Une copropri\u00e9taire, propri\u00e9taire d\u2019un lot depuis 2014, contestait quatre r\u00e9solutions vot\u00e9es le 19 d\u00e9cembre 2023. La question de droit portait sur la caract\u00e9risation d\u2019un abus de majorit\u00e9 dans le refus de lui vendre une partie commune. Le tribunal a d\u00e9clar\u00e9 irrecevable la contestation de la r\u00e9solution n\u00b021 et d\u00e9bout\u00e9 la demanderesse de toutes ses pr\u00e9tentions.<\/p>\n<p>L\u2019irrecevabilit\u00e9 de la contestation de la r\u00e9solution d\u2019information.<br \/>\nLa demanderesse sollicitait l\u2019annulation de la r\u00e9solution n\u00b021, mais celle-ci n\u2019\u00e9tait pas un vote. Le tribunal rappelle que seules les d\u00e9cisions soumises au vote peuvent \u00eatre contest\u00e9es sur le fondement de l\u2019article 42 de la loi de 1965. La r\u00e9solution n\u00b021 \u00e9tant un simple point d\u2019information, la demande est irrecevable. Cette solution confirme la rigueur proc\u00e9durale applicable aux actions en contestation des assembl\u00e9es g\u00e9n\u00e9rales. Elle a une valeur p\u00e9dagogique en ce qu\u2019elle distingue strictement les informations des d\u00e9cisions. Sa port\u00e9e est de limiter le champ du contentieux aux seules d\u00e9lib\u00e9rations ayant fait l\u2019objet d\u2019un suffrage.<\/p>\n<p>L\u2019absence d\u2019abus de majorit\u00e9 dans les r\u00e9solutions n\u00b019, 20 et 22.<br \/>\nLe tribunal \u00e9carte d\u2019abord le moyen tir\u00e9 d\u2019une vente de principe issue d\u2019assembl\u00e9es ant\u00e9rieures. Il estime que ces r\u00e9solutions n\u2019engageaient pas d\u00e9finitivement la copropri\u00e9t\u00e9, faute d\u2019accord pr\u00e9cis sur le lot et le prix. Il retient que \u201cchaque assembl\u00e9e g\u00e9n\u00e9rale \u00e9tant souveraine, il ne peut \u00eatre d\u00e9duit de ces r\u00e9solutions prenant des d\u00e9cisions de principe, l\u2019existence d\u2019une vente acquise\u201d (Motifs). Cette appr\u00e9ciation rappelle le caract\u00e8re non-contractuel des votes pr\u00e9paratoires. Sa valeur est de prot\u00e9ger la souverainet\u00e9 de chaque assembl\u00e9e contre des droits acquis pr\u00e9matur\u00e9s. Sa port\u00e9e est de subordonner la cession de parties communes \u00e0 un acte de disposition expr\u00e8s et d\u00e9finitif.<\/p>\n<p>Le tribunal \u00e9carte ensuite la rupture d\u2019\u00e9galit\u00e9 invoqu\u00e9e par la demanderesse. Il constate que celle-ci ne d\u00e9montre pas de similitude de situation avec les autres copropri\u00e9taires ayant acquis des parties communes. Il souligne que la vente du couloir litigieux n\u00e9cessitait l\u2019accord pr\u00e9alable de la voisine, car elle modifiait la jouissance de son lot. Le juge pr\u00e9cise que \u201cla vente du bout de couloir auquel les lots 162 et 163 ont acc\u00e8s impose n\u00e9cessairement au pr\u00e9alable l\u2019accord de Mme [I]\u201d (Motifs). Cette solution lie l\u2019\u00e9galit\u00e9 de traitement \u00e0 une identit\u00e9 de situation juridique et factuelle. Sa port\u00e9e est de conditionner l\u2019acquisition d\u2019une partie commune au respect des droits des copropri\u00e9taires voisins.<\/p>\n<p>Enfin, le tribunal rejette l\u2019abus de majorit\u00e9 fond\u00e9 sur l\u2019absence de plans ou l\u2019ajout d\u2019une r\u00e9solution d\u2019information. Il estime que ces circonstances ne d\u00e9montrent pas une intention de nuire ou une rupture d\u2019\u00e9galit\u00e9. Il conclut que la preuve d\u2019un abus de majorit\u00e9 n\u2019est pas rapport\u00e9e, d\u00e9boutant la demanderesse de ses demandes principales et subsidiaires. Cette solution rappelle le caract\u00e8re exceptionnel de l\u2019abus de majorit\u00e9 en copropri\u00e9t\u00e9.
