Le litige na\u00eet d&#8217;une vente d&#8217;une maison dont l&#8217;acc\u00e8s au garage s&#8217;est r\u00e9v\u00e9l\u00e9 difficile en raison d&#8217;une rampe tr\u00e8s pentue. Les acqu\u00e9reurs, apr\u00e8s expertise, ont recherch\u00e9 la garantie des vices cach\u00e9s contre les h\u00e9riti\u00e8res du vendeur, ainsi que la responsabilit\u00e9 contractuelle de l&#8217;agence immobili\u00e8re. Le tribunal judiciaire de Cr\u00e9teil, le 13 juin 2023, les a d\u00e9bout\u00e9s, retenant l&#8217;application d&#8217;une clause d&#8217;exclusion de garantie faute de preuve de la connaissance du vice par le vendeur.<\/p>\n<p>Devant la juridiction d&#8217;appel, les acqu\u00e9reurs ont sollicit\u00e9 l&#8217;infirmation, invoquant l\u2019impropri\u00e9t\u00e9 \u00e0 l\u2019usage du bien compte tenu de l\u2019impossibilit\u00e9 de stationner dans le garage. Les h\u00e9riti\u00e8res du vendeur ont conclu \u00e0 la confirmation, soutenant le caract\u00e8re apparent de l\u2019anomalie. L\u2019agence immobili\u00e8re a contest\u00e9 toute faute et tout lien causal. La question portait sur la qualification de l\u2019anomalie au regard des articles 1641 et 1642 du code civil, ainsi que sur l\u2019engagement de responsabilit\u00e9 de l\u2019interm\u00e9diaire. La cour confirme le rejet, retenant l\u2019apparence du d\u00e9faut et \u00e9cartant, par voie de cons\u00e9quence et faute de causalit\u00e9, les demandes dirig\u00e9es contre l\u2019agence.<\/p>\n<p>L\u2019arr\u00eat pr\u00e9cise d\u2019abord les crit\u00e8res d\u2019apparence du d\u00e9faut, malgr\u00e9 la r\u00e9f\u00e9rence technique \u00e0 une non\u2011conformit\u00e9, puis appr\u00e9cie la port\u00e9e de cette qualification sur la garantie l\u00e9gale et sur l\u2019action en responsabilit\u00e9 dirig\u00e9e contre l\u2019interm\u00e9diaire.<\/p>\n<p>I. L\u2019apparence du d\u00e9faut d\u2019acc\u00e8s et la neutralisation de la garantie<\/p>\n<p>A. Une non-conformit\u00e9 objectiv\u00e9e mais un vice rest\u00e9 visible lors de la vente<\/p>\n<p>La cour s\u2019appuie sur l\u2019expertise judiciaire qui d\u00e9crit une rampe techniquement inad\u00e9quate. Elle rel\u00e8ve que \u00ab la rampe n\u2019est pas conforme aux pr\u00e9conisations de la circulaire du 3 mars 1975 relative aux parcs de stationnement couverts \u00bb. Elle ajoute que \u00ab qu\u2019il en r\u00e9sulte que l\u2019acc\u00e8s au garage, qui ne peut d\u00e9pendre du type de v\u00e9hicule utilis\u00e9, n\u2019est pas possible dans des conditions normales \u00bb. Ces \u00e9l\u00e9ments soulignent l\u2019impropri\u00e9t\u00e9 fonctionnelle de l\u2019acc\u00e8s, appr\u00e9ci\u00e9e au regard d\u2019un standard d\u2019utilisation normale d\u2019un garage domestique.<\/p>\n<p>Cependant, la qualification de vice cach\u00e9 suppose que le d\u00e9faut n\u2019ait pas \u00e9t\u00e9 apparent lors de la vente. Or, la cour retient que \u00ab il \u00e9tait visible que la pente de la rampe \u00e9tait anormalement forte \u00bb, appr\u00e9ciation qui substitue une analyse ph\u00e9nom\u00e9nologique \u00e0 la seule mesure normative. L\u2019\u00e9clairage technique ne fait pas dispara\u00eetre l\u2019\u00e9vidence perceptible par des acqu\u00e9reurs normalement attentifs, au moment de la visite, sans investigations destructrices ni comp\u00e9tence sp\u00e9cialis\u00e9e.