La cons\u00e9cration des obligations contractuelles du locataire<\/p>\n<p>Le juge a rappel\u00e9 le principe selon lequel &#8220;le locataire est oblig\u00e9 de payer le loyer et les charges r\u00e9cup\u00e9rables aux termes convenus&#8221; (Motifs, r\u00e9f\u00e9rence \u00e0 l&#8217;article 7 de la loi du 6 juillet 1989). La qualit\u00e9 de preneur \u00e9tant \u00e9tablie par le contrat de bail, le locataire devait ex\u00e9cuter son obligation essentielle de paiement. Le d\u00e9compte de cr\u00e9ance produit par le bailleur d\u00e9montrait un solde d\u00e9biteur de 1.109,34 euros, que le locataire ne contestait pas. Cette solution affirme la force obligatoire du contrat et la n\u00e9cessit\u00e9 pour le juge de v\u00e9rifier la preuve de la cr\u00e9ance.<\/p>\n<p>Le tribunal a \u00e9galement retenu la responsabilit\u00e9 du locataire pour les d\u00e9gradations locatives, en application de l&#8217;article 7 c de la loi du 6 juillet 1989. L&#8217;examen comparatif des \u00e9tats des lieux d&#8217;entr\u00e9e et de sortie \u00e9tablissait &#8220;l&#8217;existence de d\u00e9gradations et pertes imputables au locataire&#8221; (Motifs). Le pr\u00e9judice, \u00e9valu\u00e9 \u00e0 2.025,78 euros apr\u00e8s d\u00e9duction du d\u00e9p\u00f4t de garantie, \u00e9tait justifi\u00e9 par des factures. Cette d\u00e9cision rappelle que la preuve des d\u00e9gradations incombe au bailleur mais qu&#8217;un simple constat contradictoire suffit \u00e0 l&#8217;\u00e9tablir.<\/p>\n<p>II. Le refus d&#8217;octroi des d\u00e9lais de paiement<\/p>\n<p>Le juge a examin\u00e9 la demande de d\u00e9lais au regard de l&#8217;article 1343-5 du Code civil, qui permet un report ou un \u00e9chelonnement dans la limite de deux ans. Il a relev\u00e9 que le locataire ne produisait que des \u00e9l\u00e9ments de revenus non actualis\u00e9s, s&#8217;\u00e9levant \u00e0 801,78 euros, et qu&#8217;il \u00e9tait d\u00e9biteur d&#8217;environ 8.000 euros pour d&#8217;autres cr\u00e9ances. Aucune information sur ses charges courantes n&#8217;\u00e9tait fournie, de sorte que les \u00e9l\u00e9ments produits &#8220;ne permettent pas de d\u00e9montrer qu\u2019il est en mesure de s\u2019acquitter de la cr\u00e9ance locative&#8221; (Motifs). La d\u00e9cision souligne que le simple souhait d&#8217;apurer une dette ne suffit pas, le d\u00e9biteur devant d\u00e9montrer sa capacit\u00e9 financi\u00e8re \u00e0 respecter l&#8217;\u00e9ch\u00e9ancier.<\/p>\n<p>Le tribunal a ainsi d\u00e9bout\u00e9 le locataire de sa demande reconventionnelle, estimant que les conditions l\u00e9gales n&#8217;\u00e9taient pas r\u00e9unies. Ce refus illustre le pouvoir souverain du juge d&#8217;appr\u00e9cier la situation du d\u00e9biteur, en \u00e9quilibrant ses besoins avec ceux du cr\u00e9ancier. Le jugement a \u00e9galement condamn\u00e9 le locataire aux d\u00e9pens et \u00e0 une indemnit\u00e9 de 800 euros au titre de l&#8217;article 700 du Code de proc\u00e9dure civile, rappelant que la partie perdante supporte les frais de l&#8217;instance.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>I.
