L&#8217;arr\u00eat traite la validit\u00e9 d\u2019un cong\u00e9 pour vendre d\u00e9livr\u00e9 \u00e0 l\u2019\u00e9ch\u00e9ance d\u2019un bail d\u2019habitation lorsque la pleine propri\u00e9t\u00e9 r\u00e9sulte de l\u2019extinction d\u2019un usufruit temporaire. Les faits tiennent en peu d\u2019\u00e9l\u00e9ments utiles. La nue-propri\u00e9t\u00e9 du logement a \u00e9t\u00e9 acquise en 2008, l\u2019usufruit ayant \u00e9t\u00e9 r\u00e9serv\u00e9 pour dix ans. Un bail d\u2019habitation a \u00e9t\u00e9 consenti en 2015 pour six ans. Un cong\u00e9 pour vendre a \u00e9t\u00e9 notifi\u00e9 le 26 ao\u00fbt 2020 pour le 28 f\u00e9vrier 2021. Les locataires ont quitt\u00e9 les lieux fin novembre 2020, apr\u00e8s avoir obtenu une compensation financi\u00e8re li\u00e9e \u00e0 leur nouvelle location.<\/p>\n<p>La proc\u00e9dure a connu un premier jugement le 1er mars 2023. La juridiction a valid\u00e9 le cong\u00e9, constat\u00e9 la fin anticip\u00e9e du bail au 1er d\u00e9cembre 2020 et allou\u00e9 des dommages-int\u00e9r\u00eats au bailleur. Les locataires ont interjet\u00e9 appel en soutenant la nullit\u00e9 du cong\u00e9, la r\u00e9int\u00e9gration, et des dommages-int\u00e9r\u00eats. Le bailleur a sollicit\u00e9 la confirmation, des sommes compl\u00e9mentaires, et des frais. Une intervention volontaire accessoire a \u00e9t\u00e9 form\u00e9e en cause d\u2019appel. La cour d\u2019appel a, par arr\u00eat avant dire droit du 12 juin 2025, r\u00e9voqu\u00e9 la cl\u00f4ture, re\u00e7u les \u00e9critures et cl\u00f4tur\u00e9 \u00e0 l\u2019audience.<\/p>\n<p>La question de droit principale porte sur le point de d\u00e9part de la \u00ab dur\u00e9e de d\u00e9tention \u00bb au sens de l\u2019article 15 de la loi du 6 juillet 1989, lorsqu\u2019un nu-propri\u00e9taire redevient plein propri\u00e9taire par extinction d\u2019un usufruit. Le litige soul\u00e8ve aussi la port\u00e9e de l\u2019article 954 du code de proc\u00e9dure civile en l\u2019absence de pr\u00e9tention expresse au dispositif, l\u2019int\u00e9r\u00eat \u00e0 intervenir de l\u2019article 330 du m\u00eame code, et la charge de la preuve du pr\u00e9judice financier. La cour r\u00e9pond que l\u2019extinction de l\u2019usufruit n\u2019est pas une acquisition et que le cong\u00e9 pour vendre est valide. Elle confirme, faute de pr\u00e9tention au dispositif, la condamnation prononc\u00e9e, d\u00e9clare l\u2019intervention accessoire irrecevable et rejette les demandes indemnitaires compl\u00e9mentaires.<\/p>\n<p>I. Le r\u00e9gime du cong\u00e9 pour vendre apr\u00e8s extinction d\u2019usufruit<\/p>\n<p>A. La qualification d\u2019extinction du droit, non assimil\u00e9e \u00e0 une acquisition<\/p>\n<p>La cour rappelle d\u2019abord le cadre l\u00e9gal du cong\u00e9 pour vendre et pr\u00e9cise le contr\u00f4le du motif par le juge. Elle rel\u00e8ve que \u00ab En l&#8217;esp\u00e8ce la r\u00e9gularit\u00e9 formelle du cong\u00e9 n&#8217;est pas contest\u00e9e \u00bb. La difficult\u00e9 r\u00e9side dans la computation des d\u00e9lais en cas de nue-propri\u00e9t\u00e9 initiale et de reconstitution de la pleine propri\u00e9t\u00e9 au terme de l\u2019usufruit temporaire.