Le preneur, comparant en personne, a expos\u00e9 r\u00e9gler son loyer en esp\u00e8ces et ne pas savoir \u00e0 qui effectuer les paiements. La question de droit portait sur la recevabilit\u00e9 de l\u2019action en raison du d\u00e9faut de justification de la qualit\u00e9 de bailleresse. La juridiction a ordonn\u00e9 la r\u00e9ouverture des d\u00e9bats pour permettre \u00e0 la demanderesse de produire les pi\u00e8ces n\u00e9cessaires.<\/p>\n<p>I. L\u2019exigence d\u2019un int\u00e9r\u00eat l\u00e9gitime \u00e0 agir conditionne la recevabilit\u00e9 de l\u2019action.<\/p>\n<p>Le juge rappelle que toute pr\u00e9tention \u00e9manant d\u2019une personne d\u00e9pourvue du droit d\u2019agir est irrecevable. Il constate que le contrat de bail mentionne une soci\u00e9t\u00e9 <em>&#8221; BD &#8220;<\/em> comme bailleresse sans lien \u00e9tabli avec la demanderesse. La d\u00e9cision souligne que <em>&#8221; la case relative au bailleur mentionne \u00e0 deux reprises le nom d\u2019une SNC \u2018BD\u2019 &#8220;<\/em> (Motifs). En valeur, cette exigence prot\u00e8ge le d\u00e9fendeur contre des actions mal fond\u00e9es.<\/p>\n<p>Il s\u2019agit d\u2019une application rigoureuse du principe de la contradiction, garantissant un d\u00e9bat loyal. La port\u00e9e de cette d\u00e9cision est de rappeler que le juge ne peut statuer sur des droits incertains. Elle impose au demandeur de d\u00e9montrer sa qualit\u00e9 \u00e0 agir avant tout examen au fond.<\/p>\n<p>II. La r\u00e9ouverture des d\u00e9bats permet de respecter le contradictoire en cas de doute sur les parties.<\/p>\n<p>L\u2019ordonnance rel\u00e8ve que le commandement de payer indique que la demanderesse vient aux droits de la soci\u00e9t\u00e9 <em>&#8221; BD &#8220;<\/em>. Elle constate qu\u2019<em>&#8221; aucune pi\u00e8ce ne permet d\u2019identifier la qualit\u00e9 de cette soci\u00e9t\u00e9 \u2018BD\u2019 &#8220;<\/em> (Motifs). La valeur de cette mesure est de pr\u00e9server l\u2019\u00e9quilibre proc\u00e9dural face aux d\u00e9clarations du locataire.<\/p>\n<p>La port\u00e9e est pratique : la demanderesse devra prouver sa qualit\u00e9 de bailleresse par des actes de cession. Cette solution \u00e9vite un rejet pr\u00e9matur\u00e9 de la demande tout en prot\u00e9geant le preneur.
