Le litige porte \u00e0 la fois sur le respect des distances et hauteurs de plantations et sur l\u2019indemnisation du trouble all\u00e9gu\u00e9 sur le fondement de l\u2019article 1240 du Code civil.<\/p>\n<p>Le demandeur sollicite l\u2019\u00e9lagage depuis 2021 et des tentatives de conciliation demeurent infructueuses. La d\u00e9cision souligne sans d\u00e9tour: &#8220;Force est de constater que ce dernier sollicite depuis le mois d\u2019ao\u00fbt 2021 l\u2019\u00e9lagage des sapins dont la hauteur \u00e9tait nettement sup\u00e9rieure \u00e0 celle autoris\u00e9e par la loi.&#8221; Une mesure d\u2019instruction est ordonn\u00e9e et un constat contradictoire intervient.<\/p>\n<p>Le 4 avril 2024, la juridiction retient l\u2019exc\u00e8s de hauteur et l\u2019implantation irr\u00e9guli\u00e8re: &#8220;Le proc\u00e8s-verbal de vue des lieux en date du 04 avril 2024 a constat\u00e9 que la haie litigieuse d\u00e9passe la hauteur de deux m\u00e8tres et qu\u2019elle est implant\u00e9e \u00e0 plus de 50 cm de la limite s\u00e9parative.&#8221; Entre octobre 2024 et avril 2025, la coupe est finalement r\u00e9alis\u00e9e \u00e0 la hauteur requise, ce que le jugement pr\u00e9cise ainsi: &#8220;Il ressort du dossier et des d\u00e9clarations des parties \u00e0 l\u2019audience que la coupe des arbres \u00e0 la hauteur de deux m\u00e8tres a \u00e9t\u00e9 r\u00e9alis\u00e9e entre le mois d\u2019octobre 2024 et le mois d\u2019avril 2025.&#8221;<\/p>\n<p>La question pos\u00e9e est double. D\u2019une part, d\u00e9terminer si la m\u00e9connaissance prolong\u00e9e des r\u00e8gles des plantations engage la responsabilit\u00e9 d\u00e9lictuelle malgr\u00e9 une r\u00e9gularisation finale. D\u2019autre part, pr\u00e9ciser les crit\u00e8res d\u2019indemnisation lorsque seul un trouble moral est \u00e9tabli. La juridiction retient l\u2019article 1240, rappelle la r\u00e8gle de l\u2019article 671 et cantonne la r\u00e9paration \u00e0 un montant symbolique. Elle \u00e9nonce d\u2019abord: &#8220;Aux termes de l\u2019article 1240 du Code Civil, tout fait quelconque de l&#8217;homme, qui cause \u00e0 autrui un dommage, oblige celui par la faute duquel il est arriv\u00e9 \u00e0 le r\u00e9parer.&#8221; Puis, elle pr\u00e9cise l\u2019assiette du dommage indemnisable: &#8220;ne justifie d\u2019aucun pr\u00e9judice particulier, exception faite de celui moral tenant aux tracas engendr\u00e9s par cette situation conflictuelle de longue date.&#8221; En cons\u00e9quence, la r\u00e9paration est limit\u00e9e: &#8220;Il convient de ce fait de limiter le montant des dommages et int\u00e9r\u00eats \u00e0 une somme de 100\u20ac.&#8221; Le dispositif rappelle en outre la r\u00e8gle de voisinage: &#8220;qu&#8217;\u00e0 la distance de deux m\u00e8tres de la ligne s\u00e9parative des deux h\u00e9ritages pour les plantations dont la hauteur d\u00e9passe deux m\u00e8tres.&#8221;<\/p>\n<p>I.<\/p>\n<p>A. Constat de la m\u00e9connaissance des r\u00e8gles de voisinage<\/p>\n<p>La d\u00e9cision combine une v\u00e9rification factuelle et un renvoi normatif pour asseoir la faute. Le constat du 4 avril 2024 \u00e9tablit le d\u00e9passement de hauteur et l\u2019implantation \u00e0 plus de cinquante centim\u00e8tres, ce qui objective l\u2019infraction \u00e0 la discipline des distances. L\u2019\u00e9nonc\u00e9 suivant en atteste en des termes pr\u00e9cis: &#8220;Le proc\u00e8s-verbal de vue des lieux en date du 04 avril 2024 a constat\u00e9 que la haie litigieuse d\u00e9passe la hauteur de deux m\u00e8tres et qu\u2019elle est implant\u00e9e \u00e0 plus de 50 cm de la limite s\u00e9parative.