<\/p>\n<p>L\u2019arr\u00eat adopte le raisonnement du premier juge en des termes d\u00e9cisifs, ainsi formul\u00e9s: \u00ab les dispositions de l&#8217;article 15 de la loi du 6 juillet 1989 pr\u00e9cit\u00e9 ne s&#8217;appliquent pas au nu-propri\u00e9taire qui recouvre la pleine propri\u00e9t\u00e9 de son bien en raison de l&#8217;extinction d&#8217;un droit temporaire d&#8217;usufruit arriv\u00e9 \u00e0 son terme, l&#8217;extinction d&#8217;un droit temporaire ne pouvant \u00eatre assimil\u00e9 \u00e0 une acquisition \u00bb. La motivation s\u2019appuie sur l\u2019article 617 du code civil, qui pr\u00e9voit l\u2019extinction de l\u2019usufruit \u00e0 l\u2019expiration du temps convenu. La solution se d\u00e9duit ensuite de l\u2019acte notari\u00e9 constatant la nue-propri\u00e9t\u00e9 et la reconstitution de plein droit. La cour ajoute, dans une formule claire, que \u00ab Il n&#8217;y a donc pas eu d&#8217;acquisition \u00e0 la date du 20 novembre 2018 mais seulement une extinction de l&#8217;usufruit \u00bb.<\/p>\n<p>La cons\u00e9quence juridique est nette. L\u2019unique \u00ab acquisition \u00bb au sens de l\u2019article 15 remonte \u00e0 2008, de sorte que le terme du bail intervenait plus de trois ans apr\u00e8s cette date. Le cong\u00e9 pour vendre satisfait ainsi la condition temporelle, sans que la fin de l\u2019usufruit puisse rouvrir un nouveau d\u00e9lai. La nature extinctive, et non translatif, de l\u2019\u00e9v\u00e9nement op\u00e8re tout enti\u00e8re la solution.<\/p>\n<p>B. L\u2019\u00e9cartement des analogies et la finalit\u00e9 de l\u2019article 15<\/p>\n<p>Les locataires invoquaient un pr\u00e9c\u00e9dent en mati\u00e8re rurale sur la \u00ab d\u00e9tention \u00bb au sens de l\u2019article L. 331-2, II du code rural. La cour marque la limite de cette analogie. La d\u00e9cision cit\u00e9e (Cass. 3e civ., 21 mai 2014, n\u00b0 13-14.851) concernait un cong\u00e9 pour reprise, un autre texte, et la notion de d\u00e9tention, non la date d\u2019acquisition vis\u00e9e par l\u2019article 15 de la loi du 6 juillet 1989. La grille d\u2019analyse diff\u00e8re structurellement, car la finalit\u00e9 du texte d\u2019habitation prime.<\/p>\n<p>La cour \u00e9claire d\u2019ailleurs l\u2019\u00e9conomie de la r\u00e8gle en rappelant que \u00ab les dispositions de l&#8217;article 15 ont pour seule vocation de pr\u00e9venir les acquisitions sp\u00e9culatives \u00bb. Assimiler l\u2019extinction de l\u2019usufruit \u00e0 une acquisition cr\u00e9erait un d\u00e9lai artificiel \u00e9tranger \u00e0 cette finalit\u00e9. La politique jurisprudentielle est coh\u00e9rente avec l\u2019objectif de stabilit\u00e9 des relations locatives et la lutte contre les op\u00e9rations d\u2019achat sp\u00e9culatif, sans p\u00e9naliser les situations d\u00e9nou\u00e9es par un simple retour de plein droit.<\/p>\n<p>II. Les enseignements proc\u00e9duraux et indemnitaires<\/p>\n<p>A. La rigueur de l\u2019article 954 et la confirmation des chefs non saisis<\/p>\n<p>L\u2019appelant doit formuler des pr\u00e9tentions au dispositif, la cour ne statuant que sur celles qui y figurent. Ici, les \u00e9critures demandaient l\u2019infirmation d\u2019une condamnation indemnitaire, sans pr\u00e9tention corr\u00e9lative au dispositif. La cour applique la lettre de l\u2019article 954 et juge que \u00ab la cour ne peut que constater qu&#8217;elle n&#8217;est pas saisie de pr\u00e9tentions relatives \u00e0 ces demandes \u00bb. La confirmation du chef de condamnation en d\u00e9coule de plein droit.