Les bailleurs, propri\u00e9taires d&#8217;un logement lou\u00e9 \u00e0 un locataire, avaient d\u00e9livr\u00e9 un commandement de payer visant la clause r\u00e9solutoire. Le locataire, non comparant, n&#8217;a pas contest\u00e9 la demande. La question de droit portait sur la validit\u00e9 de la clause r\u00e9solutoire et l&#8217;octroi de d\u00e9lais de paiement. Le juge a fait droit \u00e0 la demande des bailleurs en constatant la r\u00e9siliation du bail.<\/p>\n<p>I. La recevabilit\u00e9 et l&#8217;acquisition de la clause r\u00e9solutoire.<\/p>\n<p>Le juge v\u00e9rifie d&#8217;abord le respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;action. Il rappelle que <em>&#8220;Lorsque le locataire est en situation d&#8217;impay\u00e9 de loyer ou de charges locatives sans interruption depuis une dur\u00e9e de deux mois&#8221;<\/em> (Article 24 I de la loi du 6 juillet 1989). La saisine de la CCAPEX et la notification au pr\u00e9fet ont \u00e9t\u00e9 effectu\u00e9es dans les d\u00e9lais, rendant la demande recevable. La valeur de cette v\u00e9rification est de garantir le droit au logement du locataire avant toute expulsion.<\/p>\n<p>Le juge constate ensuite que le commandement de payer est demeur\u00e9 infructueux apr\u00e8s le d\u00e9lai contractuel de deux mois. Il applique strictement la clause r\u00e9solutoire pr\u00e9vue au contrat de bail. La port\u00e9e de cette d\u00e9cision est d&#8217;affirmer la force obligatoire des conventions, m\u00eame en l&#8217;absence du locataire. Le bail est donc r\u00e9sili\u00e9 de plein droit \u00e0 compter du 5 mai 2025.<\/p>\n<p>II. Les cons\u00e9quences de la r\u00e9siliation et le refus des d\u00e9lais.<\/p>\n<p>Le juge ordonne l&#8217;expulsion du locataire devenu occupant sans droit ni titre. Il pr\u00e9cise que les meubles suivront le sort pr\u00e9vu par l&#8217;article L433-1 du code des proc\u00e9dures civiles d&#8217;ex\u00e9cution. La valeur de cette mesure est de r\u00e9tablir le droit de propri\u00e9t\u00e9 des bailleurs sur leur bien. La port\u00e9e est l&#8217;application des voies d&#8217;ex\u00e9cution forc\u00e9e.<\/p>\n<p>Enfin, le juge refuse d&#8217;octroyer des d\u00e9lais de paiement au locataire. Il souligne que <em>&#8220;la reprise du paiement int\u00e9gral du loyer courant, condition d&#8217;octroi des d\u00e9lais, est effective&#8221;<\/em> mais que le locataire ne s&#8217;est pas pr\u00e9sent\u00e9 aux rendez-vous sociaux. La valeur de ce refus est de sanctionner l&#8217;absence de coop\u00e9ration du d\u00e9biteur.
