La locataire reconnaissait la dette et sollicitait des d\u00e9lais pour quitter les lieux. La question de droit portait sur la recevabilit\u00e9 de l\u2019action en raison de l\u2019absence de saisine pr\u00e9alable de la CCAPEX. Le juge a d\u00e9clar\u00e9 la demande irrecevable tout en condamnant la locataire au paiement provisionnel de la dette.<\/p>\n<p>I. L\u2019irrecevabilit\u00e9 de l\u2019action en r\u00e9siliation pour d\u00e9faut de formalit\u00e9 substantielle<\/p>\n<p>Le juge rappelle que la saisine de la CCAPEX est une condition pr\u00e9alable obligatoire pour les bailleurs personnes morales. Il constate que <em>&#8220;la COMMUNE DE [Localit\u00e9 7] ne justifie pas avoir valablement saisi la CCAPEX par voie \u00e9lectronique&#8221;<\/em> (Motifs, page 2). Cette formalit\u00e9 est prescrite \u00e0 peine d\u2019irrecevabilit\u00e9 de l\u2019action.<\/p>\n<p>La valeur de cette solution est de garantir le respect des dispositifs de pr\u00e9vention des expulsions locatives. Elle impose au bailleur une diligence rigoureuse dans la transmission \u00e9lectronique du signalement.<\/p>\n<p>La port\u00e9e de cette d\u00e9cision est de rappeler que l\u2019irrecevabilit\u00e9 sanctionne l\u2019absence de preuve, m\u00eame en cas de dette certaine. Le juge privil\u00e9gie la protection du locataire contre les proc\u00e9dures pr\u00e9cipit\u00e9es.<\/p>\n<p>II. La condamnation provisionnelle fond\u00e9e sur une cr\u00e9ance non contestable<\/p>\n<p>Le juge se fonde sur l\u2019article 835 alin\u00e9a 2 du code de proc\u00e9dure civile pour accorder une provision. Il rel\u00e8ve que la commune <em>&#8220;produit le bail contract\u00e9 avec Madame [K] [X] et un d\u00e9compte arr\u00eat\u00e9 \u00e0 la date du 12 novembre 2025&#8221;<\/em> (Motifs, page 3). La dette de 6773,96 euros <em>&#8220;ne souffre d\u2019aucune contestation&#8221;<\/em> (Motifs, page 3).<\/p>\n<p>La valeur de cette solution est de dissocier la recevabilit\u00e9 de l\u2019action en r\u00e9siliation de l\u2019existence de la cr\u00e9ance locative. Le juge peut ainsi prot\u00e9ger les int\u00e9r\u00eats du bailleur malgr\u00e9 l\u2019irrecevabilit\u00e9 proc\u00e9durale.<\/p>\n<p>La port\u00e9e est de confirmer que le r\u00e9f\u00e9r\u00e9 provision demeure ouvert pour les sommes dues, ind\u00e9pendamment du sort de la r\u00e9siliation.
