Un bailleur avait assign\u00e9 son locataire d\u00e9faillant, non comparant, en paiement d&#8217;une dette locative et en expulsion. La question de droit portait sur la r\u00e9union des conditions l\u00e9gales et contractuelles de la r\u00e9siliation de plein droit du bail. Le juge a fait droit \u00e0 la demande en constatant l&#8217;acquisition de la clause r\u00e9solutoire au 10 ao\u00fbt 2025 et en ordonnant l&#8217;expulsion.<\/p>\n<p>I. L&#8217;acquisition constat\u00e9e de la clause r\u00e9solutoire<\/p>\n<p>Le juge a v\u00e9rifi\u00e9 la validit\u00e9 proc\u00e9durale du commandement de payer d\u00e9livr\u00e9 au locataire. Il rel\u00e8ve que <em>&#8220;les sommes vis\u00e9es au commandement n&#8217;ayant pas \u00e9t\u00e9 r\u00e9gl\u00e9es ni dans le d\u00e9lai de deux mois selon la clause r\u00e9solutoire inscrite au bail&#8221;<\/em> (Motifs). Cette constatation pure et simple de la r\u00e9siliation de plein droit constitue l&#8217;application de la loi.<\/p>\n<p>La valeur de cette solution est de rappeler le caract\u00e8re automatique de la clause r\u00e9solutoire une fois ses conditions remplies. La port\u00e9e de cette d\u00e9cision est de priver le locataire d\u00e9faillant de tout droit \u00e0 se maintenir dans les lieux sans titre. Le juge n&#8217;a aucun pouvoir pour \u00e9carter la clause lorsque les conditions sont objectivement r\u00e9unies.<\/p>\n<p>II. Le rejet des d\u00e9lais et la fixation des cons\u00e9quences<\/p>\n<p>Le tribunal a refus\u00e9 d&#8217;accorder des d\u00e9lais de paiement suspensifs au locataire absent. Il constate que <em>&#8220;M. [H] [C] non comparant et n&#8217;a pas effectu\u00e9 de reprise du paiement du loyer courant&#8221;<\/em> (Motifs). Cette condition l\u00e9gale imp\u00e9rative n&#8217;\u00e9tant pas remplie, la suspension de la clause r\u00e9solutoire est impossible.<\/p>\n<p>La valeur de ce refus est de subordonner strictement la cl\u00e9mence judiciaire \u00e0 l&#8217;initiative du d\u00e9biteur. La port\u00e9e de la d\u00e9cision est de condamner le locataire \u00e0 payer la dette actualis\u00e9e de 11602,48 euros et une indemnit\u00e9 d&#8217;occupation mensuelle.
