Le locataire, assign\u00e9 par acte d\u00e9pos\u00e9 \u00e0 \u00e9tude, n\u2019a pas comparu. La question de droit portait sur la r\u00e9gularit\u00e9 de l\u2019acquisition de la clause r\u00e9solutoire fond\u00e9e sur l\u2019absence de justification d\u2019une assurance locative. La solution retient que les conditions d\u2019acquisition de la clause r\u00e9solutoire sont r\u00e9unies au 25 juillet 2025.<\/p>\n<p>I. L\u2019acquisition de la clause r\u00e9solutoire pour d\u00e9faut d\u2019assurance<\/p>\n<p>Le juge rappelle que l\u2019obligation d\u2019assurance du locataire est une obligation de premi\u00e8re importance. Il \u00e9nonce que la r\u00e9gularisation tardive, m\u00eame r\u00e9troactive, n\u2019emp\u00eache pas l\u2019application de la clause r\u00e9solutoire.<\/p>\n<p>En l\u2019esp\u00e8ce, un commandement de justifier d\u2019une assurance a \u00e9t\u00e9 signifi\u00e9 le 24 juin 2025. Le locataire, non comparant, ne justifie pas de cette assurance.<\/p>\n<p>Le juge constate que le commandement est demeur\u00e9 infructueux pendant plus d\u2019un mois. Il en d\u00e9duit que \u201cles conditions d\u2019acquisition de la clause r\u00e9solutoire contenue dans le bail sont r\u00e9unies \u00e0 la date du 25 juillet 2025\u201d (Motifs).<\/p>\n<p>La valeur de cette solution est de rappeler la rigueur de l\u2019obligation d\u2019assurance. La port\u00e9e est de sanctionner fermement le locataire qui ne justifie pas de son assurance dans le d\u00e9lai l\u00e9gal.<\/p>\n<p>II. La condamnation provisionnelle au paiement des sommes dues<\/p>\n<p>Le juge constate que le locataire est redevable des loyers impay\u00e9s jusqu\u2019\u00e0 la r\u00e9siliation du bail. Il rappelle que le maintien dans les lieux constitue une faute civile ouvrant droit \u00e0 r\u00e9paration.<\/p>\n<p>Le juge fixe l\u2019indemnit\u00e9 d\u2019occupation au montant du loyer et des charges, soit 521,21 euros. Il condamne le locataire \u00e0 payer une provision de 9.743,77 euros selon le d\u00e9compte arr\u00eat\u00e9 au 7 janvier 2026.<\/p>\n<p>Le juge pr\u00e9cise que le locataire, non comparant, n\u2019apporte aucun \u00e9l\u00e9ment pour contester le principe ou le montant de la dette. La valeur de cette solution est de rappeler le caract\u00e8re non s\u00e9rieusement contestable de l\u2019obligation de payer.