<\/p>\n<p>Cette approche rejoint la logique de l\u2019article 1642 du code civil, qui \u00e9carte la garantie pour les d\u00e9fauts apparents dont l\u2019acheteur \u00ab a pu se convaincre lui\u2011m\u00eame \u00bb. Les juges constatent l\u2019accessibilit\u00e9 directe de l\u2019information par l\u2019examen des lieux. L\u2019expertise fonde l\u2019exactitude du diagnostic, mais ne transforme pas un d\u00e9faut visible en vicio occulto. Le visible prime d\u00e8s lors que la perception sensorielle suffisait \u00e0 alerter des acqu\u00e9reurs ordinaires lors de la formation du consentement.<\/p>\n<p>B. Les effets de l\u2019apparence sur la garantie l\u00e9gale et la clause d\u2019exon\u00e9ration<\/p>\n<p>La cons\u00e9quence est double. D\u2019une part, la garantie l\u00e9gale des vices cach\u00e9s est inapplicable, le grief n\u2019entrant pas dans son champ. La cour ne discute plus la connaissance du vendeur, car l\u2019article 1642 barre l\u2019action en amont, au stade de la qualification. D\u2019autre part, la clause d\u2019exclusion de garantie \u00e9voqu\u00e9e en premi\u00e8re instance devient sans objet en appel, la solution reposant directement sur l\u2019apparence du d\u00e9faut.<\/p>\n<p>La solution est coh\u00e9rente avec la fonction de la garantie des articles 1641 et suivants, qui prot\u00e8ge l\u2019acheteur contre l\u2019invisible et l\u2019inimputable. Elle rappelle que l\u2019obligation d\u2019examen minimal p\u00e8se sur l\u2019acqu\u00e9reur lors de la visite, sp\u00e9cialement pour des caract\u00e9ristiques mat\u00e9rielles patentes telles qu\u2019une pente, une longueur utile ou un gabarit. La pr\u00e9cision selon laquelle l\u2019acc\u00e8s \u00ab ne peut d\u00e9pendre du type de v\u00e9hicule utilis\u00e9 \u00bb pose un standard raisonnable d\u2019usage, mais elle ne peut suppl\u00e9er la vigilance \u00e9l\u00e9mentaire requise lors de l\u2019achat.<\/p>\n<p>Cette articulation conforte une hi\u00e9rarchie claire des instruments juridiques. Le filtre de l\u2019article 1642 \u00e9vite d\u2019ouvrir des d\u00e9bats probatoires plus lourds sur la connaissance du vendeur au sens de l\u2019article 1643. Elle s\u00e9curise la charge des v\u00e9rifications ordinaires, sans imposer \u00e0 l\u2019acqu\u00e9reur des mesures techniques approfondies, mais en exigeant l\u2019attention port\u00e9e aux caract\u00e9ristiques manifestes du bien.<\/p>\n<p>II. La responsabilit\u00e9 de l\u2019interm\u00e9diaire immobilier et ses limites au regard du litige<\/p>\n<p>A. Port\u00e9e de l\u2019obligation de conseil et d\u00e9faut de causalit\u00e9 directe<\/p>\n<p>L\u2019action dirig\u00e9e contre l\u2019agence immobili\u00e8re s\u2019articulait, du c\u00f4t\u00e9 des acqu\u00e9reurs, autour de l\u2019exactitude des informations relatives aux emplacements de stationnement, et, du c\u00f4t\u00e9 des vendeurs, autour d\u2019un pr\u00e9judice proc\u00e9dural subi du fait des poursuites. La cour rejette l\u2019ensemble. Apr\u00e8s avoir retenu l\u2019apparence de l\u2019anomalie, elle confirme par voie de cons\u00e9quence le rejet des demandes form\u00e9es contre l\u2019interm\u00e9diaire.