Un syndicat des copropri\u00e9taires, repr\u00e9sent\u00e9 par un administrateur provisoire, avait assign\u00e9 la propri\u00e9taire d&#8217;un lot pour un impay\u00e9 de 45.493,79 euros. La d\u00e9fenderesse, r\u00e9guli\u00e8rement assign\u00e9e, n&#8217;a pas constitu\u00e9 avocat, ce qui a conduit \u00e0 un jugement r\u00e9put\u00e9 contradictoire. La question de droit portait sur la validit\u00e9 de la cr\u00e9ance de charges et sur l&#8217;octroi de dommages-int\u00e9r\u00eats pour le pr\u00e9judice subi par la copropri\u00e9t\u00e9. Le tribunal a fait droit \u00e0 la demande principale et a allou\u00e9 500 euros de dommages-int\u00e9r\u00eats.<\/p>\n<p>La recevabilit\u00e9 de la demande en paiement des charges est \u00e9tablie par les pi\u00e8ces vers\u00e9es aux d\u00e9bats.<\/p>\n<p>Le tribunal rappelle que l&#8217;obligation de payer les charges na\u00eet de l&#8217;approbation des comptes par l&#8217;assembl\u00e9e g\u00e9n\u00e9rale, conform\u00e9ment \u00e0 l&#8217;article 10 de la loi du 10 juillet 1965. Il pr\u00e9cise que <em>&#8220;les appels provisionnels auxquels proc\u00e8de le syndic, dans les limites et sous les conditions pr\u00e9vues par ce texte, constituent une cr\u00e9ance certaine, liquide et exigible&#8221;<\/em> (motifs, page 3). En l&#8217;esp\u00e8ce, les proc\u00e8s-verbaux d&#8217;assembl\u00e9es g\u00e9n\u00e9rales et les d\u00e9cisions de l&#8217;administrateur provisoire sont produits, justifiant le bien-fond\u00e9 de la cr\u00e9ance. La valeur de ce raisonnement est de rappeler que le d\u00e9faut de comparution du d\u00e9fendeur ne dispense pas le juge de v\u00e9rifier le fondement de la demande. La port\u00e9e de cette solution est de s\u00e9curiser le recouvrement des charges pour les syndicats, m\u00eame en l&#8217;absence de contestation.<\/p>\n<p>La condamnation \u00e0 des dommages-int\u00e9r\u00eats distincts du simple int\u00e9r\u00eat moratoire est justifi\u00e9e par un pr\u00e9judice sp\u00e9cifique.<\/p>\n<p>Le juge estime que le non-paiement prolong\u00e9 des charges a <em>&#8220;n\u00e9cessairement perturb\u00e9 la tr\u00e9sorerie et le bon fonctionnement de la copropri\u00e9t\u00e9&#8221;<\/em> (motifs, page 4). Ce pr\u00e9judice, distinct du retard de paiement, est r\u00e9par\u00e9 par l&#8217;allocation d&#8217;une somme de 500 euros. La valeur de cette d\u00e9cision est d&#8217;admettre que le d\u00e9faut de paiement des charges cause un trouble collectif autonome. La port\u00e9e est d&#8217;inciter les copropri\u00e9taires \u00e0 respecter leurs obligations sous peine d&#8217;une double sanction : les int\u00e9r\u00eats l\u00e9gaux et des dommages-int\u00e9r\u00eats. Cette solution confirme une jurisprudence constante visant \u00e0 prot\u00e9ger l&#8217;\u00e9quilibre financier de la copropri\u00e9t\u00e9.<\/p>\n<\/div>\n<style scoped>.fondements-juridiques{margin:40px 0 0;padding:0}.fondements-juridiques>h2{font-size:22px;color:#1a1a1a;border-bottom:2px solid #2c5f8a;padding-bottom:10px;margin-bottom:20px}.fj-article{background:#fdfdfd;border:1px solid #e8e8e8;border-radius:6px;padding:20px;margin-bottom:16px}.fj-article h3{font-size:17px;color:#2c5f8a;margin:0 0 12px;font-weight:600}.fj-texte{font-size:15px;line-height:1.7;color:#333}.fj-texte p{margin:8px 0}.fj-badge{font-size:11px;padding:2px 8px;border-radius:3px;margin-left:8px;font-weight:500;vertical-align:middle}.fj-en-vigueur{background:#e8f5e9;color:#2e7d32}.fj-abroge{background:#ffebee;color:#c62828}.fj-modifie{background:#fff3e0;color:#e65100}<\/style>\n<section class=\"fondements-juridiques\">\n<h2 