La commune locataire se plaignait d\u2019infiltrations d\u2019eau et d\u2019odeurs naus\u00e9abondes rendant les locaux difficilement utilisables par les associations h\u00e9berg\u00e9es. Apr\u00e8s plusieurs mises en demeure rest\u00e9es infructueuses, elle a assign\u00e9 la bailleresse en r\u00e9f\u00e9r\u00e9 pour obtenir la condamnation \u00e0 r\u00e9aliser les travaux sous astreinte et la suspension du paiement des loyers.<\/p>\n<p>La question de droit portait sur la comp\u00e9tence du juge des r\u00e9f\u00e9r\u00e9s pour ordonner des travaux de grosses r\u00e9parations et suspendre l\u2019ex\u00e9cution du contrat de bail. Le juge a partiellement fait droit aux demandes en ordonnant les travaux mais en rejetant la suspension des loyers.<\/p>\n<p>I. L\u2019obligation de faire du bailleur consacr\u00e9e en r\u00e9f\u00e9r\u00e9<\/p>\n<p>Le juge des r\u00e9f\u00e9r\u00e9s a retenu que les infiltrations d\u2019eau constituent un trouble manifestement illicite justifiant une mesure conservatoire. Il a relev\u00e9 que la nature de ces d\u00e9sordres impliquait des travaux de grosses r\u00e9parations au sens de l\u2019article 606 du Code civil. <em>&#8220;La juridiction ce c\u00e9ans ne retiendra, en cons\u00e9quence que les griefs tenant aux fuites d&#8217;eau, d&#8217;une part, et aux mauvaises odeurs d&#8217;autre part, qui constituent \u00e0 l&#8217;\u00e9vidence des travaux de grosses r\u00e9paration&#8221;<\/em> (Sur ce, 1). Le juge a ordonn\u00e9 l\u2019ex\u00e9cution des travaux selon le devis produit par la bailleresse elle-m\u00eame, assortie d\u2019une astreinte.<\/p>\n<p>Cette d\u00e9cision affirme le pouvoir du juge des r\u00e9f\u00e9r\u00e9s de contraindre le bailleur \u00e0 ex\u00e9cuter son obligation de d\u00e9livrance. La valeur de la solution est d\u2019appliquer l\u2019article 873 du Code de proc\u00e9dure civile \u00e0 une obligation de faire non s\u00e9rieusement contestable. En ordonnant les travaux sur la base d\u2019un devis adverse, le juge \u00e9vite une expertise longue et pr\u00e9serve l\u2019urgence.<\/p>\n<p>II. Le refus de suspendre le paiement des loyers<\/p>\n<p>Le juge a rejet\u00e9 la demande de suspension des loyers en estimant que la commune n\u2019avait pas prouv\u00e9 l\u2019impossibilit\u00e9 d\u2019utiliser les lieux. <em>&#8220;la commune \u00e9choue \u00e0 d\u00e9montrer que les infiltrations seraient d&#8217;une telle importance qu&#8217;elles rendraient les locaux impropres \u00e0 l&#8217;usage auquel ils sont destin\u00e9s&#8221;<\/em> (Sur ce, 2). Le versement du loyer demeure l\u2019obligation principale du preneur, et l\u2019exception d\u2019inex\u00e9cution ne peut jouer qu\u2019en cas d\u2019impossibilit\u00e9 totale de jouissance.<\/p>\n<p>Cette position rappelle le caract\u00e8re exceptionnel de la suspension des loyers en r\u00e9f\u00e9r\u00e9. La port\u00e9e de cette solution est de subordonner la mesure \u00e0 un pr\u00e9judice grave et actuel, non \u00e0 un simple inconfort.
