Un commandement de payer visant la clause r\u00e9solutoire fut signifi\u00e9 en mai 2024 pour une dette locative.<\/p>\n<p>La locataire n&#8217;ayant pas comparu, le bailleur a sollicit\u00e9 la constatation de la r\u00e9siliation du bail et la condamnation de l&#8217;occupante.<\/p>\n<p>La question de droit portait sur la validit\u00e9 du commandement de payer au regard du d\u00e9lai mentionn\u00e9 et sur l&#8217;acquisition de la clause r\u00e9solutoire pour d\u00e9faut d&#8217;assurance.<\/p>\n<p>Le juge a constat\u00e9 la r\u00e9siliation du bail pour d\u00e9faut d&#8217;assurance, mais a rejet\u00e9 la demande fond\u00e9e sur l&#8217;impay\u00e9 locatif.<\/p>\n<p>I. La nullit\u00e9 du commandement de payer pour vice de forme affectant la r\u00e9siliation pour loyers<\/p>\n<p>Le tribunal a sanctionn\u00e9 l&#8217;irr\u00e9gularit\u00e9 du commandement de payer d\u00e9livr\u00e9 par le bailleur. Il a estim\u00e9 que le d\u00e9lai de six semaines mentionn\u00e9 dans l&#8217;acte avait n\u00e9cessairement induit la locataire en erreur.<\/p>\n<p>Le juge a ainsi \u00e9cart\u00e9 la demande de constat de la r\u00e9siliation du bail pour d\u00e9faut de paiement des loyers. Cette solution rappelle la rigueur formelle impos\u00e9e au cr\u00e9ancier dans la d\u00e9livrance de cet acte.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est de prot\u00e9ger le d\u00e9biteur contre toute ambigu\u00eft\u00e9 dans les actes d&#8217;ex\u00e9cution. Le sens de la d\u00e9cision est de garantir l&#8217;information pr\u00e9cise du locataire sur ses droits et obligations.<\/p>\n<p>II. L&#8217;acquisition de la clause r\u00e9solutoire pour d\u00e9faut d&#8217;assurance et ses cons\u00e9quences indemnitaires<\/p>\n<p>Le tribunal a constat\u00e9 que la locataire n&#8217;avait pas justifi\u00e9 de son assurance dans le mois suivant le commandement. Il a donc d\u00e9clar\u00e9 r\u00e9unies les conditions d&#8217;acquisition de la clause r\u00e9solutoire \u00e0 la date du 16 juin 2024.<\/p>\n<p>Le juge a condamn\u00e9 l&#8217;occupante sans droit ni titre au paiement de l&#8217;arri\u00e9r\u00e9 locatif et d&#8217;une indemnit\u00e9 d&#8217;occupation. Il a rejet\u00e9 la demande de d\u00e9lais de paiement faute d&#8217;\u00e9l\u00e9ment sur la situation de la d\u00e9bitrice.<\/p>\n<p>La valeur de cette solution est de distinguer clairement les deux clauses r\u00e9solutoires et leurs r\u00e9gimes respectifs.
