00e9, born\u00e9 par des d\u00e9lais pr\u00e9fix et des qualit\u00e9s pour agir strictement d\u00e9finies.<\/p>\n<p>La port\u00e9e pratique est nette. Le juge de la mise en \u00e9tat neutralise une tentative de contournement proc\u00e9dural par la voie de mesures d\u2019administration de la copropri\u00e9t\u00e9, au profit d\u2019un examen concentr\u00e9 sur la validit\u00e9 des d\u00e9cisions attaqu\u00e9es. La discipline ainsi pos\u00e9e limite la dispersion des demandes incidentes et favorise la lisibilit\u00e9 du proc\u00e8s collectif, sans priver le copropri\u00e9taire d\u2019un recours adapt\u00e9 lorsqu\u2019il est ouvert.<\/p>\n<p>B \u2013 Int\u00e9r\u00eat \u00e0 agir, identit\u00e9 des r\u00e9solutions et coh\u00e9rence r\u00e9dactionnelle<\/p>\n<p>L\u2019ordonnance aborde, avec mesure, l\u2019incidence d\u2019une d\u00e9lib\u00e9ration post\u00e9rieure sur l\u2019int\u00e9r\u00eat \u00e0 agir. Elle rel\u00e8ve qu\u2019\u00ab on ne peut consid\u00e9rer en l&#8217;esp\u00e8ce que la r\u00e9solution n\u00b022 de l&#8217;assembl\u00e9e g\u00e9n\u00e9rale du 27 juin 2024 est identique. \u00bb Le raisonnement \u00e9vite l\u2019extinction automatique de l\u2019action par une d\u00e9cision ult\u00e9rieure, en exigeant une stricte identit\u00e9 d\u2019objet et d\u2019effet. Cette exigence prot\u00e8ge l\u2019effectivit\u00e9 du contr\u00f4le juridictionnel des d\u00e9cisions, d\u00e8s lors que la r\u00e9solution nouvelle pr\u00e9sente un contenu distinct, tel un ouvrage diff\u00e9rent ou une cl\u00e9 de r\u00e9partition non superposable.<\/p>\n<p>Une r\u00e9serve tient toutefois \u00e0 la pr\u00e9cision du dispositif, qui comporte une double r\u00e9f\u00e9rence \u00e0 une m\u00eame sous\u2011r\u00e9solution, susceptible d\u2019appeler une rectification mat\u00e9rielle. L\u2019\u00e9conomie g\u00e9n\u00e9rale des motifs demeure cependant intelligible. Le crit\u00e8re d\u00e9cisif est le caract\u00e8re vot\u00e9 et cr\u00e9ateur d\u2019effets de la d\u00e9cision, seul de nature \u00e0 ouvrir l\u2019action, tandis que l\u2019unanimit\u00e9 ferme l\u2019acc\u00e8s \u00e0 la contestation.