id=\"fondements-juridiques\">Fondements juridiques<\/h2>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000028352393\" rel=\"nofollow\" target=\"_blank\">Article L. 1421-1 du Code de la sant\u00e9 publique<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Les pharmaciens inspecteurs de sant\u00e9 publique, les m\u00e9decins inspecteurs de sant\u00e9 publique, les inspecteurs de l&#8217;action sanitaire et sociale, les ing\u00e9nieurs du g\u00e9nie sanitaire, les ing\u00e9nieurs d&#8217;\u00e9tudes sanitaires et les techniciens sanitaires contr\u00f4lent, dans le cadre de leurs comp\u00e9tences respectives, l&#8217;application des dispositions du pr\u00e9sent code et, sauf dispositions sp\u00e9ciales contraires, des autres dispositions l\u00e9gislatives et r\u00e9glementaires relatives \u00e0 la sant\u00e9 publique. <\/p>\n<p>Ils peuvent recourir \u00e0 toute personne qualifi\u00e9e, d\u00e9sign\u00e9e par l&#8217;autorit\u00e9 administrative dont ils d\u00e9pendent. Cette personne peut les accompagner lors de leurs contr\u00f4les. Elle peut prendre connaissance de tout document ou \u00e9l\u00e9ment n\u00e9cessaires \u00e0 la r\u00e9alisation de sa mission ou de son expertise, y compris les donn\u00e9es de nature m\u00e9dicale si ladite personne a la qualit\u00e9 de m\u00e9decin ou de pharmacien, dans les conditions pr\u00e9vues \u00e0 l&#8217;article L. 1421-3. <\/p>\n<p>Ils peuvent proc\u00e9der \u00e0 des inspections conjointes avec des agents appartenant \u00e0 d&#8217;autres services de l&#8217;Etat et de ses \u00e9tablissements publics. Lorsque ces personnes qualifi\u00e9es ou ces agents sont des professionnels de sant\u00e9, ils ne peuvent \u00eatre traduits, pour des faits relevant de leur contribution \u00e0 ces missions d&#8217;inspection, devant la juridiction disciplinaire de l&#8217;ordre dont ils rel\u00e8vent, que par le ministre charg\u00e9 de la sant\u00e9, le procureur de la R\u00e9publique ou le directeur g\u00e9n\u00e9ral de l&#8217;agence r\u00e9gionale de sant\u00e9. <\/p>\n<p>Pour l&#8217;accomplissement de missions confi\u00e9es par le ministre charg\u00e9 de la sant\u00e9, les membres de l&#8217;inspection g\u00e9n\u00e9rale des affaires sociales peuvent effectuer des contr\u00f4les en application du pr\u00e9sent article.<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000041398073\" rel=\"nofollow\" target=\"_blank\">Article L. 1421-3 du Code de la sant\u00e9 publique<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Les agents mentionn\u00e9s \u00e0 l&#8217;article L. 1421-1 peuvent recueillir, sur place ou sur convocation, tout renseignement, toute justification ou tout document n\u00e9cessaires aux contr\u00f4les. Ils peuvent exiger la communication et obtenir ou prendre copie, par tout moyen et sur tout support, ou proc\u00e9der \u00e0 la saisie des documents de toute nature, entre quelques mains qu&#8217;ils se trouvent, propres \u00e0 faciliter l&#8217;accomplissement de leur mission et la mise \u00e0 leur disposition des moyens indispensables pour effectuer leurs v\u00e9rifications. Pour le contr\u00f4le des op\u00e9rations faisant appel \u00e0 l&#8217;informatique, ils ont acc\u00e8s aux logiciels et aux donn\u00e9es stock\u00e9es, ainsi qu&#8217;\u00e0 la restitution en clair des informations propres \u00e0 faciliter l&#8217;accomplissement de leurs missions. Ils peuvent en demander la transcription par tout traitement appropri\u00e9 dans des documents directement utilisables pour les besoins du contr\u00f4le.<\/p>\n<p>Ils peuvent pr\u00e9lever des \u00e9chantillons.
