La locataire, assign\u00e9e, n\u2019a pas comparu \u00e0 l\u2019audience. La question de droit portait sur la r\u00e9gularit\u00e9 de la proc\u00e9dure de r\u00e9siliation et le bien-fond\u00e9 des demandes provisionnelles. Le juge a d\u00e9clar\u00e9 l\u2019action recevable, constat\u00e9 la r\u00e9siliation du bail et condamn\u00e9 la locataire au paiement d\u2019une provision.<\/p>\n<p>La recevabilit\u00e9 de l\u2019action conditionne l\u2019examen des demandes au fond par le juge des r\u00e9f\u00e9r\u00e9s. Le juge v\u00e9rifie d\u2019abord le respect des obligations pr\u00e9alables impos\u00e9es par la loi du 6 juillet 1989. Il rel\u00e8ve que la bailleresse a bien saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives plus de deux mois avant l\u2019assignation. Il constate \u00e9galement que l\u2019assignation a \u00e9t\u00e9 notifi\u00e9e au repr\u00e9sentant de l\u2019\u00c9tat dans le d\u00e9partement plus de six semaines avant l\u2019audience. En cons\u00e9quence, il d\u00e9clare l\u2019action recevable, confirmant la n\u00e9cessit\u00e9 de ces formalit\u00e9s protectrices pour le locataire.<\/p>\n<p>Sur le fond, le juge applique la clause r\u00e9solutoire ins\u00e9r\u00e9e au contrat de bail. Il constate que le commandement de payer d\u00e9livr\u00e9 le 24 juillet 2025 est rest\u00e9 sans effet pendant plus de six semaines. Il en d\u00e9duit que la clause r\u00e9solutoire est acquise de plein droit et que le bail est r\u00e9sili\u00e9 \u00e0 la date du 4 septembre 2025. Cette solution illustre l\u2019application m\u00e9canique de la clause r\u00e9solutoire en mati\u00e8re de baux d\u2019habitation.<\/p>\n<p>L\u2019octroi d\u2019une provision au cr\u00e9ancier est subordonn\u00e9 \u00e0 l\u2019absence de contestation s\u00e9rieuse sur l\u2019obligation. Le juge estime que la cr\u00e9ance de loyers et d\u2019indemnit\u00e9s d\u2019occupation n\u2019est pas s\u00e9rieusement contestable. Il condamne la locataire \u00e0 payer une somme provisionnelle de 7606,58 euros, arr\u00eat\u00e9e au 13 janvier 2026. Cette d\u00e9cision confirme le pouvoir du juge des r\u00e9f\u00e9r\u00e9s d\u2019accorder des provisions lorsque l\u2019obligation est certaine.<\/p>\n<p>Le juge refuse toutefois d\u2019assortir l\u2019expulsion d\u2019une astreinte, estimant que le recours \u00e0 la force publique est une mesure suffisante. Il \u00e9carte \u00e9galement la demande relative au transfert des frais d\u2019ex\u00e9cution forc\u00e9e, faute de fondement juridique expliqu\u00e9 par la bailleresse. Ces refus montrent que le juge conserve un pouvoir mod\u00e9rateur dans l\u2019octroi de mesures accessoires.<\/p>\n<p>La port\u00e9e de cette ordonnance est double. Elle rappelle d\u2019abord la rigueur proc\u00e9durale impos\u00e9e aux bailleurs personnes morales pour obtenir la r\u00e9siliation d\u2019un bail. Elle souligne ensuite la force de la clause r\u00e9solutoire, qui produit ses effets de plein droit apr\u00e8s l\u2019expiration du d\u00e9lai l\u00e9gal.
