Le bien correspond au lot n\u00b05 d\u2019une copropri\u00e9t\u00e9, ferm\u00e9, \u00e9lectrifi\u00e9 et lou\u00e9, situ\u00e9 en rez-de-chauss\u00e9e dans un environnement dense et desservi. L\u2019op\u00e9ration proc\u00e8de d\u2019une d\u00e9claration d\u2019utilit\u00e9 publique de 2019 visant un \u00e9quipement culturel polyvalent, et a donn\u00e9 lieu \u00e0 un transport judiciaire.<\/p>\n<p>L\u2019autorit\u00e9 expropriante a offert 25 200 euros, le commissaire du gouvernement a propos\u00e9 28 500 euros, tandis que l\u2019expropri\u00e9e r\u00e9clamait 50 500 euros. Elle sollicitait aussi 2 400 euros pour perte locative et une indemnit\u00e9 de remploi selon bar\u00e8me, outre une somme au titre de l\u2019article 700. La divergence portait sur la s\u00e9lection des termes de comparaison et sur les ajustements qualitatifs tenant aux caract\u00e9ristiques du box.<\/p>\n<p>La question pos\u00e9e portait sur la d\u00e9termination d\u2019une juste indemnit\u00e9, au regard des articles L. 321-1, L. 322-1 du code de l\u2019expropriation et L. 213-4 du code de l\u2019urbanisme, compte tenu de la date de r\u00e9f\u00e9rence. Le juge a retenu le 4 juillet 2023, appliqu\u00e9 la m\u00e9thode par comparaison et fix\u00e9 une indemnit\u00e9 totale de 32 550 euros, comprenant 26 500 euros au principal, 3 650 euros de remploi et 2 400 euros pour la perte locative, avec d\u00e9pens et ex\u00e9cution provisoire.<\/p>\n<p>I. Le cadre d\u2019\u00e9valuation et sa mise en \u0153uvre<\/p>\n<p>A. La date de r\u00e9f\u00e9rence et ses effets<br \/>\nLe jugement pr\u00e9cise que \u00ab La date de r\u00e9f\u00e9rence \u00e0 prendre en compte est donc le 04 juillet 2023. \u00bb Issue de l\u2019articulation entre l\u2019article L. 322-2 du code de l\u2019expropriation et l\u2019article L. 213-4 a) du code de l\u2019urbanisme, cette fixation r\u00e9sulte de l\u2019opposabilit\u00e9 du plan local d\u2019urbanisme. Elle \u00e9tablit le contexte de march\u00e9 pertinent et borne la prise en compte des \u00e9volutions, afin d\u2019\u00e9carter des r\u00e9f\u00e9rences obsol\u00e8tes ou sp\u00e9culatives.<\/p>\n<p>Ce choix s\u00e9curise le p\u00e9rim\u00e8tre temporel des termes de comparaison et limite le risque de sur\u00e9valuation. Il conforte la lecture d\u2019un march\u00e9 local stabilis\u00e9 \u00e0 l\u2019\u00e9t\u00e9 2023, ce qui contribue \u00e0 l\u2019\u00e9galit\u00e9 de traitement entre propri\u00e9taires concern\u00e9s par la m\u00eame op\u00e9ration.<\/p>\n<p>B. La comparaison comme m\u00e9thode directrice<br \/>\nLe juge rappelle que \u00ab En l\u2019esp\u00e8ce, les parties se sont accord\u00e9es et lient la juridiction quant \u00e0 la m\u00e9thode de fixation de l\u2019indemnit\u00e9, \u00e0 savoir la m\u00e9thode par comparaison. \u00bb La s\u00e9lection privil\u00e9gie des ventes r\u00e9centes, homog\u00e8nes et g\u00e9ographiquement proches, avec une attention particuli\u00e8re aux lots de m\u00eame quote-part dans le m\u00eame immeuble. Elle s\u2019appuie aussi sur la fourchette \u00e9tablie par l\u2019autorit\u00e9 ind\u00e9pendante: \u00ab Le Commissaire du gouvernement rel\u00e8ve notamment une valeur unitaire basse de 18.000 euros, une valeur unitaire moyenne de 26.500 euros et une valeur unitaire haute de 30.000 euros. \u00bb<\/p>\n<p>Le d\u00e9bat sur la hi\u00e9rarchie entre box ferm\u00e9 et place de stationnement est tranch\u00e9 avec prudence: \u00ab Si l\u2019expropri\u00e9e soutient qu\u2019un box ferm\u00e9 pr\u00e9sente une valeur sup\u00e9rieure \u00e0 une place de parking, force est de constater que tel n\u2019est pas n\u00e9cessairement le cas compte tenu des termes de r\u00e9f\u00e9rence vers\u00e9s aux d\u00e9bats. \u00bb Le raisonnement refuse toute prime automatique et r\u00e9int\u00e8gre l\u2019appr\u00e9ciation qualitative concr\u00e8te