&#8221;<\/p>\n<p>La mise en conformit\u00e9 finale ne purge pas r\u00e9troactivement la violation. Le dispositif rappelle la norme applicable aux plantations d\u00e9passant deux m\u00e8tres: &#8220;\u00e0 la distance de deux m\u00e8tres de la ligne s\u00e9parative des deux h\u00e9ritages pour les plantations dont la hauteur d\u00e9passe deux m\u00e8tres.&#8221; La faute est donc caract\u00e9ris\u00e9e par le maintien prolong\u00e9 d\u2019une situation non conforme jusqu\u2019\u00e0 l\u2019\u00e9lagage effectif.<\/p>\n<p>B. Qualification de la responsabilit\u00e9 et d\u00e9limitation du dommage<\/p>\n<p>La juridiction retient classiquement le fondement d\u00e9lictuel, en rappelant que &#8220;tout fait quelconque de l&#8217;homme&#8221; engage r\u00e9paration en cas de dommage prouv\u00e9. La faute r\u00e9sulte de la persistance d\u2019une haie non conforme, dont la r\u00e9gularisation tardive ne fait pas dispara\u00eetre les effets \u00e9prouv\u00e9s pendant pr\u00e8s de trois ans.<\/p>\n<p>Pour autant, la preuve d\u2019un pr\u00e9judice mat\u00e9riel distinct n\u2019est pas rapport\u00e9e. Le juge borne la r\u00e9paration au trouble moral, selon une formule claire: &#8220;ne justifie d\u2019aucun pr\u00e9judice particulier, exception faite de celui moral tenant aux tracas engendr\u00e9s par cette situation conflictuelle de longue date.&#8221; L\u2019\u00e9valuation retient une somme modeste, destin\u00e9e \u00e0 r\u00e9parer un d\u00e9sagr\u00e9ment r\u00e9el mais limit\u00e9, conform\u00e9ment \u00e0 l\u2019\u00e9conomie du contentieux de proximit\u00e9.<\/p>\n<p>II.<\/p>\n<p>A. Une indemnisation symbolique, guid\u00e9e par la dur\u00e9e et la coresponsabilit\u00e9<\/p>\n<p>La dur\u00e9e anormalement longue de la mise en conformit\u00e9 p\u00e8se dans l\u2019appr\u00e9ciation. La motivation souligne la lenteur fautive par une indication temporelle significative: &#8220;a n\u00e9cessit\u00e9 pr\u00e8s de trois ans pour faire droit \u00e0 la demande l\u00e9gitime de son voisin.&#8221; Cette inertie justifie l\u2019allocation d\u2019une r\u00e9paration, malgr\u00e9 la r\u00e9gularisation intervenue avant le d\u00e9lib\u00e9r\u00e9.<\/p>\n<p>La juridiction tient toutefois compte du contexte relationnel. Elle retient une faute partag\u00e9e dans la d\u00e9gradation des rapports de voisinage, ce que marque la formule: &#8220;le demandeur ayant manifestement \u00e9galement entretenu un climat d\u00e9l\u00e9t\u00e8re entre les parties.&#8221; La somme de 100 euros refl\u00e8te ainsi une indemnisation proportionn\u00e9e \u00e0 un pr\u00e9judice moral certain mais limit\u00e9, att\u00e9nu\u00e9 par la coresponsabilit\u00e9 et par l\u2019ex\u00e9cution finale des travaux.<\/p>\n<p>B. Port\u00e9e pratique en mati\u00e8re de voisinage et rappel des priorit\u00e9s proc\u00e9durales<\/p>\n<p>La d\u00e9cision illustre un sch\u00e9ma \u00e9quilibr\u00e9 en droit des troubles de voisinage. Le juge exige la preuve concr\u00e8te du dommage et distingue nettement la sanction de la non-conformit\u00e9 de l\u2019indemnisation, cantonn\u00e9e au seul trouble moral \u00e9tabli. Le rappel normatif du dispositif s\u00e9curise les comportements futurs en r\u00e9affirmant les distances et hauteurs applicables.<\/p>\n<p>Enfin, la solution encourage la pr\u00e9vention et l\u2019apaisement des conflits de voisinage. Le rejet d\u2019une logique indemnitaire inflationniste, combin\u00e9 au rappel de la r\u00e8gle et \u00e0 la mise en conformit\u00e9, favorise la sortie durable du diff\u00e9rend.
