Une locataire avait conclu un contrat de location avec option d&#8217;achat le 8 juillet 2021 pour financer un v\u00e9hicule. Le loueur a prononc\u00e9 la r\u00e9siliation du contrat le 6 mars 2024 en raison d&#8217;impay\u00e9s des \u00e9ch\u00e9ances de juillet et ao\u00fbt 2023. La locataire a \u00e9t\u00e9 condamn\u00e9e en premi\u00e8re instance \u00e0 payer 18682,93 euros et \u00e0 restituer le v\u00e9hicule sous astreinte. La question de droit portait sur la validit\u00e9 de la r\u00e9siliation du contrat et des condamnations subs\u00e9quentes. La cour a jug\u00e9 que la r\u00e9siliation \u00e9tait irr\u00e9guli\u00e8re car les impay\u00e9s avaient \u00e9t\u00e9 r\u00e9gularis\u00e9s.<\/p>\n<p>I. L&#8217;absence de cause justifiant la r\u00e9siliation du contrat<\/p>\n<p>La cour constate que la mise en demeure adress\u00e9e par le loueur \u00e9tait d\u00e9pourvue d&#8217;objet. Les motifs de l&#8217;arr\u00eat indiquent que <em>&#8220;la mise en demeure pronon\u00e7ant la d\u00e9ch\u00e9ance du terme [&#8230;] \u00e9tait donc d\u00e9pourvue de tout objet et adress\u00e9e irr\u00e9guli\u00e8rement&#8221;<\/em> (point 13). Cette d\u00e9cision confirme que la r\u00e9siliation unilat\u00e9rale du contrat par le cr\u00e9ancier \u00e9tait abusive. La valeur de cet arr\u00eat est de rappeler que la bonne foi contractuelle impose au cr\u00e9ancier de v\u00e9rifier la r\u00e9alit\u00e9 de la dette avant d&#8217;engager une proc\u00e9dure de r\u00e9siliation. La port\u00e9e de cette solution est de prot\u00e9ger le d\u00e9biteur contre les cons\u00e9quences d&#8217;une action pr\u00e9cipit\u00e9e et infond\u00e9e.<\/p>\n<p>II. La r\u00e9paration du pr\u00e9judice subi par la locataire<\/p>\n<p>La cour alloue \u00e0 la locataire une somme de 2000 euros en r\u00e9paration de son pr\u00e9judice moral et direct. Elle retient que celle-ci <em>&#8220;a subi un pr\u00e9judice direct et certain par le constat de la r\u00e9siliation du contrat, l&#8217;obligation de restituer le v\u00e9hicule&#8221;<\/em> (point 15). Le sens de cette d\u00e9cision est de reconna\u00eetre que la mauvaise foi du cr\u00e9ancier, qui a poursuivi la proc\u00e9dure malgr\u00e9 la r\u00e9gularisation, engage sa responsabilit\u00e9 civile. La valeur de cet arr\u00eat est de sanctionner le comportement abusif d&#8217;un professionnel du cr\u00e9dit.