<\/p>\n<p>Cette rigueur est conforme \u00e0 une jurisprudence constante, notamment 2e Civ., 5 d\u00e9cembre 2013, n\u00b0 12-23.611, 1re Civ., 17 mars 2016, n\u00b0 14-27.168, et 2e Civ., 4 f\u00e9vrier 2021, n\u00b0 19-23.615. Elle illustre la s\u00e9paration nette entre motifs et dispositif en appel, et sanctionne les dispositifs lacunaires. Le contentieux locatif n\u2019\u00e9chappe pas \u00e0 ces exigences, qui structurent la saisine de la juridiction du second degr\u00e9.<\/p>\n<p>La cour examine aussi l\u2019intervention accessoire. Les textes applicables sont rappel\u00e9s, en particulier l\u2019article 330 du code de proc\u00e9dure civile: \u00ab L&#8217;intervention est accessoire lorsqu&#8217;elle appuie les pr\u00e9tentions d&#8217;une partie. Elle est recevable si son auteur a int\u00e9r\u00eat, pour la conservation de ses droits, \u00e0 soutenir cette partie \u00bb. L\u2019int\u00e9r\u00eat doit \u00eatre n\u00e9 et actuel en cause d\u2019appel. \u00c0 d\u00e9faut d\u2019un tel int\u00e9r\u00eat, l\u2019intervention est irrecevable, ce que consacre la d\u00e9cision, au regard des risques seulement hypoth\u00e9tiques all\u00e9gu\u00e9s.<\/p>\n<p>B. L\u2019office du juge sur le pr\u00e9judice financier et l\u2019absence d\u2019abus<\/p>\n<p>S\u2019agissant des demandes indemnitaires compl\u00e9mentaires en appel, la cour constate l\u2019insuffisance de preuve d\u2019une impossibilit\u00e9 de louer ou de vendre post\u00e9rieurement au premier jugement assorti de l\u2019ex\u00e9cution provisoire. Elle rel\u00e8ve l\u2019absence de pi\u00e8ces actualis\u00e9es \u00e9tablissant l\u2019immobilisation du bien pour la p\u00e9riode en cause. La conclusion s\u2019\u00e9nonce sans d\u00e9tour: \u00ab La demande d&#8217;actualisation du pr\u00e9judice li\u00e9 aux \u00e9ch\u00e9ances de l&#8217;emprunt non couvertes par la location ou la vente du bien et \u00e0 son immobilisation, sera rejet\u00e9e \u00bb. Le rejet s\u2019\u00e9tend \u00e0 la demande relative \u00e0 la taxe sur les logements vacants, faute d\u2019\u00e9l\u00e9ments probants.<\/p>\n<p>La cour rejette encore la demande de dommages-int\u00e9r\u00eats pour proc\u00e9dure abusive. Elle retient la d\u00e9finition usuelle, reprise par l\u2019arr\u00eat: \u00ab l&#8217;exercice d&#8217;une action en justice ne d\u00e9g\u00e9n\u00e8re en abus que s&#8217;il constitue un acte de malice ou de mauvaise foi, ou s&#8217;il s&#8217;agit d&#8217;une erreur grave \u00e9quipollente au dol ; l&#8217;appr\u00e9ciation inexacte qu&#8217;une partie se fait de ses droits n&#8217;est pas constitutive en soi d&#8217;une faute \u00bb. Les \u00e9critures d\u2019appel, m\u00eame persistantes, ne r\u00e9v\u00e8lent pas de man\u0153uvres fautives. L\u2019action demeure dans les limites normales de l\u2019instance.<\/p>\n<p>Enfin, la date de fin de bail, fix\u00e9e au 1er d\u00e9cembre 2020, r\u00e9sulte d\u2019un accord des parties, la lib\u00e9ration effective \u00e9tant intervenue fin novembre. Cette appr\u00e9ciation, d\u00e9j\u00e0 faite en premi\u00e8re instance, n\u2019est pas utilement remise en cause par des \u00e9l\u00e9ments nouveaux. Les condamnations au titre de l\u2019article 700 du code de proc\u00e9dure civile et des d\u00e9pens d\u2019appel suivent la solution principale et l\u2019\u00e9quit\u00e9 retenue par la cour.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Cour d&#8217;appel de Paris, 19 juin 2025.