<\/p>\n<p>La solution s\u2019explique par le d\u00e9faut de lien causal utile. Lorsque le d\u00e9faut est visible, la pr\u00e9sentation commerciale du bien ne constitue pas, \u00e0 elle seule, la cause d\u00e9terminante du dommage all\u00e9gu\u00e9, l\u2019acheteur pouvant se convaincre par lui\u2011m\u00eame de l\u2019inad\u00e9quation de l\u2019acc\u00e8s. L\u2019obligation de v\u00e9rification de l\u2019interm\u00e9diaire n\u2019est pas illimit\u00e9e, et s\u2019appr\u00e9cie \u00e0 l\u2019aune des \u00e9l\u00e9ments accessibles \u00e0 l\u2019acqu\u00e9reur lors des visites, sp\u00e9cialement pour des caract\u00e9ristiques physiques \u00e9videntes.<\/p>\n<p>Du c\u00f4t\u00e9 des vendeurs, la cour \u00e9carte la tentative de translater sur l\u2019interm\u00e9diaire la charge d\u2019un pr\u00e9judice n\u00e9 d\u2019une action contentieuse. L\u2019absence de faute caract\u00e9ris\u00e9e de l\u2019agent \u00e0 leur \u00e9gard et l\u2019insuffisance d\u2019un lien causal direct font obstacle \u00e0 une indemnisation distincte. L\u2019id\u00e9e qu\u2019un contentieux, en tant que tel, constituerait un dommage imputable \u00e0 l\u2019interm\u00e9diaire n\u2019est pas retenue, faute de manquement sp\u00e9cifique et d\u2019imputabilit\u00e9 certaine.<\/p>\n<p>B. Incidences pratiques et port\u00e9e de la d\u00e9cision pour la s\u00e9curit\u00e9 des transactions<\/p>\n<p>La d\u00e9cision clarifie un point d\u00e9licat de pratique. La non\u2011conformit\u00e9 \u00e0 une circulaire technique peut \u00e9tayer l\u2019impropri\u00e9t\u00e9 d\u2019usage, mais elle n\u2019efface pas l\u2019analyse de l\u2019apparence du d\u00e9faut. Les op\u00e9rateurs doivent distinguer les d\u00e9fauts perceptibles des anomalies n\u00e9cessitant des v\u00e9rifications sp\u00e9cialis\u00e9es. Cette distinction conditionne l\u2019outil mobilisable, qu\u2019il s\u2019agisse de la garantie l\u00e9gale ou d\u2019une action en responsabilit\u00e9 contre l\u2019interm\u00e9diaire.<\/p>\n<p>Pour les acqu\u00e9reurs, l\u2019arr\u00eat invite \u00e0 documenter les difficult\u00e9s d\u2019acc\u00e8s constatables avant l\u2019achat et, si n\u00e9cessaire, \u00e0 conditionner la vente \u00e0 des travaux, plut\u00f4t qu\u2019\u00e0 escompter a posteriori la garantie des vices cach\u00e9s. Pour les interm\u00e9diaires, il confirme que l\u2019obligation d\u2019information n\u2019emporte pas l\u2019obligation de suppl\u00e9er la vigilance de l\u2019acheteur sur des caract\u00e9ristiques manifestes, tout en maintenant l\u2019exigence de loyaut\u00e9 sur les \u00e9l\u00e9ments non imm\u00e9diatement visibles.<\/p>\n<p>La solution renforce la pr\u00e9visibilit\u00e9 du contentieux des garages et des acc\u00e8s pentus, domaine propice aux confusions entre inefficacit\u00e9 fonctionnelle et invisibilit\u00e9 juridique. En rappelant que \u00ab il \u00e9tait visible que la pente de la rampe \u00e9tait anormalement forte \u00bb, la cour r\u00e9affirme un crit\u00e8re op\u00e9ratoire, ais\u00e9ment transposable \u00e0 d\u2019autres d\u00e9fauts mat\u00e9riels apparents affectant l\u2019usage courant d\u2019une maison.<\/p>\n<p>Enfin, l\u2019\u00e9quilibre d\u00e9gag\u00e9 nourrit la s\u00e9curit\u00e9 des transactions. L\u2019article 1642 conserve son r\u00f4le de garde\u2011fou contre des demandes qui auraient pu \u00eatre \u00e9vit\u00e9es par une observation attentive. Les articles 1641 et 1643 demeurent disponibles pour les anomalies dissimul\u00e9es ou techniques, que l\u2019expertise seule r\u00e9v\u00e8le.