issue du transport. La conclusion s\u2019accorde avec la valeur centrale de la fourchette: \u00ab Compte tenu de l\u2019ensemble de ces \u00e9l\u00e9ments, l\u2019indemnit\u00e9 principale sera fix\u00e9e \u00e0 la somme de 26.500 euros. \u00bb<\/p>\n<p>II. Appr\u00e9ciation critique et port\u00e9e<\/p>\n<p>A. Les ajustements qualitatifs et la revalorisation<br \/>\nLa d\u00e9cision fonde l\u2019ajustement \u00e0 la hausse sur des qualit\u00e9s intrins\u00e8ques constat\u00e9es: \u00ab Il ressort en revanche du proc\u00e8s-verbal de transport que le bon \u00e9tat g\u00e9n\u00e9ral du bien, b\u00e9n\u00e9ficiant de l\u2019\u00e9lectricit\u00e9, sa taille, et son emplacement tr\u00e8s favorable situ\u00e9 face \u00e0 la [Adresse 11] en rez-de-chauss\u00e9e, directement accessible par la rue (et non en parking souterrain), desservant la [Adresse 12], axe routier important \u00e0 double sens de circulation, facilement accessible, proche de nombreux commerces et des transports en commun (ligne 11 du m\u00e9tro, arr\u00eat de bus n\u00b026), sa taille et son bon \u00e9tat g\u00e9n\u00e9ral, doivent conduire \u00e0 revaloriser le bien \u00e0 la hausse, sur une base proche de la valeur unitaire moyenne relev\u00e9e par le Commissaire du gouvernement. \u00bb Cette motivation lie l\u2019ajustement \u00e0 des facteurs objectivables, ce qui r\u00e9duit l\u2019al\u00e9a et renforce la tra\u00e7abilit\u00e9 de l\u2019\u00e9valuation.<\/p>\n<p>La r\u00e9serve pos\u00e9e sur des avantages non v\u00e9rifi\u00e9s renforce encore la rigueur probatoire: \u00ab la fonctionnalit\u00e9 efficace de ces \u00e9l\u00e9ments n\u2019a pas \u00e9t\u00e9 constat\u00e9e lors du transport sur les lieux. \u00bb La m\u00e9thode consacre ainsi un contr\u00f4le de r\u00e9alit\u00e9, conciliant comparables chiffr\u00e9s et visite, sans c\u00e9der \u00e0 des \u00e9l\u00e9ments incertains. L\u2019\u00e9quilibre atteint limite les effets d\u2019aubaine et stabilise la r\u00e9f\u00e9rence autour de la moyenne observ\u00e9e.<\/p>\n<p>B. Les accessoires indemnitaires et la s\u00e9curit\u00e9 de l\u2019issue<br \/>\nL\u2019accessoire de remploi s\u2019inscrit dans un bar\u00e8me partag\u00e9 qui facilite la pr\u00e9visibilit\u00e9: \u00ab S\u2019agissant de l\u2019indemnit\u00e9 de remploi, celle-ci doit \u00eatre \u00e9valu\u00e9e selon le bar\u00e8me r\u00e9gressif sur lequel les parties s\u2019accordent, \u00e0 savoir : \u00bb. Le chiffrage aboutit \u00e0 3 650 euros, ce qui parach\u00e8ve une indemnit\u00e9 globale coh\u00e9rente avec le principal et le march\u00e9 retenu. S\u2019agissant du revenu manquant, le juge retient le caract\u00e8re direct, mat\u00e9riel et certain de l\u2019atteinte, et tranche sans ambigu\u00eft\u00e9: \u00ab La perte locative sera donc \u00e9valu\u00e9e \u00e0 2.400 euros. \u00bb<\/p>\n<p>La synth\u00e8se est claire et op\u00e9rationnelle: \u00ab En conclusion, l\u2019indemnit\u00e9 d\u2019expropriation totale sera fix\u00e9e \u00e0 la somme de 32.550 euros. \u00bb L\u2019office est compl\u00e9t\u00e9 par la charge des frais et la c\u00e9l\u00e9rit\u00e9 d\u2019ex\u00e9cution: \u00ab En l\u2019esp\u00e8ce, il convient de condamner l\u2019expropriant, \u00e0 l\u2019initiative de la proc\u00e9dure d\u2019expropriation, aux d\u00e9pens. \u00bb Enfin, la force ex\u00e9cutoire est rappel\u00e9e dans le strict cadre l\u00e9gal: \u00ab En cons\u00e9quence, l\u2019ex\u00e9cution provisoire est de droit et aucun \u00e9l\u00e9ment ne justifie de l\u2019\u00e9carter. \u00bb<\/p>\n<p>L\u2019ensemble dessine une grille lisible pour des biens comparables, o\u00f9 la comparaison recentr\u00e9e sur des ventes proches, le contr\u00f4le qualitatif in situ et la prise en compte mesur\u00e9e des accessoires assurent une indemnisation \u00e0 la fois compl\u00e8te et ma\u00eetris\u00e9e.
