Une soci\u00e9t\u00e9 locataire avait cess\u00e9 de payer ses loyers, conduisant \u00e0 la d\u00e9livrance d&#8217;un commandement de payer visant la clause r\u00e9solutoire. La locataire, bien que r\u00e9guli\u00e8rement cit\u00e9e, n&#8217;a pas comparu ni constitu\u00e9 avocat. La question de droit portait sur l&#8217;acquisition de la clause r\u00e9solutoire et le paiement provisionnel des sommes dues. Le juge a constat\u00e9 la r\u00e9siliation du bail au 15 novembre 2025 et condamn\u00e9 la locataire \u00e0 payer une provision.<\/p>\n<p>L&#8217;office du juge des r\u00e9f\u00e9r\u00e9s face \u00e0 une clause r\u00e9solutoire contractuelle.<\/p>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s a constat\u00e9 l&#8217;acquisition de la clause r\u00e9solutoire, confirmant son pouvoir de ne pas suspendre ses effets. Il a relev\u00e9 que <em>&#8220;la soci\u00e9t\u00e9 NIMA n\u2019a pas r\u00e9gl\u00e9 les causes du commandement, ni sollicit\u00e9 de d\u00e9lais pour le r\u00e8glement de cette dette&#8221;<\/em> (Motivation). Cette d\u00e9cision illustre le caract\u00e8re automatique de la clause r\u00e9solutoire en l&#8217;absence de contestation s\u00e9rieuse. La valeur de cette solution est de rappeler le r\u00f4le limit\u00e9 du juge des r\u00e9f\u00e9r\u00e9s, qui ne peut qu&#8217;accueillir la demande. Sa port\u00e9e est de s\u00e9curiser le cr\u00e9ancier en cas d&#8217;impay\u00e9s locatifs non r\u00e9gularis\u00e9s dans le d\u00e9lai l\u00e9gal.<\/p>\n<p>Le principe de l&#8217;indemnit\u00e9 d&#8217;occupation et le respect du principe dispositif.<\/p>\n<p>Le juge a fix\u00e9 l&#8217;indemnit\u00e9 d&#8217;occupation au montant demand\u00e9, soit 41,67 euros par jour, sans appliquer la clause p\u00e9nale du bail. Il a pr\u00e9cis\u00e9 que <em>&#8220;le juge est li\u00e9 par les pr\u00e9tentions des parties et ne peut statuer infra ou ultra petita&#8221;<\/em> (Motivation). Cette solution souligne la soumission du juge aux demandes des parties, m\u00eame en pr\u00e9sence d&#8217;une clause contractuelle plus \u00e9lev\u00e9e.
