Le litige na\u00eet d\u2019un bail d\u2019habitation conclu le 1er janvier 2020 pour un loyer mensuel convenu, suivi d\u2019impay\u00e9s ayant entra\u00een\u00e9 un commandement de payer du 17 ao\u00fbt 2022 puis une assignation d\u00e9livr\u00e9e le 21 d\u00e9cembre 2022. Le juge des contentieux de la protection de Fort-de-France, le 15 mai 2023, a constat\u00e9 l\u2019acquisition de la clause r\u00e9solutoire \u00e0 la date du 18 octobre 2022, ordonn\u00e9 la lib\u00e9ration des lieux, prononc\u00e9 l\u2019expulsion \u00e0 d\u00e9faut et condamn\u00e9 la locataire au paiement d\u2019arri\u00e9r\u00e9s et d\u2019une indemnit\u00e9 d\u2019occupation, outre une somme au titre de l\u2019article 700 et les d\u00e9pens.<\/p>\n<p>Un appel a \u00e9t\u00e9 interjet\u00e9 le 10 juillet 2023. Apr\u00e8s \u00e9changes de conclusions, la pr\u00e9sidence a enjoint aux parties, le 12 mars 2024, de rencontrer un m\u00e9diateur. Un accord a \u00e9t\u00e9 sign\u00e9 le 25 novembre 2024, puis l\u2019intim\u00e9 a demand\u00e9 son homologation, la force ex\u00e9cutoire, l\u2019autorit\u00e9 de la chose jug\u00e9e, l\u2019extinction de l\u2019instance et le d\u00e9sistement r\u00e9ciproque. L\u2019appelante n\u2019a pas conclu post\u00e9rieurement, la cl\u00f4ture est intervenue le 20 mars 2025, et l\u2019affaire a \u00e9t\u00e9 plaid\u00e9e le 20 juin 2025. La question pos\u00e9e tient aux conditions et aux effets de l\u2019homologation d\u2019un accord de m\u00e9diation par le juge d\u2019appel, en pr\u00e9sence de concessions r\u00e9ciproques, malgr\u00e9 l\u2019absence de conclusions subs\u00e9quentes de l\u2019appelant. La cour r\u00e9pond explicitement que \u00ab Conform\u00e9ment aux dispositions des articles 1565 et suivants du code de proc\u00e9dure civile, l&#8217;accord sera homologu\u00e9. Il aura donc autorit\u00e9 de chose jug\u00e9e entre les parties. \u00bb Le dispositif pr\u00e9cise encore \u00ab Ordonne l&#8217;extinction de l&#8217;instance; \u00bb et \u00ab Dit que chacune des parties conservera la charge de ses propres d\u00e9pens. \u00bb<\/p>\n<p>I. Les conditions de l\u2019homologation en appel<\/p>\n<p>A. La caract\u00e9risation d\u2019un accord valable issu de la m\u00e9diation<br \/>\nLe dossier r\u00e9v\u00e8le un accord sign\u00e9 en cours d\u2019instance, apr\u00e8s une injonction de m\u00e9diation, et mat\u00e9rialisant des concessions r\u00e9ciproques. La cour rel\u00e8ve l\u2019abandon, par le bailleur, des condamnations p\u00e9cuniaires prononc\u00e9es en premi\u00e8re instance et, par la locataire, une renonciation proc\u00e9durale dans un contentieux p\u00e9nal connexe. Ce sch\u00e9ma satisfait l\u2019exigence d\u2019un compromis r\u00e9el, r\u00e9v\u00e9lateur d\u2019un consentement \u00e9clair\u00e9 et d\u2019un \u00e9quilibre des prestations, tel que requis pour un accord de m\u00e9diation. L\u2019absence de conclusions post\u00e9rieures de l\u2019appelante n\u2019affecte pas la validit\u00e9 de l\u2019accord d\u00e8s lors que la signature r\u00e9ciproque atteste l\u2019adh\u00e9sion mat\u00e9rielle \u00e0 ses termes.<\/p>\n<p>B. L\u2019office du juge au regard des articles 1565 et suivants du code de proc\u00e9dure civile<br \/>\nLe contr\u00f4le exerc\u00e9 par la cour se concentre sur la r\u00e9alit\u00e9 de l\u2019accord, la qualit\u00e9 du consentement, l\u2019existence de concessions r\u00e9ciproques et l\u2019absence d\u2019atteinte \u00e0 l\u2019ordre public. La motivation, br\u00e8ve et cibl\u00e9e, manifeste ce contr\u00f4le de r\u00e9gularit\u00e9, non d\u2019opportunit\u00e9, en se r\u00e9f\u00e9rant express\u00e9ment au cadre proc\u00e9dural des modes amiables. En validant l\u2019\u00e9quilibre de l\u2019\u00e9change et la pertinence de l\u2019objet, la cour peut, sans m\u00e9conna\u00eetre le contradictoire, homologuer l\u2019acte commun et clore le litige. Elle le dit en des termes clairs: \u00ab Conform\u00e9ment aux dispositions des articles 1565 et suivants du code de proc\u00e9dure civile, l&#8217;accord sera homologu\u00e9. Il aura donc autorit\u00e9 de chose jug\u00e9e entre les parties. \u00bb<\/p>\n<p>II. Les effets de l\u2019homologation sur le litige<\/p>\n<p>A. L\u2019autorit\u00e9 de chose jug\u00e9e, la force ex\u00e9cutoire et l\u2019extinction de l\u2019instance<br \/>\nL\u2019homologation conf\u00e8re \u00e0 l\u2019accord une double efficacit\u00e9, probatoire et ex\u00e9cutoire, en lui attachant l\u2019autorit\u00e9 de la chose jug\u00e9e et la force ex\u00e9cutoire. La d\u00e9cision consacre cette cons\u00e9quence en des termes explicites, puis tire la conclusion proc\u00e9durale attendue. Le dispositif \u00e9nonce \u00ab Ordonne l&#8217;extinction de l&#8217;instance; \u00bb ce qui \u00e9teint l\u2019effet d\u00e9volutif et substitue aux pr\u00e9tentions ant\u00e9rieures l\u2019\u00e9conomie contractuelle de l\u2019accord homologu\u00e9. Le r\u00e8glement des frais suit la logique transactionnelle de neutralisation des co\u00fbts r\u00e9siduels, la cour d\u00e9cidant que \u00ab Chacune des parties conservera la charge de ses propres d\u00e9pens. \u00bb<\/p>\n<p>B. La port\u00e9e mat\u00e9rielle de l\u2019accord et son articulation avec la d\u00e9cision ant\u00e9rieure<br \/>\nL\u2019abandon des condamnations p\u00e9cuniaires de premi\u00e8re instance r\u00e9v\u00e8le l\u2019effet novatoire pratique d\u2019un accord homologu\u00e9 sur le contenu du litige, sans effacer formellement la d\u00e9cision ant\u00e9rieure, mais en la privant de port\u00e9e ex\u00e9cutoire sur les postes abandonn\u00e9s. L\u2019engagement corr\u00e9latif de renonciation proc\u00e9durale, ext\u00e9rieur au litige locatif, demeure admissible tant qu\u2019il ne contrevient pas aux r\u00e8gles d\u2019ordre public ni aux droits indisponibles. La cour, en relevant des concessions crois\u00e9es claires et licites, accepte une pacification globale des rapports entre les parties.
