La bailleresse avait assign\u00e9 les locataires apr\u00e8s un commandement de payer infructueux, sollicitant leur expulsion et une provision. La question portait sur l\u2019acquisition de la clause r\u00e9solutoire et les demandes de d\u00e9lais formul\u00e9es par une occupante comparante.<\/p>\n<p>L\u2019acquisition de la clause r\u00e9solutoire et l\u2019expulsion.<\/p>\n<p>Le juge constate que les conditions de la clause r\u00e9solutoire sont r\u00e9unies \u00e0 la date du 19 octobre 2025. Il rel\u00e8ve que \u201cle commandement est demeur\u00e9 infructueux pendant plus de deux mois, de sorte qu\u2019il y a lieu de constater que les conditions d\u2019acquisition de la clause r\u00e9solutoire contenue dans le bail \u00e9taient r\u00e9unies\u201d (Motifs). La valeur de cette solution est de rappeler le caract\u00e8re automatique de la clause apr\u00e8s un commandement r\u00e9gulier et infructueux. La port\u00e9e est de confirmer que le juge des r\u00e9f\u00e9r\u00e9s peut constater la r\u00e9siliation sans appr\u00e9cier le bien-fond\u00e9 de la dette. Le sens est de prot\u00e9ger le cr\u00e9ancier en \u00e9vitant un d\u00e9bat au fond sur les causes de l\u2019impay\u00e9.<\/p>\n<p>Le rejet des d\u00e9lais de paiement et la fixation d\u2019un d\u00e9lai pour quitter les lieux.<\/p>\n<p>Le juge refuse les d\u00e9lais de l\u2019article 24 de la loi de 1989, mais accorde un mois suppl\u00e9mentaire pour quitter les lieux. Il motive le refus par \u201cl\u2019absence de diminution du montant de la dette et l\u2019\u00e2ge de la bailleresse, accueillie \u00e0 ce jour en \u00e9tablissement d\u2019h\u00e9bergement pour personnes \u00e2g\u00e9es d\u00e9pendantes\u201d (Motifs). La valeur de cette d\u00e9cision est de concilier les int\u00e9r\u00eats en pr\u00e9sence, en tenant compte de la situation personnelle des parties. La port\u00e9e est de limiter la suspension des effets de la clause r\u00e9solutoire aux cas o\u00f9 le locataire d\u00e9montre une capacit\u00e9 s\u00e9rieuse d\u2019apurement.
